51-77 ORDINANCE NO. 51-77 AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 9-2 of CHAPTER 9 "BUILDING CODE" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY ADOPTING THE 1976 EDITION OF THE STANDARD MECHANICAL CODE; EXCEPT FOR SECTION 106.3 -SCHEDULE OF PERMIT FEES; ESTABLISHING FEES; PROVIDING AN EFFECTIVE DATE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY CLAUSE. WHEREAS, the Contractors Board of Examiner~, a committee of local architects and the Chief Building Official have reviewed the 1976 edition of the Standard Mechanical Code and recommended that it be adopted with amendments thereto; and, WHEREAS, the City Administration concurs with the recommendations of the Contractors Board of Examiners, a committee of local architects and the Chief Building Official; and, WHEREAS, the City Council of the City of Delray Beach deems it to be in the best interests of the citizens of Delray Beach to make the changes recommended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ~HE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 9-2. of Chapter 9 "Building Code" of the"Code of Ordinances, be amended to read as follows: SECTION 9-2. $~W~KERN STANDARD MECHANICAL CODE ADOPTED BY REFERENCE; FEES. (a) The ~9~ 1976 edition of the SeH~keF~ Standard Mechanical Code is hereby adopted as the mechanical code for the City of Delray Beach except for Section 106.3- Schedule of Permit Fees. (b) The Schedule of fees to be changed under the 8eH~ke~ Standard Mechanical Code is as follows: (1) Issuing each permit, five dollars ($5.00). (2) Fees shall be five dollars ($5.00) for each one thousand dollars ($1,000.00) of valuation or portion thereof of the work to be done new, repairs or alterations. (3) Fees for all inspectfons and reinspections shall be eight dollars ($8.00). Section 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. That any person, firm or corporation violating any of the provisions of Section 1 above, shall upon conviction, be punished as provided in Section 1-6 of the Code of Ordinances of the City of Delray Beach. Section 4. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. This ordinance shall take effect i~ediately upon passage. PASSED AND ADOPTED in regular session on second and final reading on this the 25th day of July , 1977.
