'~FHEREAS the City Council of the City of Delray Beach,
Florida, did on tire ~__~Lday of ~ , 1939, adopt a
resolution ordering the city engineer to prepare plans, speci-
fications and estimates of cost of certain public iraprovements,
and did also on the 13th day of Nov~.tber, 1939, accept the plans,
specifications and estimates of cost of ~aid improvement work,

the City of Delray Beach, Florida, that it has determined to
make the roi/or,lng described public improvements which the City
deems to be necessary for the safety and convenience of the
public, to-~Lt:
The Construction of a sidewalk on the East side of S. E.
Seventh Avenue, from Atlantic Avenue to S. E. Second ,Street.
The total estimated cost
BE IT FU~TKER ~ESOLVED That the entire cost of such improve-
ment shall be assessed against all lots and lands adjacent and

contingent or bounding and abutting on such improvement in pr°-
portion to the benefits to be derived therefrom, said benefits
to be determined and prorated according to the foot frontage of
the respective properties specially benefitted by said improvement.
BE IT FURTHER R~oO~V~D That said special assessments against
the lots and lands soec'
~ ~a_,..ly benefitted and adjacent and contin-
gent or bounding and abutting upon such improvement shall be and
remain liens superior in dignity to all other liens,, except liens
for taxes, until paid, frora the date of the assessment upon the
fast, active lots and parcels of land assessed and which shall bear
interest at the rate of 8 per cent per annum and which may be paid
, in ten equal yearly installments with accrued interest on all
deferred payz%ents. Payment shall be made at the same place that
, taxes payable to the City of Delray Beach, Florida, are paid;
namely, at the office of the City Tax Collector, and upon the
failure of any property owner to pay any annual installment due,
· or any part thereof, or any armual interest upon deferred pay-
ments, the City of Delray Beach may bring necessary legal pro-
ceedings by a Bill in Chancery to enforce payment thereof with
all accrued interest, together with all legal costs incurred,
including a reasonable attorney's fee. The total amount of any
lien may be paid in full at any time with interest from the date
of assessment.
IT IS ORDERED That the foregoing resolution be published
once each week for two consecutive weeks in the Delray Ben, ch News,
a newspaper published in the City of Delray Beach, Florida.
ADOPTED By the City Council of the City of Delray Beach,
Florida, on this the l~th day of ll[OVember, 2~. D. 1959.
