Res 322 RESOLUT~DN NO.~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEA(2~, FLORIDA, ORDERING THE CONSTRUCTION OF SIDEWALK ON N.E. 1st STREET. Group 5 WHEREAS, the City Coummil of the City of Delray Beach, Florida, did on the 28th day of August, 19~9 adopt a resolution ordering the City Enginmer to prepare plans and specifications f~r certain sidewalk construction, ami did also adopt a reso- lution on the 28th day of August, 1959, accepting plans, specifi- cations and estimate of cost of said construction work, and ordered said plans and specifications and estimate of cost thereof to be filed in the office of the City Clerk and a copy there of to be filed in the office of the City Engineer and kept open for inspection by the public. NOW, THEREFORE, be it resolved by the City Council of the City of De]ray Beach, Florida, that it has determined to _make the following described construction of a sidewalk which the City deems to be necessary for the safety and convenience of the public, to-wit: Construction of a sidewalk on N.E. 1st Street, between ~h Avenue and 7th avenue abutting on the following lots, with foot frontage as indicated: Lot 10 Block 107 1~5' Lot i Block 10B 1~5 ' Lot 10 Block 115 135 ' Lot 20 Block 115 1~5 ' Lot 1 Block 116 45' Lot 12 Block 116 37 ' The total estimated cost of which construction is $?55.00. BE IT FURTHER RESOLVED That the entire cost of such con- struction sh~.ll be assessed against all lots and lands adjacent and contingent or bounding and abutting on such improvement in proporition to the benefits to be derived therefrom, said benefits to be determined and prorated according to the foot fron,tage of the respective properties specially benefitted by said improvement. BE IT FURTHER RESOLVED That said special assessments against the lots end lands specially benefitted and adjacent and contingent or bounding and abutting upon such sidewalk construction shall be and remain liens superior in dignity to all other liens, except lien~ for taxem, until paid, from the date of the assessment upon the respective lots and parcels of land assessed and which shall bear interest at the rate of 8 per cent per annum and which may be paid in ten equal yearly installments with accrued interest on all deferred payments. Payment shall be made at the same place that taxes payable to the City of Delray Beach, Florida, are paid; namely, at the office of the City Tax Collector, and upon the failure of any property owner to pay any annual installment due, or any part thereof, or any annual interest upon deferred pay- ments, the C~y of Delray Beach may bring necessary legal pro- ceedings by a Bill in Chancery to enforce payment thereo~ with all accrued interest, together with all legal costs incurred, including a reasonable attorney's fee.
