Res 872-52 RESOLUTION NO, ~72 A ~ESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, PLORIDA, ORDERING THE GRADING AND RESURFACING 0F MIRAMAR ~RIVE, AND NASSAU STREET, FROM OCEAN BOULEVARD WEST TO GLEAS0N STREET. WHEREAS~ the City Council of the City of Delray Beach, Florida, did on the 23rd day of September, 1952, adopt a Resolution ordering the City Manager to prepare plans and specifications and estimates of the cost of grading and resurfactng Miramar Drive, and Nassau Street, from Ocean Boulevard west to Gleason Street, to a width of twenty (20) feet, and requiring said plans, specifications and estimates of cost of such improvements to be placed on file in the office of the City Mauager, and WHEREAS, the City Council deems it to be necessary for the safety and convenience of the public to resurface the above mentioned streets,' NOW, THEREFORE, BE IT RESOLVED by the City' Council of the City of Delray Beach, Florida, that it is determined to make the following described improvements, to-w~[t: The grading and resurfacing of Mi~ar Drive, and Nassau Streets, from Ocean BouleYard west to G!eason Street, to a width of twenty (20) feet, the total cost as estimated of such improvements being $ 4,165.50 BE IT FURTHER RESOLVED that the entire cost of such improvements shall be assessed against the foYJ. o;~ng descr, ib.~.31 :~.~-o.pe~tio.~ ~-n :~lray ~each, Palm.. BE IT FURTHER RESOLVED that said special assessments against all the lots and lands as set forth above which are specially benefitted, shall be and remain liens superior in dignity to all othc~ liens, except liens for taxes, until paid, From the date of the assessment upon the respective lots and parcels of land assesse~, and ~hich shall bear interest at the rate of eight per cent per annun, mud which may be paid in five equal yearly installments with accrued interest on all deferred payments. Payment shall be made at the same place that taxes payable to the City of Delray Beach, Florida, are paid; namely, at the office of the City Tax Collector, s. nd upon faX lure of any property owner to pay any annual installment due, or any part thereof, or any annual interest upon deferred payments, the City of Delray Beach may bring necessary legal proceedings by a Bill in Chancery to enforce payment thereof with all accrued interest, together with all legal costs incurred, including a reasonablo Attorney's fee. The total smount of any lien msy be paid in full at any time with interest from the date of assessment. IT I~ORDERED that the City Council shall sit at the City Hall in the City of Delray Beach, Florida, at 7:30 P. M. on October 13th, 1952, for the purpose of hearing objections, if any, on said proposed improve- ments, as set forth above.
