termined that it is necess2ry for said work to be done according to the plans and
specifications on file' in the office of the City Engineer, and that it is required
that said improvements be so made. The City Council of the City of Delray
Beach, Florida, will sit at the Council Chambers in the City Hall of the City of
Delray Beach, Florida, at 7:30 o'clock on the 8th day of January, A. D. 1940, for
the purpose of hearing objections to the proposed improvement work.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ORDERING THE PERFORMANCE OF CERTAIN LOT
CLEARANCE WORK.
WHEREAS the City Council of the City. of Delray Beach, Florida, did on
the 27th day of November, A. D. 1939, adopt a resolution ordering the City
Engineer to prepare plans and specifications for certain lot clearance work,
and
WHEREAS the City Council has accepted the plans' and specifications of
the City Engineer for lot clearance work. and also the estimated cost of said
proposed work and ordered such plans and specifications and the estimates of
the cost thereof to be' filed with the City Engineer and a copy filed with the
City Clerk and kept open for the inspection of the public,
NOW. THEREFORE, be it resolved by the City Council of the City of Del-
ray Beach that the following improvement be made, to:wit: Clearing the fol-
lowing described lots in the City of Delray Beach, Florida, of palmettos', wild
growth, weeds and/or rubbish; the total estimated cost of,~which ~mprovement
is $2,450.00.

~BE IT FURTHER RESOLVED That, the entire cost of such work be as-
sessed again~ the lots and land upon whic~h such work is performed in ~propor,-
tion to the benefits to be derived therefrom, said special benefits to be pro-,
rated according to the foot frontage of the property specially benefitted by suchi
work.
BE IT FURTHER RESOLVED That said s~ecial assessments 'against the{
lots and lands specially benefitted shall be and remain lien superior in dignity
to all other liens, except liens for taxes until paid from~ the date of the assess-
ment upon the respective lots and parcels of land assessed and which will bear
interest at the rate of eight percent per annum and may be paid in ten equal
yearly installments with accrued interest on all deferred payments. Payments
shall be made in the same place that taxes payable to the City of Delray Beach, '
Florida, are paid,, to-wit, the office.of the City Tax Collector, and upon the fail-'
ute of any property owner to pay any annual installment due, or any part
thereof, or any annual interest upon deferred payments, the City of Delray
Beach may bring necessary, legal proceedings by a Bill in Chancery to ehforce
payment thereof with all accrued interest~ together with all legal cost incurred,
including a reasonable attorney's fee.
The total estimated cost of the foregoing improvement is $2,450.00.
IT IS ORDERED That the foregoing resolution be published once each week
for two consecutive weeks in the Delray Beach News, a newspaper published
in the City of Delray Beach, Florida.
