AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE
CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 96.16,
"CERTAIN CODES ADOPTED BY REFERENCE", BY REPEALING
SUBSECTION (B)(5) IN ORDER TO PROVIDE UPDATED REFERENCES;
PROVIDING A SAVING CLAUSE, A GENERAL REPEALER CLAUSE, AND
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Delray Beach, Florida, desires to reference
current Florida Fire Prevention Code sections and eliminate outdated references.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 96.16, "Certain Codes Adopted by Reference", Subsection
(B)(5) shall be hereby repealed and Subsection (B)(6) shall be renumbered as follows:
Sec. 96.16. CERTAIN CODES ADOPTED BY REFERENCE.
({j ~ Section 7-7.1.1 is amended to include the following language:
Remote monitoring locations shall not be permitted to verify fire alarm signals prior to
reporting them to the Fire-Rescue Department.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a whole or part thereof other than
the part declated to be invalid.
Section 3. That all ordinances or parts of ordinances in conflict herewith be, and the same
are hereby repealed.
Section 4. That this ordinance shall become effective immediately upon its passage on
second and final reading.
PASSED AND ADOPTED in regular session on second and final reading on this 18'" day
of March, 2008.

This item is before Commission for consideration of an ordinance amending Chapter 96, "Fire Safety
and Emergency Services", Section 96.16, "Certain Codes Adopted By Reference", of the Code of
Ordinances by repealing Subsection (B)(5).
BACKGROUND
At the first reading on March 3, 2008, the Commission passed Ordinance No. 14-08.
Recommend approval of Ordinance No. 14-08 on second and final reading.
