RESOLUTION OF ~ CITY COUNCIL OF TIC] CITY OF DELRA¥ BEACH, FLORIDA,
COMCERNINC CROSSINC PROTECTION AT ATLANTIC AVENUE Ah~rD ~ FLORIDA
EAST COAST RAILV~TAY IN T~] CITY OF DELR~Y BEACH, FLORIDA.
?,~!EREAS, for sometime the members of the City Council and the
representatives of the Florida East Coast Railway have been trying
to work out an agreeable plan for crossing protection at Atlantic
Avenue and the Florida East Coast Railway in Delray Beach, ]florida, and
¥~EREAS, sometime back automatic gates were installed at this
crossing by the Florida East Coast Railway, and
WHE~EA~ before and after the installation for such automatic
gate, the City Co~ncil h~d requested that the gates be so constructed
Dnat manual operation be possible and that an operator be in charge
of the gates during the daylight hours and
¥ZqE~EAS members of the Council and representatives of the Florida
East Coast Railway Company met on October 28Dh to discuss the matter
of manual operation of the gates during the dsylight hours~ and
~gH~EDTAS sfter such meeting the City Attoruey of the City of Delray
Beach received the following letter fro~'~_~ Scott ~. Loftin, ode of the
Truestees of the Florida East Coast Railway Company, to-wit:
"VJe are writing to acknowledge your letter of the 3lst,
in reference to the discussions that have taken place between
members of tae City Council and representatives of the Railway
regarding crossing protection at Atlantic Avenue crossing in
Delray Beach. The last discussion I understand was held at
the regular Gity Council meeti~g on October 28th.
"We are requesting a report of the discussions that have
been had, and particularly of ~he one held on the 28th, and
when this is received will write you further regarding this
matter."
;VHERF~IS, without notice to the City Council the manual control
tower of the crossing was dismantled on or about November 3 or 4, 1947.
NO?J, THE]~EFORE, BE IT RESOLVED by the City Council of the City
of Delray Beach, Florida, as follows:
1. Th~_~t we hereby vigorously protest against the removal of the
manual control tower of the crossing of the Florida East Coast Railway,
particularly due Do Phc fact that at the time said tower was dismantled
negotiations were pending between the City of Delray Beach and Florida
East Coast Railway for the manual operation of the crossing gates
during the daylight hours and that the removal of such tower at this
time does not indicate good faith on the part of the Railway Company
representatives and to the contrary indicate an attitude .of total
disregard for the wishes of the City Council of the City of Delray
Beach.
2. That we insist upon the immediate erection of a new ~ower
or other adequate structure for the manual opera~ion of the crossing
gates during the daylight hours.
3. That a copy of this Resolution be mailed to !~. Scott ~.
Loftin, one of the Trustees of the Florida .East Coast Railway Company
at St. Augusting, Florida.
