'1 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING THE LAND DEVELOPMENT REGULATIONS BY AMENDING SECTION 4.6.6, "COMMERCIAL AND INDUSTRIAL USES TO OPERATE WITHIN A BUILDING", SUBSECTION "A", "INTENT", IN ORDER TO CLARIFY THAT ALL COMMERCIAL AND INDUSTRIAL USES SHALL CONDUCT BUSINESS INSIDE REGARDLESS OF ZONING DISTRICT; PROVIDING A SAVING CLAUSE, A GENERAL REPEALER CLAUSE AND AN EFFECTIVE DATE. WHEREt1S, pursuant to LDR Section 1.1.6, the Planning and Zoning Boazd reviewed the proposed text amendment at a public hearing held on May 19, 2008 and voted 7 to 0 to recommend that the changes be appxoved;and WHEREAS, pursuant to Florida Statute 163.3174(4)(c), the Planning and Zoning Boazd, sitting as the Local Planning Agency, has determined that the change is consistent with and furthers the goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City Commission of the City of Delray Beach adopts the findings in the Planning Zoning Staff Report; and WHEREAS, the City Commission of the City of Delray Beach finds the ordinance is consistent with Comprehensive Plan; and WHEREAS, the City Commission desires to clarify that all commercial uses shall be conducted in. no matter which zoning district ui which they are located. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 4.6.6, "Cotmercial and Industrial Uses to Operate Within a Building", Subsection (A) "Intent", of the Land Development Regulations of the Code of Ordinances of the City of Deltay Beach, Florida, shall be amended to read as follows: Section 4.6.6 Commercial and Industrial Uses to Operate Within a Building: (A) Intent: (1) ee>~ueted All commercial and industrial uses shall conduct business within a completely \ / g ra ex an outst a regar ess o e zoning distuct. However, certain aspects of a use may be conducted outside and such aspects axe identified in (B) below. (2) Certain conditional uses that aze allowed within commercial, industrial, and mixed use districts can be characterized as outside uses. Such operations may be conducted outside when it is specifically determined through the conditional use process that the outside aspects of the use are appropriate. Conditions may be applied to mitigate visual and other impacts. f31 Commercial and industrial uses may be allowed outside on a temporary basis for special events pursuant to Section 2.4.6(F1. Section 2. That should any section or provision of this ordinance ox any portion thereof, any pazagraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby repealed. Section 4.
