That Title v, "Public Works" Chanter 5~, "Water", "General Provisions", of the Code of Ordi, ancos of the City of Delra,~ Beach, Florida, be, the same is hereby repealed and a new Section 5~.03 "Use of Water From ~,rdrants", hereby enacted to read ss follows: 52.03 Use of Water From Hydrants. (g) Fire hydrants sh~ll not bo use0 for obtai,i,~ potoble wator, under certain extenuating circumstances wherein o request, which must be writing, may be made to the Director of Public Utilities or his/her designee permission to use a fire hydrant for potable water on ap~ ~nterim nv temnor0r,, basis. The Director of Public Utilities or his/her designee must snnro~ro such requests. (B) If permission to use a fire h,,drant is ~nnroved h,~ ~ho Director Public Utilities, or his/her designee, on an interim ond tempor0r,~ basis, applicant shall bo required to submit an anDlieation including a minimum deposit of $350. The customer charw~s and capacity char~os ~nr a two-i~ch motor as set forth in Section 52.34, shall he duo and na,rohlo ooch apd month, for as long as the motor is installed, regardless of ,,,bother tho is octually turned on avd without re~ard to usaffo. All charges must he noid in full before the deposit of $350 is r~turned to the customer. Section 2. That should any secffon or ¢rovision o~ this erdipanco or portion thereof, on2r para~rs, ph, sentonce, or word bo declared b,~ a court of jurisdiction to bo invalid, such decision shall not affect the validity of tho romainder hereof as a whol~ or part thereof other than the hart declared to b, invalid. Section 3. That all ordinances or parts of ordinances which are in cnnflic* herewith are hereby repealed. Section 4. That this ordinance shall become effective ten (10) da--s after its passage on second and final reading.
