A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, ORDERING THE PERFOR~NCE OF CERTAIN LOT CLEARANCE
WORK°- ~~
WHEREAS the City Council of the City of Delray Beach,
Florida, did on the 28th day of August, A. D. 1939, adopt
a resolution ordering the City Engineer to prepare plans and
specifications for certain lot clearance work and did also
adopt a certain resolution on the same date accepting the plans
and specifications of the City Engineer for lot clearance work
and also the estimated cost of said proposed work and ordered
such plans and specifications and the estimates of the cost
thereof to be filed with the City Clerk and kept open for the
inspection of the public.
NOW, THEREFORE, be it resolved by the City Council of
the City of Delray Beach that the following improvements be
made, to-wit: Clering the following described lots in the City of
Delray Beach, Fla. of palmettos, wild growth, weeds and/or rubbish;

equal yearly installments with accrued interest on all deferred
pa~ents. Pe~ents shall be made in the same place that taxes
payable to the City of Delray Beach, Florida, are paid, to-wit,
the office of the City Tax Collector, and upon the failure of
any property oEer to pay any a~ual installment due or any part
thereof or any annual interest upon deferred pa~ents, the City
of Delray Beach ~y bring necessary legal proceedings by a bill in
chancery to enforce pa~ent thereof with all acc~ed interest,
together with all legal cost incurred, including a reasonable
attorney's fee.
The total estimated cost of the foregoing improvement is
$6 6.72.
IT IS ORDERED that the foregoing resolution be published
once each week for two consecutive weeks in the Del~y Beach N~s
a newspaper published in the City of Delray Beach, Florida.

BE IT FURTHER RESOLVED That the 'entire cost of such work~ be assessed
against the lots and land upon which such work is performed in proportion to
the benefits to be derived therefrom, said special benefits to be pro-rated ac-
cording to the foot frontage of the property specially benefitted by such work.
BE IT FURTHER RESOLVED That said special assessments against the lots
and lands specially benefitted shall be and remain lien superior in dignity to
all other liens, except liens for taxes until paid from the date of the assessment
upon the respective lots and parcels of land assessed and which will bear inter-
est at the rate of eight percent per annum and may be paid in ten equal yearly
installments with accrued interest on all deferred payments. Payments shall
be made in the same place that taxes payable to the City of Delray Beach,
Florida, are paid, to-wit, the office of the City Tax Collector, and upon the failure
of any property owner to pay 8ny annual installment due or any part thereof
or any annual interest upon deferred payments, tt'/e City of Delray Beach may
bring necessary legal proceedings by a Bill in Chancery to enforce payment
thereof with all accrued interest, together with all legal cost incurred, includ-
ing a reasonable atlorney's fee.
The total estimated cost of the foregoing improvement is $616.72.
IT IS ORDERED That the foregoing resolution be published once each
week for two consecutive weeks in the Delray Beach News, a newspaper pub-
lished in the City of Delray l~each, Florida.
