40-89 ORDINANCE NO.40-89 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING TITLE XV, "BUILDING REGULATIONS", CF~PTER 150, "BUILDING REGULATIONS", SECTION 150.115 "PERMIT REQUI~Rn: APPROVAL", AND TITLE XV, "BUILDING REGULATIONS", CHAPTER 154, "DOCKS, DOLPHINS, FINGER PIERS, AND BOAT LIFTS", SECTION 154.02, "PERMIT REQUIRED", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, FOR THE PURPOSE OF REQUIRING MORE DETAILED INFORMATION PRIOR TO ISSUANCE. OF PERMITS FOR SEAWALLS OR BULK- HEADS AN~FOR DOCKS, DOLPHINS, FINGER PIERS AND BOAT LIFTS; PROVIDING A GENERAL REPE~T.~R CLAUSE; PRO- VIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Delray Beach, Florida, deems it to be in the best interests of the residents and citizens of the City to require that additional detailed information be submitted prior to approval of and issuance of permits for seawalls and bulkheads, and for docks, dolphins, finger piers, and boat lifts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Title XV, "Building Regulations", Chapter 150, "Building Regulations", Section 150.115, "Permit Required; Approval", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby, amended to read as follows: Section 150.115 PERMIT REQUIBRD: APPROVAL. Prior to the erection, construction, or alteration of any seawall or bulkhead, there shall first be submitted to the City Engineer an application in the form as may be prescribed by the City Ma~a~e~?-e~a~n~-a-~e~a~e~-~a~eme~-~-~he-s~ee~ea~s am~-pEams-fe~-%he-s~=ue~e7-ee~EfEe~-by-an-en~Emee~-~e~Este~e~ ~e~--%he-~aws-~-~he-s~a%e?--~e~he~-w~%h-a-p~%-~a~-sh~w~-~he w%~h -a~e}m~mg -~am~s7 -wa~e~s? -am~ -eha~ae~s~ containing detailed plans and specifications for the structure at the proposed site. A plot plan showing the location of the proposed structure or altera- tioa in con~unction with adjoining lands, waters and channels. The above shall be prepared and sealed b~ a registered professional engineer reqistered in the State of Florida. As-built drawings an4 final certification of completion and compliance to said engineer's design shall be submitted to the City before the City's final acceptance. ~gD~e~e~-b¥-~he-e~%¥-E~§~mee~? No permit shall be issued for the construction until reviewed and aD, roved by the City Engineer. The City Engineer ma~ adopt, through administrative policies and. procedures, and shall review said application in accordance with certain minimum design standards, which standards may be amended from time to time to reflect acceptable engineering practice. No permit fees shall be required in addition to the permit fees otherwise required by this subchapter, however, a separate permit shall be required and will be issued on a no fee basis. No permit shall be required for minor repairs to existing seawalls or bulk- heads. Section 2. That Title XV, "Building Regulations", Chapter 154, "Docks, Dolphins, Finger Piers, and Boat Lifts", Section 154.02(A), "Permits Required", of the Code of Ordinances of the City o~ Delray Beach, Florida, be, and the same is hereby, amended to read as follows: (A) It shall be unlawful to construct any dock, dolphin, finger pler, or boat lift in the City without first s,~hmitting plans and obtaining a building permit therefo= from the Building Department. The installation of docks, dolphins, finger piers, and boat lifts shall Be -~ -ae~e~a~ee -w~%h -the -~es~gm -~9 -a -s~a~e ~e~s~e~e~-~ess~ena~-e~ee~7-a~ -~he-~es~-a~ -p~ams -sha~ &ne~e-as-e-m~n~m~m~ require the submission to the City in advance of detailed plans and specifications for the proposed work, a plot plan, as-built drawings; plus a final certification of completion and compliance to said engineer's design b~ a state registered professional engineer before the City's final acceptance. The design and plans shall include as a minimum: (1) Waterway typical section. (2) Type of soil being penetrated. ~en~h of piling, minL,~ ~,-ubed~,ent into bottom material, and minimum loading capacity. (4) Type and treatment of decking, seats, stringers, and bumpers. (5) Type of treatment of wooden piles. (6) Type of fastening to be used. (7) American Wood Preservation Association Standards where applicable. The City Engineer may adopt, through administrative policies and procedures, and shall review said submittal in accordance with certain minimum design standards, which standards may be amended from time to time to reflect acceptable engineering practice. Section 3. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 4. That should, any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity or the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
