09-87 ORDINANCE NO. 9-87
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AMENDING
SECTION 2(a) OF ORDINANCE NO. 33-85, WHICH
ESTABLISHED SAD (SPECIAL ACTIVITIES) DISTRICT
FOR PROPERTY LOCATED SOUTH OF DOTTEREL ROAD,
IF EXTENDED EAST, BETWEEN JAEGER DRIVE AND
THE F.E.C. RAILROAD, BY DELETING THE WORD
"BALLPLAYERS" AND ADDING THE WORDS "ATHLETES
AND/OR STUDENTS" TO MORE ACCURATELY DESCRIBE
THE CONDITIONAL USE WHICH IS PERMITTED IN
THIS SAD ZONING DISTRICT; PROVIDING A SAVING
CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the requested modification to Ordinance No.
33-85, which rezoned The Baseball School, Ltd. to SAD (Special
Activities) District, has been determined by the Planning Staff
to be non-impacting; and,
WHEREAS, the modification, nonetheless, requires a
technical revision to Ordinance No. 33-85,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Ordinance No. 33-85, Section 2(a) is
hereby amended to read as follows:
(a) The only conditional uses to be
permitted hereunder are as follows:
Sports Training Facility, specifically
being 26 dwelling units to house
~~Fe~ athletes and/or students
attending The Baseball School, with
attendant lecture/dining hall and lounge
area.
Section 2. That should any section or provision of
this ordinance or any portion thereof, any paragraph, sentence,
or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not a£fect the validity of the
remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 3. That this ordinance shall become effective
immediately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and
final reading on this the 10th day of February , 1987.
