A P~F~OLUTION OF THE CITY CouNcIL OF T]~E CITY OF DELRAY BEACH, FLORIDA, }t{O-
VIDING FOR Tt~ CONSTRUCTION OF CERTAIN SID~,~ALKS IN SAID CITY.
WHEREAS, a need has arisen in the City of Delray Beash, Florida, for
sidewalks to be constructed in that part of said city generally inhabited by
colored persons, and
WHERE~, the City of Delray Beach, Florida, desires to proceed with
certain sidewalk construction in the City of Delray Beach, said sidewalk con-
s~ruction to be made on a strip of land being five (5) feet in width and
lying immediately East of the forty (40) foot right-of-way of N. W. 5th Avenue
and running parallel to N. 1J. 5th Avenue for a distance of two (2) blocks
from the Northeast corner of the intersection of N. W. 5th Avenue and Atlantic
Avenue, intersections excepted, AND that strip of land being five (5) feet
in width and lying imediately East of the forty (40) foot right-of-way of
S. W. 5th Avenue, and running parallel to S. W. 5th Avenue for a distance of
two (2) blocks from the SoutheaSt corner of the intersection of S.
Avenue a~ Atlantic Avenue, intersections excepted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the 'City ef
Delray Beach, Florida, as ~511ows:
SECTION 1. That in consideration of the relinquishment and con-
veyance to the City of Delray Beach by the property owners of the above
described property, on which a sidewalk is to be constructed, the City ef
Delray Beach will make no special assessments for benefits against the adjacent
property for the construction work to be done, and ~aid City will bear the
total cost of the construction thereof.
SECTION 2. This resolution shall become effective upon the proper
a~.-~m~e ~ereof by the owner of the hereim~i~ d~ri~ed proi~rty which
aceep~e shall be signified ~y tb, ~xecu%ion of the c~e~$
which is made ~ par~ 5ereof.
SECTION 3. The property effected by this resolution is the ~est
Five (5) feet of:
Lots 28 and 29, Block 29, 0ity of Delray Beach, Fla.

For and in consideration of the City of Delray Beach, Florida construct-
ing said sidewalk, and in the further consideration of the agreement of said
city to make no special assessments for benefits against the property adjacent
to the above described strip Of land for the construction of said sidewalk
and for %he city bearing ~e total cost of the construction thereof, the
undersigned ox,mcr hereby accepts the above resolution and hereby remise, re-
lease, convey and quit-claim to the City of Delray Beach, Florida, for the
~e as a sidewalk, all of that portion of the above described property as set
out in Section 3 of this Resolution.
