Res 1177-59 RESOLUTION NO. ]177 RESOLUTION OF THE CITY COUNCIL 0P THE CITY 0I~ DELRAY BEACH, FLORIDA, PETITION- ING THE COUNTY COMHISSION OF PALM BEACH COUNTY, FLORIDA TO DEED AND CONVEY TO THE CITY 0F I~ELRAY BEACH CERTAIN LANDS IN AND ADJACENT TO LAKE IDA FOR RECREAT- IONAL AND MUNICIPAL PURPOSES. WHEREA~, in order to promote the best interests and general welfare of the inhabitants of the City of Delray Beach, it is recognized as being necessary to build, develop and main- tain recreational a~eas; and WNEREA~, the City Council and the Planning Board of the City of Delray Beach have made thorough and intensive study as to availability of land and areas suitable for such pux~poses, ~d after such study and investigation have determined and found that Lake Ida and the lands surrounding it a~e the best suited site within the corporate limits and the adjacent areas; and WHEREAS, the City Council and Planning Board of Delray Beach further find tb*t control of Lake Ida and the lands adjacent thereto is es-~-ential and necessary to the City of Delray Beach as a future or reserve souse® of water, and that the City should have supervision and control thereof in order to prevent pollution of the lake water supply; and that the said Lake Ida and adjacent lands should be preserved for the benefit and ms, of the public and inhabitants of said City, and not exploited by private or cow,,ercial purposes; and WHEREAS, as a r~sult of said study and investigation, the City Council and Planning Board have made and prepared a map or sketch of said lands, a copy of ~hich is attached hereto, dividing Lake Ida and adjacent lands into eleven parcels or tracts, and have designated and suggested a proposed recreational use for each parcel or tract as hereinafter set forth; and WHEREA~, the said parcels or tracts of land herein- after described and designated are now owned by Palm Beach County. NOW, THEREFOr, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH. FLORIDA: SECTION 1. That in order to promote the health, happiness, safety and general welfare of the inhabitants of the City of Delray Beach, t~lorida, the City Council does hereby petition and request the County Commission of Palm Beach County, Florida to grant and convey to the City of Delray Beach, Florida for recreational and municipal purposes as hereinafter set forth, the parcels or t~acts of land in and adjacent to Lake Ida contiguous to the present corporate limits of the City of Delray Beach, Florida, described as follows: T~act No. 1: The NW 1~4 of the NW 1/~ of the NE 1/~ of Section 8, Township 46 South, Range T~act No. 2: The W 1/2 of the SW 1/4 of the I~W 1/4 of the NE 1/~ of Section 8, Township 46 South, Range 43 East· T~act No. 3: The W 1/2 of the SW 1/4 of the SW 1/4 of the NE 1/4 of Section 8, Township 46 South, Range 43 East. T~act No. ~: That portion of L~e Ida lying within the NW 1/~ of Section 8, Township South, Range 43 East. Tract No. 5: That part of the N 1/2 of the SE 1/~ of the I~W 1/~ of the Township 46 South, Range [~3 East, lying east of Lateral' No. 11 of the Lake Worth Drainage District. Tract No. 6: The S 1/2 of the NE 1/~ of the ¥ SW 1/~ of the SW 1/~ of Section 8, Township South, Range 43 East. T~act No. 7: That part of the NW 1/4 of the SW ~ 1/~ of the SW 1/4 of Section 8, Township ~6 South, Range 43 East, lying east of Lateral No. 11 of the Lake Worth Drainage Dist~iCte T~act No. 8: The SE 1/[~ of the 1/~ of Section 8, Township ~6 South, Range ~3 East, less the ix~egula~ly shaped parcel of land ¥ belonging to the City of Delray Beach comprising five acres, more or less, deeded to the City of Delray Beach by Palm Beach County by deed under date of ~uly 23, 1957. ~act ~o. 9. ~he ~ 1/2 of the 1/[~ of Section 8, Township ~6 South, Range ~3 East, less that portion lying west of the west shore of Lake Ida. T~act No. 10. That portion of Lake Ida ly. ing within the W 1/2 of the ~/ 1/2 of the SE 1/[~ of Section 5, Township 46 South, Range ~3 East. Tract No. 11: ~aat portion of Lake Ida lying within 2he E 1/2 of the SW 1/4 of Section 5, Town- ship 46 South, Range 43 East. SECTION 2. That the City Council of the City of Delray Beach does hereby represent that if the County of Palm Beach will deed and convey said parcels or tracts of land to said city, the following proposed uses are suggested: T~ac$ No. 9 above described is proposed for use as a Civic 0enter wi~h adequate parking therefor and the Playhouse now erected thereon. Tract Ncc 2 above described is proposed for use as a boat picnic area, including proper fireplaces grills, disposal receptacles, sanitary facilities, picnic tables, water supply and other sim[la~ facili ties. Tracts Nos. 6, 7 and 8 above described are proposed for use as soft ball diamonds, and other simila~ uses as the proposed use of Tract 1/o. 2 as a picnic area as her,inshore set forth. T~act No. 3 above described is proposed for use as a boat dock and recreational a~ea, equipped with simila~ facilities as proposed for Tract No. 2 above. No present use, other than landscaping and beautifica- tion is presently planned or proposed for ~he remainder of the tracts, except i~ is agreed such lands shall never be used for anything other than simila~ recreational or municipal us.se -2- SECTION 3. That the City Council does hereby r.epresent that if the County of Palm Beach will deed and convey said par- cels or tracts of land to the City of Delray Beach, consideration will be given for budgetin~ .and prov.iding funas to construct and install the proposed facilities herelnabove set forth as follows: For the Civic Center to commence in late 1959 or early 1960; For the p.icnic area proposed for Tract No. 2 to commence in late i959; For the Ball diamonds aha similar projects pro- ~osed for Tracts No' 6, ? and 8, to be commenced in fall of 1960; and For the boat ~ock and related facilities proposed for Tract No. $ to be commenced in fail of i961. SECTION 4. That the City Council does hereby agree that if the said lands are deedea and conveyed to the City of I)elray Beach, it will accept .them subject to any restriction, the County Ccn~ission destos to ~n~ose con~o .r~n~ to the foregoing suggested .uses, or any. or.her reasonable restriction, the county re.ay.wish to ~ose restricting such lands for recreational~an~ municipal pu~- looses only.
