A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, ORDERING
THE CONSTRUCTION, GRADING AND PAVING OF
OCEAN TERRACE, FROM GLEASON STREET EAST
TO OCEAN BOULEVARD; ASSESSING ADJACENT
PROPERTY FOR THE COST THEREOF, AND PROVID-
ING FOR THE PAYMENT THEREOF TO BE PAID IN
FIVE (5) EQUAL ANNUAL INSTALLMENTS, AND
FURTHER PROVIDING THAT THE TIME AND PLACE
OF HEARING OBJECTIONS, IF ANY, TO SUCH
IMPROVEMENT, SHALL BE AT 7:30 P. M., on
MAY 26TH, 1952, AT THE CITY HALL IN THIS
CITY.
'a~HEREAS, the City Council of the City of Delray Beach,
Florida, did on the 14th day of April, 1952, adopt a Resolution
ordering the City Manager to prepare plans and specifications
and an estimate of cost for the construction, grading and paving
of Ocean Terrace, from Gleason Street to Ocean Boulevard, said
paviD~ to be the width of twenty-four (24) feet, where right-
of-way is available, and requiring said plans, specifications
· and estimate of cost of such improvement to be placed on file
in the office of the City Manager, and
WHEREAS', increased vehicular traffic has necessitated the
paving of Ocean Terrace as aforesaid,
NOW, THEREFORE, BE IT RESOLVED by th~City Council of the
City of Delray Beach, Florida, that it is dete~nined to make the
following described improvement, to-wit:
Grading, construction and paving of Ocean
Terrace, from Gleason Street east to Ocean
Boulevard, to a width of twenty-four (24)
feet, where right-of-way is available, the
total cost as estimated of such improvement
being $ 1,735.50.
BE IT FURTHER RESOLVED that the entire cost of such improve-
ment shall be assessed against the following described properties
in Delray Beach, Palm Beach County, Florida:
Ocean Beach Lot 25
Commencing at the Northeast corner of Ocean Beach
Lot 26, thence Southwest along the ~est line of
Ocean Boulevard 78.82', thence Westerly 150',
thence Northerly to the North line of said
Lot 26, thence Easterly to point of beginning.
Commencing at the Northwest corner of Lot 1, Nassau
Park, thence- Nesterly 12.96', thence Northerly
49.33' (parrallel to Ocean Blvd.) to a point 30'
south of the north line, thence Westerly 75', thence
Southerly 128.95' to the south line of Lot 26, thence
Easterly 83.2' (to the Southwest corner of Lot 1,
Nassau Park), thence Northerly 79.6' to point of
beginning.
E. 75' of the West 309.36' of Ocean Beach Lot 26, less the
N. 30' thereof.
E. 150' of the West 234.36' of Ocean Beach ~ot 26, less the
N. 30' thereof.

said benefits to be determined and prorated according to the fron~
footage of the eespective properties as set forth immediately above.
BE IT FURTHER RE~0LVED that said special assessments against all
the lots and lands as set forth above which are specially benefited,
shall be and remain liens superior in dignity to all other liens,
except liens for taxes, until paid, from the date of the assessment
upon the respective lots and parcels of land assessed, and which
shall bear interest at the rate of eight per cent per annum, and
which may be paid in five equal yearly installments with accrued
interest on all deferred payments. Payment shall be made at the
same place that taxes payable to the City of Delray Beach, Florida,
are paid; namely, at the office of the City TaxCollector, and upon
failure of any property owner to pay any annual installment due, or
any pa~t thereof, or any annual interest upon deferred payments, the
City of Delray Beach may bring necessary legal proceedings by a
Bill in Chancery to enforce payment thereof with all accrued interest,
together with all legal costs incurred, including a reasonable
Attorney.s fee. The total amount of any lien may be paid in full
at any time with interest from the date of assessment.
IT IS ORDERED that the City Council shall sit at the City Hall
in the City of Delray Beach, Florida, at 7:30 P. M., on May .- 26th,
1952, for the purpose o~ hearing objections, if any, on said pro-
posed improvements, as ~set forth above.
IT IS FURTHER ORDERED that this Resolution be published once
a week for two (2) consecutive weeks in the Delray Beach Journal.
PASSED AND ADOPTED by the City Council of the City of Delray
Beach, Florida, on this the 28th day of April, A. D., 1952.
