PRODUCTS - PLAYRGOUND EQUIPMENT VETERAN'S PARK
BACKGROUND
The playground at Veteran's Park is one of the most utilized playgrounds in Delray Beach.
The existing wood playgrounds (2), by Leathers & Associates, were constructed through a
community build model in 1993. Over the last 21 years, the playground has been utilized to its
fullest potential by all ages. The structure has been maintained by Park Maintenance staff,
which coordinates repairs in response to issues identified through regular inspections. Due to
the age of the structures, replacement parts are limited and very difficult to obtain. The
structure has met its useful life and is in need of replacement.
DISCUSSION
Parks & Recreation is requesting Commission approval, through a Best Interest Resolution, to
enter into a contract with Gametime/Dominica Recreation Products, Inc. in the amount of
$92,192.84. Gametime/Dominica Recreation Products, Inc. submitted the lowest proposal
price for playground equipment, installation and engineered wood fiber which will cover and
area 97'x 46' and serve ages 2 - 12. Gametime/Dominica Recreation Products, Inc. is able to
offer the lowest price due to a special end of fiscal year promotion that involves 2015
equipment. The proposed playground will be ADA compliant and able to be relocated if future
park plans locate it in another area of the park. Park Maintenance and volunteers from the
community will be responsible for removal of the existing playground and basic site
preparation. The name plates on the existing playground will be removed an incorporated into
an art piece to be located within the park.

This is time sensitive as the existing playground has met its useful life and continues to be
heavily used by the community on a daily basis. The replacement of this playground will
reduce liability to the City associated with the existing playground. The Parks & Recreation
department would like to have a new playground installed before the end of 2015.

Payment Terms: Governmental Purchase Order.
Purchases in excess of $1,000.00 to be supported by your written purchase order made out to GameTime.
Net 30 days subject to approval by GameTime Credit Manager. A completed Credit Application and Bank Reference Authorization, must be
received with the order. The decision on credit is the sole discretion of GameTime/PlayCore. A 1.5% per month finance charge will be imposed
on all past due accounts.
Multiple Invoices: Invoices will be generated upon services rendered. When equipment ships it will be invoiced seperately from installation
and/or other services. Terms are Net 30 for each individual invoice.
This Quotation is subject to policies in the current GameTime Park and Playground Catalog and the following terms and conditions. Our
quotation is based on shipment of all items at one time to a single destination, unless noted, and changes are subject to price adjustment.
Pricing: Firm for 60 days from date of quotation.
Shipment: F.O.B. factory, order shall ship within 45 days after GameTime's receipt and acceptance of your purchase order, color selections,
approved submittals, and receipt of payment.
Taxes: State and local taxes will be added at time of invoicing, if not already included, unless a tax exempt certificate is provided at the time of
order entry.
Exclusions Unless specifically discussed, this quotation excludes all sitework and landscaping; removal of existing equipment; acceptance of
equipment and off-loading; storage of goods prior to installation; security of equipment (on site and at night); equipment assembly and
installation; safety surfacing; borders; drainage; signed/sealed drawings; or permits.
Installation Terms: Shall be by a Certified Installer. If playground equipment, installer will be NPSI and Factory Trained and Certified.
Customer shall be responsible for scheduling and coordination with the installer. Site should be level and allow for unrestricted access of trucks
and machinery. Customer shall be responsible for unknown conditions such as buried utilities, tree stumps, rock, or any concealed materials or
conditions that may result in additional labor or material costs. Customer will be billed hourly or per job directly by the installer for any
additional costs that were not previously included.
Unitary Surfacing Notes : The installer of the Unitary Surfacing (Poured, Bonded, Turf, Tiles) is not the same installer of the playground
equipment. However, your certified equipment installer will coordinate the timing of the unitary surfacing installation, but more than likely they
will not be on-site at the time. They will continue to be your contact should you have any questions. Security is needed to protect surfacing at
night or after installation as the product set. Normally it is not needed or a concern, however in some areas additional security is needed to
prevent vandalism. Security is not included. Vandalism will be the responsible of the owner.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, APPROVING THE PURCHASE OF SPECIFIC PLAYGROUND
EQUIPMENT FROM GAMETIME, INC FOR VETERANS PARK; DECLARING BY
A FOUR-FIFTHS AFFIRMATIVE VOTE THAT THE CITY'S SEALED
COMPETITIVE METHOD OR WRITTEN QUOTATIONS PROCUREMENT
METHOD FOR THE PURCHASE IS NOT IN THE BEST INTEREST OF THE CITY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Veterans Park playground has one of the highest utilization rates in the City; and
WHEREAS, the two (2) existing wood playground structures were constructed in 1993; and
WHEREAS, due to the age and materials of this equipment, replacement parts are limited and
difficult to obtain; and
WHEREAS, the existing playground equipment does not meet the standards articulated in the
current ADA code; and
WHEREAS, due to the age and condition of this equipment, there is an increased risk to those
who utilize the playground; and
WHEREAS, in order to keep residents safe, this equipment needs to be removed as soon as
possible; and
WHEREAS, the removal of this equipment will leave a large vacant area in Veterans Park; and
WHEREAS, it is in the best interest of the city to obtain replacement equipment as quickly as
possible to maintain the aesthetics of Veterans Park and provide safe equipment for this highly utilized
area; and
WHEREAS, as part of its efforts to update the 2010 Veterans Park conceptual master plan, the Parks
and Recreation Department has collaborated with the CRA to design a playground for Veterans Park, which
may be relocated (no permanent surfacing material will be included with this phase of development);
WHEREAS, the Parks and Recreation Department contacted three playground companies for
proposals;
WHEREAS, the Parks and Recreation Department received the lowest proposal from GAMETIME
c/o DOMINICA RECREATION PRODUCTS, INC., in the amount of $92,192.84 per quote #72398;
WHEREAS, GAMETIME, INC. is a member of U.S. Communities, the leading national cooperative
purchasing program for schools, state and local public agencies, non-profit organizations and housing
authorities;
WHEREAS, GAMETIME c/o DOMINICA RECREATION PRODUCTS, INC. certified that the
U.S. Communities contract is the biggest discount from list price contract that is offered in the State of Florida;
WHEREAS, the Parks and Recreation Department has utilized and installed GAMETIME, INC.
playground equipment in other parks and is satisfied with the construction and durability of the equipment;
WHEREAS, City staff requests that the City be authorized to enter into a contract with GAMETIME,
INC. c/o DOMINICA RECREATION PRODUCTS for the purchase of specific playground equipment and
installation of said equipment per quote #72398 in the amount of $92,192.84; and
WHEREAS, Section 36.02(c)(11) of the City's Code of Ordinances provides that the City may acquire
or contract for non -real property, goods or services without utilizing a Sealed Competitive Method or the
Written Quotation Method where the City Commission declares by at least a four -fifth (4/5) affirmative vote
that the Sealed Competitive or the Written Quotation Method is not in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct
factual findings and are made a specific part of this Resolution.
Section 2. The City Commission of the City of Delray Beach hereby declares, by a minimum four-
fifths affirmative vote, that the City's Sealed Competitive Method or Written Quotations Procurement Method
is not in the best interest of the City. The City Commission declares that the acquisition of playground
equipment from GAMETIME, INC. c/o DOMINCA RECREATION PRODUCTS, attached as Exhibit "A",
is in the best interest of the City.
Section 3. The City Manager is authorized to do all things necessary and expedient to carry out the
aims of this Resolution.
Section 4. This Resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED by the City Commission of the City of Delray Beach this the day
