Res 1080-57 RESOLUTION NO. A RESOLUTION OF THE CI~f COUNCIL OF THE CITY OF DELRAY BEACH, FLOR- IDA, AFFROVING PIAT OF "DEL-HARBOUR"; AND APPROVING ANNEXATION THEREOF. WHEREAS, TOTTERDALE DEVELOP¥~T, INC., a Florida corporation, Joined by JOHN W. SPINNER and PHYLLIS M. SPINNER, his wife, are the fee simple title holders of the following described property, to-wit: Beginning at the intersection of the south line of Delray Beach Shores, recorded in Plat Book 23, page 167 with the easterly right-of-way line of the Intracoastal Water- way as said right-of-way is shown on plat recorded in Plat Book 17, pages 17B and 18, public records of Palm Beach County, Florida; thence S. 1° 25' 30" W. along said easterly right-of-way line, a distance of 525.70 feet (for convenience the south line of said Delray Beach Shores is assumed to bear East- West and all other bearings are relative thereto); thence S. 0° 31' 10" W., a distance of 765.02 feet, more or less, ~to a point in a line parallel to, and 2000 feet northerly f rom (measumed at right angles), the East-West Qusm- ter Section line of said Section 28; thence N. 89° 58' 15" E. along said parallel line, a distance of 649.96 feet, more or less, to the center line of State Road AiA as now laid out and in use; thence northerly along the amc of a cumve concave to the east, being the center line of said State Road No. AiA, having a radius of 17,188.80 feet, a distance of 884.92 feet to the end of said curve; thence N. 9° 39' 30" E. along the tangent to said curve, a distance of 420.33 feet to a point in the easterly extension of the south line of said Delray Beach Shores; thence West along said South line, a distance of 826.43 feet to the point of beginning. SUBJECT to the existing right of way State Road No. AiA. ALSO Lot "A",Delray Beach Shores, according to the plat thereof recorded in Plat Book 23, page 167, public records of Palm Beach County, Florida. All being in Sections 21 and 28, Township 46 South, Range 43 East, and said owners have heretofore, by their Joint Petition for Annexation, as amended, presented a plat of said property pro- posed to be filed of record entitled "Plat of DEL-HARBOUR", together with plans for the development thereof; and WHEREAS, said proposed plat and zoning applicable thereto has been studied and approved by the Planning Board of the 0ity of Delray Beach, and this Council deems said plat and plans to be satisfactory and designed for the orderly development of the property and for the protection of the health and welfare of the f~nhabitants thereof and the inhabitants of the City of Delray Beach. -!- NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: 1. That the aforesaid plat and plans for the pro- posed subdivision and development known as "DEL-HARBOUR" be and they are hereby approved. 2. That the City boundaries shall be extended by ordinance, as provided by law, to include said property, and such ordinance shall include and contain provisions for the zoning and taxation of said lands. $. That the Mayor, City Clerk and Director of Public Works are hereby authorized and directed to forthwith approve the plat of DEL-HARBOUR as presented. PASSED in regular session this twenty-seventh day of January, A. D., 1958.
