A RESOLUTION OF THE CIl~ COUNCIL OF THE
CITY OF DELHAY BEACH, FLORIDA, ORDERING
THE CONSTRUCTION OF FIVE (5) FOOT SIDE-
WALKS AND CUHB ON THE NORTH AND SOUT~
SIDES OF NORTH EAST SECOND STHEET, BE-
TWEEN NORTH SWINTON AVENUE AND U. S. NO.

WHEBEAS, the City Council of the City of Delray Beach,
Florida, did, on the tenth (10th) day of June, 19~?, adopt a
Resolution ordering the City Hanager to prepare plans and speci-
fications, together with estimate of cost for the construction
of sidewalks and curb on the North and South sides of North East
Second Street, between North Swinton Avenue and U. S. No. 1 (Fed-
eral Highway) and requiring said plans, specifications and esti-
mated cost of such construction to be placed on file in the office
of the City ~anager, and
WHEREAS, the City Council deems it to be necessary for
the safety and convenience of the public to make the above de-
scribed improvement to North East Second Street, between North
Swinton Avenue and U. S. No. 1 (Federal Highway),
NOW, THEHEFORE, BE IT RESOLVED by the City Council of
the City of Delray Beach, Florida, that it is determined to make
the following described l~provement, to-wit;
Construct Five (5) Foot Sidewalks
and Curb on the North and South
sides of North East Second Street,
between North Swinton Avenue and
U. S. No. 1 (Federal Highway), the
total cost, as estimated, for such
improvement, being $10,450.00.
BE IT FUHTBER HESOLVED that the entire cost of-such im-
prove~mnt shall be shared by the City of Delray Beach, Florida,
and the following described properties ~n Delray Beach, Palm Beach
County, Florida, on a basis of the City of Delray Beach paying
sixty five (65) per cent of the cost of said improvement, and the
abutting properties, sho~ below, paying thirty five (35) per cent

said benefits to be dete~mined and prorated according to the front
footage of the respective properties as set forth immediately a-
bove.
BE IT FURTBER BESOLVEB that said special assessments a-
gainst all the lots and lands as set forth herein which are speci-
ally benefitted, shall be and remain liens superior in dignity to
all other liens, except liens for taxes, until paid, from the date
of the assessment upon the respective lots and parcels of land as-
sessed, and which shall bear interest at the rate of eight (8) per
cent per annum, and which may be paid in three (3) equal yearly in-
stallments with accrued interest on all deferred payments. Payment
shall be made at the same place that taxes payable to the City of
Delray Beach, Florida, are paid; namely, at the office of the City
Tax Collector, and upon failure of any property owner to pay any
annual installment due, or any part thereof, or any ~nnual inter-
est upon deferred payments, the City of Delray Beach may bring ne-
cessary legal proceedin~s by a Bill in Chancery to enforce payment
thereof with all accrued interest, together with all legal costs
incurred, includin~ a reasonable attorney's fee. The total amount
of any lien may be paid in full at any time with interest f~om the
date of assessment.
IT IS 0BDF~ that the City Council shall sit at the City
Hall in the City of Delray Beach, Florida, at ?t30 P.M. t on ~onday
Jtme 2~tht 1957., for the purpose of hearing objections,
if any, on said proposed improvement, as set forth herein.
IT IS FURTHER OKBERED that this Resolution be published
once a week for two (2) consecutive weeks.
PASSED AND ADOPTED by the City Council of the City of
Delray Beach, Florida, on this the 10th day of June, A.Do~
