Res 175 RESOLOTION BOOK NO. 4 B~ IT RESOLVED, by the City Council of the City of Delray ~.~Beacn, Florida, that the said Council hereby joins individual owners of property aOutting tn~ east bank of Intra-Coastal iiWaterway, thru the City of Delray Beach, between t~e North and i South lines of Section 16, Township 46 South, Range 43 East, in making application to the war Department for permission to excavate material within the right-of-way lines of the Intra- Coastal ~aterway and deposit t~e same easterly of the east right-of-way line of said ~aterway; and BE IT FURTHER RESOLVED, that the City Council hereby waives all objections to the excavation and removing of the materials iy2ng west of said east right-of-way line including t~e following areas designated as streets and avenues to-wit: M~rket Street (N. E. 4th St.), LairgStreet, Thomas Avenue, Lowry Street, Lawrence Street, Ingram Street, Shulson Street, watson Street (S. E. 4th St.) and Miles Street; and BE IT FURTHER RESOLVED, that all owners of property lying east of the Intra-Coastal Waterway between the North and South section lines of said Section 16 in the City of Delray Beaci~, Florida, and the officers and officials of the War Department are hereby requested to cooperate to their fullest extent in granting as expediciously as possible the necessary waivers and permit in order to expedite the work of filling these low lands and swamp areas whic~ are ~ menace to the health and com- fort of the entire community, and BE IT FURTheR RESOLVED, that the ~ayor and City Clerk are hereby requested and directe~ to furnish t~e necessary signed copies of the foregoing Resolution, to owners of property in the area east of the Intra-Coastal ~aterway, when such owners make application to ti~e War Department for permission to excavate !iand cut away the area easterly' of the Intra-Coastai Waterway within iltne City limits of Deiray Beach, Florida. Dear Sir, Attention: Colonel Brown The owners of lands lying East of the Intra- Coastal waterway in the City limits of Delray Beach, in conjunction with the City of Delray Beach, are making application for permission to excavate the area along the easterly bank of said Canal. The City of ~Delray B~ach, by resolution, has already joined with the owners making such application, requesting the immediate granting of the necessary per- mission, and herewith we wish to state the reasons for an early consideration of this request. First - The mosquito and sand fly menace is great and the comfort and health of the entire community is Jeopardized. Second- There is now present and ready to start work, necessary equipment in the ~orm of a suction dredge and drag line machine. Third - The equipment is owned and operated by a public spirited contractor who is willing to cooperate to the fullest extent and he has shown his willingness to cooperate by submitting a very reasonable price for the work -- provided work is started at once, as he is unable to · hold the ~uipment in this location after the first of July 1937. Fourth- In order for the City and landowners to take advantage of the above outlined conditions it will be greatly appreciated by the undersigned, representing the City of Delray Beach, if you will do whatever you can to expedite the issuance of the permits covering the areas above referred to CITY OF DELRAY BEACHs Mayor.
