A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH PROVIDING FOR THE FORM OF BALLOT TO BE USED IN
THE GENERAL ELECTION TO BE HELD ON TUESDAY, DECF~iBER
1939, DESIGNATING THE CANDIDATES V~t0 ARE ENTITLED TO
HAVE THEIR NAMES PRINTED THEREON, AND APPOINTING A CLERK
AND INSPECTORS TO HOLD SAID ELECTION.
WHEREAS the charter of the City of Delray Seach pro-
vides that the regular municipal election shall be held on the
first Tuesday in December of each year, and whereas the Mayor
of the City of Delray peach has, by proclamation.made in con-
fortuity with the city charter, called for said election to be
held on Tuesday, December 5, 193~, and whereas it is the duty
of the City Council to provide for the holding of said election,
NOW, THEREFORE, De it resolved by the City Council of
the City of Delray Beach as follows:
lat. The Council finds that no candidates qualified
by petition to have their names placed on the general election
ballot. The following candidates nominated by the primary
election held on November 7, 1939, are, therefore, the only
candidates entitled to have their names printed on the general
election ballot in the group indicated:
Group A - A.L. ~,iiller
Group B - W.A. Jacobs
Group C - C.W. Hill
2nd. The official ballot for said election shall be
substantially in the following form:

4th. This election shell be conducted substantially
on ~e principles adopted for State elections insofar as the
same do not ~nfliot ~th the charter of the City of Delray
Beach. The candidate in ~ch group ~o receives the highest
number of votes s~ll be declared elected.
5th. The result of the voting in said general
election, when ascertained, shall be certified by retu~ in
duplicate signed by the Clerk and a majority of the inspectors
of said election, one copy to be delivered to the ~yor and
the other to the ~ity Clerk, both of whom shall tran~t such
ret~ns to the City Gouncil at a called meeting to be held not
later than three days after such election. At such meeting
the City Council shall canvass the returns, and in the absence
of a declaration of a contest by any of the candidates in such
election, shall declare the ~sult of the election by the
returns made by ~e Clerk and inspectors for said election.
