A RESOLUTION OF THE CITY ~0UNCIL OF
THE CITY OF D ~ELRAY BEACH, FLORIDA,
AUTHORIZING AND EMPOWERING MAYOR AND
CITY CLERK TO EIECUTE RELE~E TO PEER-
LESS INSURANCE COMPANY.
WHEREA~, by contract dated June 16, 1958, Semlnole
Construction Co. of Fort Lauderdale undertook to install and
construct storm sewers and appurtenances in the area identified
as Section "D" of said project; and
WHEREAS, Seminole Construction Co. of Fort Lauderdale
thereafter abandoned such work, as certified by Brockway, Weber
& Brockway, Engineers, under date of August 29, 1958 to the
City, and the City has terminated the employment of said con-
tractor and relet the contract to ONEMAN ENGINING CO; and
WHEREAS, P_~F4~RLES$ INSURANCE COMPANY, of Keene, New
H_~mpshtre, did furnish bond no. 231,426 to the City, ~la~-
anteeing the completion of the aforesaid contract by Seminole
Constl-uctlon Co. of Fort Lauderdale, for the sum of $18,406,95,
and by reason of the default of said contractor, the surety is
now liable thereon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF ~fE CITY OF DELRAY BEACH, FLORIDA:
1, Provided Peerless Insurance Company of Keene, New
Hampshire first pays to the City of Delray Beach, Florida, the
sum of $?~500,00, which sum is estimated as being adequate to
cover the City's damages, thereupon the Mayor and City Clerk
of said City are hereby anthorized and empowered to execute
and deliver to Peerless Insurance Company of Keene, New Hamp-
shire a release and hold hammless agreement in form approved by
the City Attorney.
2, Nothing herein contained shall be construed as
releasing Seminole Construction Co. of Fort Lauderdale of any
right, claim or cause of action existing against it.
