A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, ORDERING THE CONSTRUCTION OF CW~RTAIN STREET IMPROVE-

'~F~REAS the City Council of the City of Delray Beach,
Florida, did on the 22nd day of 5~rch, 1943, adopt a resolution
ordering the City Engineer to prepare plans and specifications
for certain street improvement work and did also adopt a resolu-
tion on the 22nd day of ~rch, 1943, accepting the plans and
specifications of the City Engineer for said street improvement
work and also the estimated cost of said proposed improvement and
ordered said plans and soecifications and the estimates of the
cost thereof to be filed with the City Clerk and kept open for
the inspection of the public,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Delray Beach, Florida, that the following improvements
be made, to-wit:
Grading and paving that portion of Northwest Eighth Avenue
lying between Northwest Second Street and a point 357 feet North of
the North property line of Northwest Third Street. The estimated
cost of which improvement is $1263.60.
BE IT FURTHER RESOLVED That the cost of said improvements
shall be assessed against all lots and land adjoining and contiguous
or bounding and abutting on Northwest Eighth Avenue lying between
Northwest Second Street and a point 357 feet North of the North
property line of Northwest Third Street, in proportion to the benefits
to be derived therefrom, said special benefits to be determined and
pro rated according to the foot frontage of the respective properties
specially benefited by said improvements.
BE IT FUR~ER RESOLVED That said special assessments against
the lots and lands specially benefited and adjoining and contiguous
or bounding or abutting upon Northwest Eighth Avenue lying between
Northwest Second Street and a point 357 feet North of the North
property line of Northwest Third Street, shall be and remain liens
superior in dignity to all other liens, ex~cept liens for taxes,
until paid from the date of the assessment upon the respective
lots and parcels of land assessed and which bear interest at the
rate of eight percent (8%) per annum and may be paid in ten (10)
equal yearly installments with accrued interest on all deferred
payments. Payments shall be made at the same time and in the
same place that taxes payable to the City of Delray Beach, Florida,
are paid, namely: from November 1st to April 1st of each fiscal
year at the office of the City Tax Collector each year and, upon
the failure of any property owner to pay any annual installment
due or any part thereof or any annual interest upon deferred
payments, the City of Delray Be~ch may bring necessary le6al
proceedings by a bill in chancery to enforce payment thereof with
all accrued interest, together with all legal cost incurred,
including a reasonable attorney's fee. The total amount of any
lien may be paid in full at any time with interest from the date
of assessment.
The total estimated cost of the foregoing improvement
is $1263.60.
IT IS ORDERED That the foregoing resolution be published
once each week for two consecutive weeks in the Delray Beach News,
a newspaper published in the City of Delray Beach, Florida.

Delray Beach, Florida, has determined that it is necessary
for said improvements to be made according to the plans
and specifications on file in the office of the City Engineer
and that it is required that said improvements be so made.
The City Council will sit at the Council Chambers in the
City Hall of the City of Delray Beach, Florida, at 7:30
P. M. on the 12th day of April, 1943, for the purpose of
hearing objections to said proposed improvements.
