A i~SOLUTION OF THE CITY COUNCIL OF THE CITY
OF DELi/AY BEACH, FLORIDA, OHDEHING THE GRADING
AND PAVING OF THE ALLEYS RUNNING NORTH AND SOUTH
THROUGH BLOCKS ll6AND 117, ASSESSING ADJACENT
PROPERTY FOR TIlE COST THEREOF, AND PROVIDING
FOR THE PAYMENT THEilEOF TO BE PAID IN FIVE (5)
E~UAL ANNUAL INSTALLMENTS, AND FURTHER PROVIDING
T[~AT THE TIME AND PLACE OF HEAAING OBJECTIONS,
IF ANY, TO SUCH IMPROVEMENT SHALL BE AT 7:30 P. M.,
ON OCTOBER 13TH, AT TI~ CITY HALL IN THIS CITY.
WH~aS, the City Council of the City of Delray Beach, Florida,
dld on the 2Mhd day of September, 19§2, adopt a Resolution ordering
the City Manager to prepare plans and specifications and an estimate
of cost for the grading and paving of the alleys running north and
south through Blocks 116 and 117, and requiring said plans, specifi-
cations and estimate of cost of such improvement to be placed on file
in the office of the City Manager, and
WHEREAS, increased traffic and business establishments in
this block have necessitated the paving of this alley, as aforesaid,
NOW, THEREFOi(E, BE IT RESOLVED by the City Co,nell of the City
of Delray Beach, Florida, that it is determined to mall® the following
described improvement, to-wit:
Grading and paving, the alleys running north
and south through Blocks ll6~and liT, to a
width of 16', the total estimate~ cost of such
improvement being $ ~,02~..00, with Plant Mix Asphalt.
BE IT FURTEERRESOLVED that the entire cost of such improvement
shall be assessed against the following described properties in
Delray Beach, Palm Beach County, Florida:
Lots 1 to 18 Inclusive, Block 116
Lot 2~, Block 116
W 40' of Lot 23, Block 116
Lots 3 to 15 Inclusive, Block 117
Lots 17 to ~4 Inclusive, Block 117
said benefits to be determined and prorated according to the front
footage of the respective properties as set forth immediately above.
BE IT FU~THPAt RESOLVED that said special assessments against all
the lots and lands as set forth above which are specially benefited,
shall be and remain liens superior in dignity to all other liens,
except liens for taxes, until paid, from the date of the assessment
upon the respective lots and parcels of land assessed, and which
shall bear interest at the rate of eight per cent per annum, and
which may be paid in five (5) equal yearly installments with accrued
interest on all deferred payments. Payment shall be ~e at the
same place that taxes payable to the City of Oelray Beach, Florida, are
paid; namely, at the office of the City Tax Collector, and upon
failure of any property owner to pay any annual installment due, or
any part thereof, or any annual interest upon deferred payments, the
City of D®l~y Beach may bring necessary legal proceedings by a Bill
in Chancery to enforce payment thereof with all accrued interest~
together with all legal costs incurred, including a reasonable
Attorney's fee. TLe total amount of any lien may be paid in full at
any time with interest from the date of assessment.
IT IS 0~D~D that the City Council shall sit at the City
Ball in the City o£ Delray Beach, Florida, at 7:30 P. M. on
October 13th, 1952, for the purpose of hearing objections, if
any, on said proposed improvements, as set forth above.
IT IS F~tT~i~ 0RDEaED that this Resolution be published once a
week For two (2) consecutive weeks in the Delray Beach Journal.
