Res 1353-61 B~CH, FLORIDA, ASSESSING COSTS FOR A~TING N~ISANCES UPON CERTAIN ~S LOCATED ~IN SAID CI~: SETTING O~ ACTUAL COSTS INCheD BY SAID CI~ TO ACC0~LISH SUCH A~TE~ A~ L~ING ~E COST OF SUCH A~TE~ OF EA~ ~IBANC~, A~ DEC,RING SA~ ~ TO BE A LI~ UPON SAID PRO~R~ IN AN AMO~T AS SHO~ BY ~PORT OF T~ CITY ~NAGER OF DE~Y B~CH, ~LORIDA. ~AS, the City Council of the City of Del~ay Beach, did, in regular and/aP session held on the 12t~ .a%~ .~6th of _ June,_~l~61 declare the existence of a nui- s'~Ce upon certal~ l°ts~ o~ar~61s of land, described in a list sub- mitted to them, for violation of the provisions of Ordinance G-~7; ~~S, pursuit to such declaration, the City Clerk of said City did f~nish each of the respective o~ers of the lands described in said list with a notice describing the nat~e of the nuisance and that they must abate said nuisance within thirty (30) days, failing in which the City Council would have it done, ~d the cost thereof would be levied as an assessment against said property; and ~E~S, the o~ers hereinafte~ named did fail and neglect to abate the nuisance e~sting upon their respective lands within the time prescribed in said notice and Ordinance G-~7, and the City of Delray Beach was required to and did ente~ upon the following lands and incur costs in abating the nuisance existing thereon as described in'the aforesaid list; ~d ~AS, the City M~ager of the City of Delray Beach, has, pur- suant to said Ordinance G~-~7 and the City Charter submitted to the City Council a report of the costs incurred in abating the nuisance as aforesaid, said report indicating the costs per parcel of land involved, NOW, T~O~, BE IT ~SOLVED BY THE CITY CO~CIL OF T~ CI~ OF DEL~Y B~CH, F~R~A, AS FOLLOWS: 1. That assessments in t~ individual ~ounts as shown by the r~port of the City M~ager of the Cit2 of Delray Beach, involving the City's cost of abating the aforesaid nuisances upon the lots or par- c,ls of land described in said report, a copy of which is attached hereto and made a part hereof, are levied against the p~cels of land described on said report and in the ~o~ts indicated thereon. Said ~ssessments so levied shall be a lien upon tho respective lots and parcels of land described in said report, of ~e sa~e ~.ature and to the same extent as the lien for general city taxes and ~hall be collectible in the s~e maker and with the s~e penalties and under the same provisions as to sale and foreclosure as city taxes are collectible. 2. ~at the Ci~ Clerk of said City shall, as soon as possible after the effective date, record a certified copy of this resolution in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, and shall furnish to each of the owners n~ed in and upon said report a notice that the Ci~ Council of the City of Delray Beach, did, on the ~2~h and 26th of. ~Mne, 1961 order the abatement- of a cerbain nuks~ce' ex~sting on"t~i~ described property ~d property o~er having failed to abate such nuisance, within the 30 day period, whereupon it was abated by the City at costs sho~ in said report and such assessments shall be legal, valid and binding obligations upon the property against which said assessments are levied. This resolution shall become effective 30 days from the date of adoption, and the assessments contained herein shall become due and payable thirty days ~ter the mailing date of the notice of said assessment, ~te~ which interes.t shall accrue at the rate of 6% per a~ on any unpaid portion thereof.
