AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING TITLE V, "PUBLIC
WORKS", C~APTER 51, "GARBAGE AND TRASH", SUB-
HEADING, "SPECIAL REFUSe. DISPOSAL PROB?.WJ~S", BY
ENACTING A NEW SECTION 51.59, "RECYCLING BINS AND
CONTAINERS", TO PROVIDE THAT IT SHALL BB. UNLAWFUL
FOR ANY UNAUTHORIZED PERSON OR AGENT TO REMOVE
ARTICLES OR OTHERWISE DISTURB MATERIALS IN THE
CITY'S RECYCLING BINS, OR TO REPROVE, DAMAGE, OR
DESTROY SAID RECYCLING BINS, OR TO ~ ARTICLES
OR OTHERWISE DISTURB MATERIALE IN CURB$IDERECYCLIN~
CONTAINERS, OR TO REMOVE, DAMAGE OR DESTROY CURB
RECYCLING COt~fAINERS; PROVIDING A GENERAL REPE~?-~R
CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
NOW, TMRREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS=
Section 1. That Title V, "Public Works", Chapter 51, "Garbage
and Trash", Subheading, "Special Refuse Disposal Problems", of the Code
of Ordinances of the City of Delay Beach, Florida, be and the same is
hereby amended by enacting a new Section 51.59, "Recycling Bins and
Containers", to read as follows:
59.59 RECYCLING'BINS AND CONTAINERS
It shall be unlawful for any unauthorized person or agent to
remove articles or to otherwise disturb materials in the City's
recycling bins or tc remove, damage or destroy said recycling bins.
it shall be unlawful for any unauthorized person or agent to remove
articles or otherwise disturb materials in curbside recycling
containers, or to remove, damage or destroy curbside recycling
containezs.
Sectien 2. That all ordinances or parts of ordinances which
are in conflict herewith are hereby repealed.
Section 3. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity or the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 4. That this ordinance shall become effective
immediately upon its passage on second and final reading.
