04-89 ORDINANCE NO. 4-89 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING TITLE VII, "TRAFFIC CODE"; BY AMENDING CHAPTER 70, TRAFFIC REGULATIONS, GENERAL PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH; BY ENACTING A NEW SECTION 70.02, "TRUCK AND TRAILER PROHIBITION ON CERTAIN PORTIONS OF ATLANTIC AVENUE"; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Title VII, "Traffic Code", Chapter 70, "Traffic Regu!ations"~ "General Provisions", of the Code of Ordinances of the City of Delray Beach, Florida, be and the same is hereby, amended by enacting a new Section 70.02, "Truck and Trailer Prohibition on Certain Portions of Atlantic Avenue", to read as follows: No trucks or trailers (except such vehicles providing emergency services or performing governmental service on behalf of the City, Palm Beach County, or the State of Florida and further accepting armored car vehicles) shall be permitted at'any time on Atlantic Avenue between Swinton Avenue on the west and southbound U.S. Highway No. 1 (N.E./S.E 5th Avenue) on the east. Section 2. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
