REAFFIR~ING TtiE APPOIN~IENT OF A GOLF C0~IITTEE, TURNING THE
CUSTODY, COh~ROL AND MANAG~NT OF THE GOLF COURSE 0V~ TO
SUCH C0~.~TTEE, APi~ROPRIATING CERTAIN S~ FOR MAINTENANCE,
UPKEEP AND I~IPROV~'~NT OF THE GOLF COURSE, PROVIDING FOR THE
F~ENDITURE OF SUCH SUBJ,, AND RE~EALING ~iLL RESOLUTIONS AI~D
ACTIONS IN C0i.IFLICT HEREV~ITH.
WHEREAS, the City Council of the City of Delray Beach has
heretofore by resolution appointed a golf conLmittee consisting
of D. ~J~. Bradshaw, J. C. Keen, J. Leslie Brown, E. Pi. Wilson
and J. B. Smith, and has by resolution turned over the control,
management and operation of the municipal golf course to such
committee and appropriated certain sums of money for the main-
tenance and improvement thereof, and whereas, there is sonde
conflict and uncertainty resulting from the several resolutions
of tt~e Council and actions of the Council,as shown on the minutes
of the City Council, as to the exact status, obligations and
duties o f the conm~ittee,
NOW, THEREFORE, BE IT RESOLVED BY Tt~d CITY COUNCIL of the
City of Delray Beach as follows:
1st. That the appointment of the golf committee consisting
of D. M. Bradshaw, J. C. Keen, J. Leslie Brown, E. M. Wilson
and J. B. Smith is hereby reaffirmed and ratified.
2nd. That the custody, control and management of the muni-
cipal golf course is hereby turned over to and vested in said
committee above named.
3rd. That the appropriation of $2500. for maintenance and
operation of the golf course for the fiscal year from October 1,
1938 to September ~"~ 1939, is hereby reaffirmed and ratified.
4th, That the City Council hereby authorizes the transfer
of the sum of ~5000. from the water fund to the general fund of
the city and does hereby appropriate the sum of $7000. from
such general fund for the purpose of paying for the installation
of a water system and other equipment at the municipal golf
course, and also for fertilizer and other materials used in
improving said course. That it is the intention of this resolution
that the $7000. hereby appropriated shall be in addition to the
$2500. mentioned in paragraph 3 of this resolution.
5th. That the said sum of $7000. shall be expended by the
i City of Delray Beach in payment for the improvements mentioned
in the fourth paragraph of this resolution; that that portion
of the ~2500. set out in paragraph 3,v~hich now remains in the
city treasury, will be expended by the city for maintenance and
operation of the golf course. That all expenditures shall be
~ made by check, drawn by the proper city officials, after bills
for materials furnished and/or work performed upon the golf
course have been approved by a majority of the golf committee,
among which majority shall be the chairman thereof, and said
bills filed in the office of the city clerk.
6th. That in addition to approving the expenditure of the
sums of money set forth above, it shall also be the duty of the
golf committee to' cause to be kept a complete record of the
total income of the golf course and also a complete record of
'~ all the disbursements. It shall also be one of the duties of
'~' the committee to report to the City Council from time to tLme
as to the condition of the golf course and to also make such
recommendations as in the opinion of the committee would vmrk
for the betterment of said course.
7th. All resolutions and parts of resolutions, and all
actions of the City Council, as shown by the minutes thereof,
which are in conflict with this resolution, are hereby repealed.
