A RESOLUTION DECLARING A PROPOSED FRANCHISE GRANTED
BY AN ORDINANCE PASSED ON SECOND AND FINAL READING
ON THE 12th DAY OF OCTOBER, 1953, ENTITLED "AN
ORDINANCE AUTHORIZING ~ SOUTHERN BELL TELEPHONE
AND TELEGRAPH COMPANY TO USE THE PUBLIC STREETS OF
THE CITY OF DELRAY BEACH, FLORIDA, FOR THE PURPOSE
OF ERECTING, CONSTRUCTING, MAINTAINING AND OPERATING
LINES OF TELEPHONE AND TELEGRAPH THEREON AND THERE-
UNDER", TO BE DULY AND LEGALLY APPROVED BY A MAJORITY
OF THE QUALIFIED ELECTORS VOTING AT AN ELECTIC~ HELD
ON TEE 1st DAY OF DECEMBER, 1953, AND TO BE IN FULL
FORCE AND EFFECT.
WHEREAS, an election of the qualified electors of the
City of Delray Beach, Florida, was held on the 1st day of
December, 1953, for the purpose of approving or disapproving
the granting of a proposed franchise to the Southern Bell
Telephone and Telegraph Company by an ordinance entitled,
"An Ordinance authorizing the Southern Bell Telephone and
Telegraph Company to use the public streets of the City of
Delray Beach, Florida, for the purpose of erecting, construct-
ing, maintaining and operating lines of telephone and telegraph
thereon and thereunder", the same having been passed on the
second and final reading at a meeting of the City Council
on the 12th day of October, 1953; and,
WHEREAS, 408 duly qualified electors voted at said
election; and
WHE~S, 34.1 duly qualified electors voting at said
electiau, voted in favo~ of the granting of said franchise to
the said Souther~ Bell Telephone and Telegraph Company by the
said ordinance; and
WHEREAS, the said 341 electors voting in favor of
the said franchise constitute a majority of all the qualified
electors participating in said election; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF ~ CITY OF
DELRAY BEACH, FLORIDA:
That the said proposed franchise to be granted by
the said ordinance entitled, "An 0rdin_~_nce authorizing the
Southern Bell Telephone and Telegraph Company to use the
public streets of the City of Delray Beach, Florida, for
the purpose of erecting, constructing, maintaining and
operating lines of telephone and telegraph thereon and
thereunder", the same having been passed on the second
and final reading on the 12th day of October, 1953, be and
the same is hereby declared to be duly and legally approved
by a majority of the votes of the qualified electors, cast
in said election held on the 1st day of December, 1953, and
to be in full force and effect.
The adoption of the above resolution was moved
by Councilman . .K.abler. . . . ~is motion was seconded
by Councilman Saunders .... , and on vote being taken
the members of the Council voting in favor of the adoption
of the resolution were as follows:
