N~, T~F0~ BE IT RESOLV~ by ~e City Co~eil of ~e Ci~ of Delray Beach, as follows: SECTION 1. That the City of Del~ay Beach here~ accepts ~d designates the above described line kno~ as the Broody S~vey Line as sho~ on that ceftin plat on file in Plat Book 20 at pa~e A of ~e ~blic Rec~ds of P~m Beach Co~%y, Florida, as bein~ ~e west right-~-way line of the Ocean Road or 0ce~ Bo~evard as sho~ ~ the plat of the fractional East half of Section 16, To, ship ~ South, Range ~3 East, recorded in Plat Book 1, at page 2~ of ~e ~blic Recede of Palm Beach C~%y, Florida, insofar as the s~e affects ~e property here~after des- cribed. SEOTION 2. T~t ~e 0it7_~ Delray Beach hereby abandons ~d ~cates all of that p~tlon of ~e 0ce~' Road ~ Ocean Boulevard as per plat receded in Plat Book 1 at .~e 25 of the public records of P~m Beach C~nty, Florida, located in the hereinafter described property and l~ing west ~ the Brock~y ' S~v~y Line as sho~ in the plat thereof recorded in P~t Book 20 at ~e A of ~e public records of P~m Beach Co~%y, Florida. SECTION 3. That in consideration of the relinquis~en% ~ the adjacent property o~mer of all cla~s to ~y of ~e hereinafter described property located East of the Brockway S~vey Line as above described, the 0ity of Delray Beach ~11 ~e no special assessments for benefits against said adjacent prope~ for the proposed repair, implement and construction work to be done during ~e ye~s 1927 and 19~8. SECTION A. This Resolution shall become effective upon the proper acceptance thereof by the owner of the hereinaeter described property, which acceptance shall be signified L? the :~xecution of the attached consent and re- lease. For and in consideration o~ the abandonment by the City of Delray Beach of that property described in Section 2 of the foregoing Resolution and in further consideration of the agreement of the City of Delray Beach to m~/{e no special assessments for benefits against the abovo described property for street improve- ment work on the Ocean Boulevard during the 19AT-19A8 construction program, the undersigned owners hereby accept th~ above Resolution and hereby remise, release and quit-claim to the City of Delray Beach, Florida, for use as a public street and sidewalk all of that portion of the above described property as set out in Section 5 of this Resolution, which may be located east of the Brockway Survey Line as shown in Plat Book 20~ page ~ of the public records of Palm Beach County, Florida.
