N~$~ the City Cemncil of the C~ty ~f Del~ay Beach~ Fla.~ did, in regular session held on ~arch 11, 1957, e~ct Resolution No. 1042, and on ~arch 25~ 1957, enact Resolution No 1040, dec- . laring the e~lstence of a nuisance ~pon certain lets er parcels of land therein described for violation of the provisions of 0rdi- nance G-147; and N~AS, pursuant to said Resolutions, the City Clerk of said City did furnish each of the oNners oF the lands therein described Nith a notice that the City Council ~ould sit on Apr~l 8th, 1957~ at 7:30 ~'clock P.~.~ at the City ~all in Delray Beach, Florida~ for the purpose of alloNing the oNners shoNn In Resolution No. 1042~ and on April 22nd~ 1957~ at 7:30 o'clock P.~., at the City Nall in Delray Beach, Florida, for the p~rpese ef allo~ the eNners ~she~n in ~esolution No. 1040, te sho~ cause, if any~ ~hy said nuisances described in said resol~tions should n~t be abated; a~ ~' ~~ pursuant to said notices~ the Co~cil of said City di~ sit on April 22nd, 1957, at 7:30 o'clock P.~.~ and on April 8th~ 1957~ at 7:30 o'clock P.~.~ at the City Nall in Delray Beach Florida, for the p~rp~se aforesaid~ and said o~ners of the lands ~having failed to shoN cause Nhy the nuisance described in the aforesaid resolutions should not be abated, the said City Council did, en the schedmled hearing dates as pro~ided and shoNn herein, resolve t~t a nuisance existed on the lots or parcels therein described ~or violation of the Ordinance G-147 as aforesaid, and f~rther resolved that each of the o~-ners described in said reso- lmtions be not~fied and required to abate the n~isance ~ithin thirty (30) days from the receipt of a copy of such resolution, otherNise~ in default thereof, said oNners Nero notified that the C~ty ~f Delray Beach~ Florida, ~omld enter upon said lands and abate the nuisance described and specified in said resolution and ~ould levy ~e cost of such ~ork as an assessment against the property there~n described; and N~S~ p~suant to such resolution; the C~ty Clerk of s~d City did furnish each of the respective o~ers of the lands de- scribed in said resolutions Nith an appropriate co~y thereof, n~ely, Nesolution No. 10~ and Resel~tion No. 1047 and the oNners herein~ter na~e~ did fail and neglect to abate the nuisance e~- ~st~ng ~pon their respective lands ~lthin the time prescribed by sa~d ~esolu~ion anO O~d~naneo G-l~g~ and ~he Florida~ was required to and did enter upon ~e following lands and incur costs in abating the nuisance existing thereon as de- scribed in the aforesaid resolutions; and W~S, the City Hanager of the City of Delray Beach, Fla., has, pursuant to said Ordinance G-147 and the City Charter sub- mitted to the City Council a report of the costs incurred in abating the nuisances as aforesaid, said report indicating the costs per parcel of land involved. 1. That assessments in the individual amounts as shown by the report of the City Manager of the City of Delray Beach, Fla.., involving sa~d C~ty~s cost of abating the aforesaid nu~ssnces ~pon the lots or parcels of la~ described in said report~ a copy of ~hich ~s attached and made a part hereof~ are lev~ed against the parcels of land described on sa~d report and in the amounts ~ndicated thereon. ~aid assessments so lev~ed shall be a l~en from the date the assessment becomes effective upon the respec- tive lots ~d parcels o9 land described ~n s~d report~ o9 the s~e nature and to the same extent as the lien for general city ta~es and shall be collect~ble ~n the s~e ~nner and ~ith the s~e penalties and under the s~e provisions as to sale and closure ~s c~ty taxes ~re collectible. :~ 2. That ~e C~ty Clerk o~ sa~d C~ty shall record a certified copy of this resolution ~n the off~ce of the Clerk of the Circuft Court in and fo~ Palm Beach County~ Florida, and shall furnish to each of the o~ers n~ed in and upon said report~ a not~ce that the C~ty Council of the City of Delray Beach, Florida~ will ~lt as a Board of ~quallzat~on at the City Hall in Delray Beach, Fla.~ on the 25th day of November, 1957~ at 7:30 o'clock P.N., to hear and ~ns~der any and all complaZnts as to the assessments sho~n herein and the said C~ty Council sh~l adjust and equalize the s~e on a basis of justice and r~ght and ~hen so equalized and approved, s~ch assessments shall stand c onfi~ed and remain legal, valid and b~nd~ng obligations upon the property against which sa~d assessments are lev~ed; such assessments after equalization adjustment and hearing shall dra~ interest at ~e rate of 6~ per ann~ until fully pa~d. 3. ~ter equalization and upon approval of such assessments~ the s~e shall be forthwith payable together ~ any interest thereon accrued. :'~- PAS~D ~b ~0PTED at regular session on the 28th day of October, A.D., 1957. .... · ,~" ~' M A Y O R I~ ROBE~T D.
