A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, PAL~ BEACH COUNTY, FLORIDA, ADOPTING ITS ANNUAL ~UDG~ OF EST I~h~TED EXPENSES FOR THE FISC~L YEAR 1937-1938, AND FOR Tt~ PUtTPO.J',2~ OF LEVYING a TM ON ALL TPLE PROPERTIES WITHIN SAID CITY FOR MAINTENANCE /AND OPERATION, AND FOR THE FURT~R PURPOSE OF LA%lYING A TAX FOR Ti~2 PAYMENT OF A PORTION OF THE CURRENT BOND I~TF~ST AGAINST TH~.T PROPERTY LOCATED IN THE FORI~ifER CITY OF DELPJ~Y, D~ND FOR THE PURPOSE OF LEVYING ~ TAX FOR PRINCIPAL AND INTEREST AGAINST Ti-MT PROPERTY LOCATED IN -~T~@~MER TO'~'N OF DELPJ~Y BEn, CH, AND FOR THE ~ LEVYING A T~ AGAINST PROPERTY LOC~T~-~ THE FORMER T0~;-N OF DELRAY BEACH FOR GENEPJ~L SEWER I~PROVF~JNTS, AND FOR ALLOC~q.TING AND APPROPRIATING SAID COLLECTIONS THEREUNDER, AND FOR OTHER PURPOSES. ?~I~AS, the City Council of the said City of ~lray Beach, Florida, has prepared its budget of estimated expenses for the fiscal year 1937-1938 and has also determined the amount of millage necessary to be levied on all of the property ilwithin the City for the maintenance and operation of said City, and for the payment of bonds of said City and the interest iithereon. P. ~.. projects 3,00_0._00 Park Maintenance & Beautification "1.200.00 B E IT ~-%~RT~R RESOLVED, that the estimated amount of revenue to be used for maintenance, which Till be derived by said City of Delray Beach during said fiscal year from sources other than current tax levy, is as follows: From delin~uent taxes on property in the former City of Delray, receivable in cash, which was levied for operating or maintenance $2,500. O0 From miscellaneous sources: Cemetery lots sold $ 40.00 Interest and fees paid in cash 1,700.00 Occupational licenses 6,000.00 Permit fees-Bldg. Elec. & Plumb. 1,500.00 Police fines and forfeitures _1,500.00 ~10,740.00 $1~.£40.00 And the amount of money necessary to be raised by taxation for maintenance and operating expense is $~3,t70.00 BE IT FURTHER RESOLVED, that there shall be and is hereby appropriated for the payment of the several items of expenditures totalling the aggregate sum of Thirty-six Thou- sand Four Hundred Ten Dollars ($36,410.00), the revenues de- rived from the taxes of Twenty mills (20) hereby levied on all taxable property within the City of Delray Beach for the fis- cal year 1937-1938, the assessed valuation of all taxable property for operating purposes within the City of Delray Beach being $1,337,~78.75, for operating and/or maintenance expenses of General Government, and also in addition of revenues derived by said City during said fiscal year from all other sources, other than the tax levy for current bond interest and that part of the collection on delinquent taxes levied for bond service. It is found that it is necessary to make a special levy for the purpose of constructing necessary sewers in the former Town of Delray Beach and that for such purpose there is estimated to be an expenditure of Two Hundred Fourteen and 20/lOOths Dollars ($214.~0) for this purpose. BE IT FUR~ RESOLVED, that there shall be and is here- by appropriated for the construction and for the repayment of monies advanced for the construction of sewers in the former Town of Delray Beach the sum of Two Hundred Fourteen and 20/lOOths Dollars ($214.~0), and that there is hereby levied a One (1) mill special tax on all taxable property within the former Town of Delray Beach for the fiscal year 1937-1~38, all of such revenue to be derived from said One (1) mill tax shall be used in the construction and repayment of monies advanced for the construction of such public sewers in the former To~rn of Delray Beach. It is found that the amount of money to be levied for bond debt service on bonds and interest issued by the former Town of Delray Beach is Two Thousand Three Hundred Eighty- four and 5$/lOOths Dollars ($~,384.59). BE IT FURTHER RESOLVED, that there is hereby appropriated~ ii for the payment ef interest and principal on bonds of the former i!!i Tomua of Delray Beach, all revenues derived from the tax levy i!ii of eight and one-half mills (8½), hereby levied for that purpose .~for the fiscal year 19~7-1~8 upon all taxable property within i!the limits of the former Town of Delray Beach, and also, all revenues heretofore levied on the property within the former ilTown of Delray Beach derived from delinquent taxes levied for .~said bonds or interest in years prior to the fiscal year 1937- ~d1D, %~EREAS, the Czty Council has been ordered by the peremptory writ of mandamus in Common Law Case No. 8~SS~to levy a tax against all taxable property ~ithin the City of Delray "Beach (exclusive of the taxable property within the former Town {iof Delray Beach) in an amount that will raise Twenty-four ~Thousand Six Hundred Eleven and ?6/lOOths Dollars ($~4,611.76), land that said amount be appropriated and set aside for the pay- ilment of current interest on bonds of the fo~mer City of Delray iias set forth and described in the alternative writ of mandamus ~filed~ in said mandamus proceedings in the Circuit Court of i~Palm Beach County, Florida; Now, Therefore, BE IT RESOLVED, that there shall be and ilis hereby appropriated for the purpose of paying a portion of the interest coming due during the fiscal year 19Z7-19~8 on said bonds described in said peremptory writ of mandamus, the same being as follows, to-wit: Purpose Interest Date of Amount of of Issue. The assessed valuation of all taxable oroperty within the former City of Delray being One Million Four Hundred Ninety-one Thousand Six Hundred Dollars ($1-~4~9t~)~G0), and the levy of Sixteen and one-half mills (16½) against said property herein- above provided will raise Twenty-four Thousand Six Hundred Eleven and 76/100ths ($B4,611.76), which is a compliance with the peremptory writ of mandamus hereinabove described. It being the puroose and intent to levy said Sixteen and one-half ~ills (16~) as just above stated and to appropriate the collection therefrom exclusively to be paid on current interest coupons -5- coming due during the fiscal year on the bonds just above des- cribed. The Tax Collector, Clerk, Treasurer and ~ayor of the City of Delray Beach are authorized and directed to make such collections and pay said monies out only for the purpose of paying current interest on said bonds. BE IT FURTHER RESOLVED that there shall be and is hereby levied upon all the taxable property within the former City of Delray; that is, upon all taxable property, including homesteads, regardless of valuation thereof, within the present City of Delray Beach (except the taxable property within the former Town of Delray) Sixteen and one-half mills (16.5) on the dollar of the assessed valuation of said property,~ and that all the revenues and proceeds derived from said levy be and they are hereby appropriated for the purr)ose of paying said interest upon the bonds of James E. Easton, ~lbert C. Mittendorf and A S Huyck, hereinabove listed and described and involved in said peremptory writ of mandamus, accruing or to accrue during the fiscal year 19J7-19~8, whether represented by coupons or being interest at the contract rate du~ing said fiscal year on the bonds included and described in said peremptory writ of mandamus; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said Sixteen and one-half mills (16.5) as above stated and to appropriate the collections therefrom exclusively to be paid on the interest maturing during the fiscal year 19j7-1938 on said bonds above ~ scribed and included in said peremptory writ of mandamus, and the Tax Collector, Clerk and Treasurer of said City of Delray Beach is authorized and directed to make such collection and pay the proceeds of such collections for the purposes aforesaid. Il AND, WHEREAS, the City Council has been ordered by the peremptory writ of mandamus described in Common Law Case No. 8386to levy a tax against all taxable property in the City of Delray Beach (exclusive of the taxable property within the former Town of Delray Beach) in an amount that will raise Two Thousand Four Hundred Sixty-one and 14/lOOths Dollars ($2,461.14), and that said amount be appropriated and set aside for the payment of current interest on bonds of the former City of Delray as set forth and described in the alternative writ of mandamus filed in said mandamus proceedings in the Circuit Court of Palm Beach County, Florida; Now, Therefore, BE IT RESOLVED, that there shall be and is hereby appropriated for the purpose of paying a portion of the interest coming due during the fiscal year 1937-1938 on said bonds described in said peremptory writ of mandamus, the sams being as follows, to-wit: Designation Interest Principal of Bond Date Rate Amount Bond Numbers General Improvement 5-1-~5 6% $72,000.00 @/80. all revenue derived from the levy of One and 65/lOOths Mills (1.65) hereafter levied on all taxable property within the former City of Delray for the fiscal year 1937-1~38. The assessed valuation of all taxable property within the former City of Delray being One Million Four Hundred Ninety-one Thousand Six Hundred Dollars ($~ and the levy of One and 65/lOOths Mills (1.65) against said property hereinabove prowided will raise Two Thousand Four Hundred Six~y~,one and 14/lOOths Dollars ($2,461.14) which is a compliance with the peremptory writ of mandamus hereinabove described. It being the purpose and intent to levy said One and 65/lOOths Mills (1.65) as just i~above stated and to appropriate the collection therefrom exclusively -7- to be paid on current interest coupons coming due during the fiscal year on the bonds just above described. The Tax Col- lector, Clerk, Treasurer and Mayor ef the City of Delray Beach are authorized and directed to make such collections and pay said monies out enly for the purpose of paying current interest on said bonds. BE IT FURT~B RESOLVED that there shall be and is hereby levied upon all the taxable property within the former City of Delray, that is, upon all the taxable property, includ-~ ing homesteads, regardless of valuation thereof, within the present City of Delray Beach (except the taxable property within the former Town of Delray), One and 65/lOOths Mills (1.65) on the dollar of the assessed valuation of said property, and that all the revenues and proceeds derived from said levy be and they~e hereby appropriated for the purpose of paying said interest upon the bonds of said Bessemer Properties, Incor- porated, hereinabove listed and described and involved in said peremptory writ of mandamus, accruing or to accrue during the fiscal year 19~?-19~8, whether represented by coupons or being interest at the contract rate during said fiscal year on the bonds included and described in said peremptory writ of mandamus; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said One and 65/lOOths Mills (1.65) as above stated and to appropriate the collections therefrom exclusively to be paid on the interest maturing during the fiscal year 1937-1938 on said bonds above described and included in said peremptory writ ef mandamus, and the Tax Collector, Clerk and Treasurer ef said City of Delray Beach is authorized and directed to make such collection and pay the proceeds of such collections for the purposes aforesaid. It being the purpose and intent to levy said One-half ~ill (½) as just above stated and to appro- priate the collection therefrom exclusively to be paid on current interest coupons coming due during the fiscal year on the bonds Just above described. The Tax Collector, Clerk, Treasurer and Mayor of the City of Delray Beach are authorized and directed to make such collections and pay said monies out only for the purpos~ of paying current interest on said bonds BE IT FURTHER RESOLVED that there shall be and is hereby levied upon all the taxable property within the former City of Delray, that is, upon all the taxable property, in- cluding homesteads, regardless of valuation thereof, within the present City of Delray Beach (exgept the taxable property within the former To~ of Delra3~~), 0ne-half Mill (½) on the. dollar of the assessed valuation of said property, and that all the revenues and proceeds derived from said levy be and they are hereby appropriated for the purpose of paying said hereinabove interest upon the bonds of Vermont Investment Company,/listed and described and involved in said peremptory writ of mandamus accruing or to accrue during the fiscal year 1937-1938, whether represented by coupons or being interest at the contract rate during said fiscal year on the bonds included and described in said peremptory writ of mandamus; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said 0ne-half Mill (½) as above stated and to appropriat~ the collections therefrom exclusively to be paid on the interest maturing during the fiscal year 1937-1938 on said bonds above described and included in said peremptory writ of mandamus, and the Tax Collector, Clerk and Treasurer of said City of Delray Beach is authorized and directed to make such collection and pay the proceeds of such collections for the purposes aforesaid. AND, ~EREAS, the City Council has been ordered by the peremptory writ of mandamus described in Case No. Civil, of the United States District Court of Florida, ~iami Division, to levy a tax against all taxable property in the City of Delray Beach (exclusive of the taxable property within the former Town of Delray Beach) in an amount that will raise Two Thousand Two Hundred Thirty-seven and 40/lOOths Dollars ($~,237.40), and that said amount be appropriated and set aside for the payment on said judgment against City of Delray Beach as set forth and described in the alternative writ of mandamus filed in said mandamus proceedings in the United States District Court forthe Southern District of Florida, Miami, Division. Now, Therefore, BE IT RESOLVED, that there shall be and is hereby aporopriated for the purpose of making a payment on said Judgment during the fiscal year 1937-1938, as described in said peremptory writ of mandamus, the same being as follows, to-wit: Final Judgment rendered in the United States District Court of the Southern District of Florida, Miami Division, being case No. 2328-M-Civil in favor of Calmgrove Securities i! Corporation, a corporation organized and ii existing under the laws of the State of Delaware ii against City of Delray Beach, a municipal corpora- !i tion organized and existing under the laws of the 'i State of Florida, in the sum of Nine Thousand Six Hundred Eighty-six and 82/lOOths Dollars :~ ($9,686.82), dated September 8, 1936; ~!iall revenue derived from the levy of One and one-half Mills (1½) ilhereafter levied on all taxable property within the former City !iof Delray for the fiscal year 1937-1938. The assessed valuation !iof all taxable property within the former City of Delray being 'One Million Four Ninety-one Thousand Six Hundred Dollars i1($~F49~~0~) and the levy of One and one-half Mills (1½) 'against said property hereinabove provided will raise Two iThousand Two Hundred Thirty-seven and 40/lOOths Dollars ($~,237.40~ iwhich is in compliance with the peremptory writ of mandamus here- inabove described; it being the purpose and intent to levy said One and one-half Mill (1½) as just above stated and to appropriate' the collection therefrom exclusively to be paid on said Judgment during the fiscal year 1937-1938. BE IT FUF~HER RESOLVED that there shall be and is hereby levied upon all the taxable property within the former City of Delray, that is, upon all the taxable property, in- cluding homesteads, regardless of valuation thereof, within the present City of Delray Beach (excep~t the taxable property within the former Town of Del~a~), One and one-half Nills (1½) on the dollar of the assessed valuation of said property, and that all the revenues and proceeds derived from said levy be and they are hereby appropriated for the purpose of paying a portion of the Judgment of ®~ Calmgrove Securities Corporation, herein- and involved above described/~n said peremptory writ of mandamus; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said One andone-half ~ills (1½) as above stated and to appropriate the collections therefrom exclusively to be paid on the judgment during the fiscal year 1957-1938 as hereinabove described and described in said perem- ptory writ of mandamus, and the Tax Collector and Treasurer of said City of Delray Beach is authorized and directed to make such collection and pay the proceeds of such collections for the purposes aforesaid. AND VF~EREAS, George Kiess, plaintiff in that certain i~ Civil Case No. E4~5£-!~-Civil, in the United States District Court I~ in and for Niami Division, Southern District of Florida, did obtain against the City of Delray Beach a final judgment on ~ the ~Sth day of 0ctober¢ A. D. 1~?, in the sum of Thirty-six ii Thousand Five Hundred Seventy-nine and l~/100ths Dollars i! ($g~,,57¢.1¢), and the said George Kiess tl~ough and b-~r his II attorneys, Williamson, Cain and Baugher, has stipulated with · ~the City of Delray Beach that the said George Kiess will accept the sum of Seven Hundred Fifteen Dollars ($715.00) to be applied on the payment of said judgment, said sum of Seven Hundred Fif- ~teen Dollars ($715.00) to be raised by the levy of 0ne-half Nill ii(½) against the taxable properties in the City of Delray Beach (exclusive of the taxable property within the former Town of 'Delray) and will execute partial releases of said judgment ~from time to time as the monies to be raised from said 0ne-half ~Nill (½) is paid to him, or to his attorneys. Now, ~herefore, BE IT RESOLVED, that there shall be and is hereby aporopriated for the puroose of paying a portion of said judgment during the fiscal year 19Z7-1938, said judgment hereinbefore described, all revenue derived from the levy of 0ne-half Nill (½) hereafter levied on all taxable property within the former City of Delray for the fiscal year 1937-1938. The assessed valuation of all taxable property within the former ~ City of Delray being One ~illion Four Hundred Ninety-one Thousand~ Six Hundred Dollars (~~) and the levy of 0ne-half ~ill (½) against said property hereinabove provided will raise in Seven Hundred Fifteen Dollars ($715.00) which is/~mpliance ~ ~ith the stipulation entered into; it being the purpose and ' '~intent to levy said 0ne-half Will (½) as just above stated and ilto appropriate the collection therefrom exclusively to be paid ilon said judgment during the fiscal 19Z7-1938. BE IT FURTHER RESOLVED that there shall be and is hereby levied upon all the taxable property within the former City of Delray, that is, upon all the taxable property, includ- ing homesteads, regardless of valuation thereof, within the present City of Delray Beach (except the taxable property within the former Town of Delray), One-half Mill (½) on the dollar of the assessed valdation of said property, and that all the revenues and proceeds derived from said levy be and they are hereby appropriated for the purpose of paying a portion of the judgment of George Kiess, hereinabove described; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said One-half Mill (½) as above stated and to appropriate the collections therefrom exclusive- ly to Be paid on the judgment during the fiscal year 19~7-1938 as hereinabove described, and the Tax Collector and Treasurer of said City of Delray Beach is authorized and directed to make such collection and paylhe proceeds of such collections for the purposes aforesaid. And there is also pending in the Circuit Court of Palm Leach County, Florida, a suit instituted by State of Florida ex rel. T. B. Walker versus the City of Delray Beach, said suit involving the collection of interest coupons attached to Bonds Nos. 541 to 550 inclusive, ~nd of General Improvement Bond Issue of 1926 of the City of Delray, and said bonds aggre- gating the sum of Ten Thousand Dollars ($10,000.00); And ~hereas, Eugene C. The assessed valuation of all taxable property within the former City of Delray being One ~£illion Four Hundred Ninety-one Thousand Six Hundred Dollars ($ ) and the levy of 20/lOOths Mill against said property hereinabove provided will raise Two Hundred Ninety-eight and 32/lOOths Dollars ($298.32). It being the purpose and intent to levy said 20/lOOths as just above stated and to appropriate the collection therefrom exclusively to be paid on current interest coupons coming due during the fiscal year on the bonds just above described. The Tax Collector, Clerk, Treasurer and Mayor of the City of Delray Beach are au- thorized and directed to make such collections and pay said monies` out only for the purpose of paying current interest on said bonds.I BE IT FURTHER RESOLVED that there shall be and is ~ hereby levied uoon all the taxable property within the former City of Delray, that is, upon all the taxable property, includ- ing homesteads, regardless of valuation thereof, within the present City of Delray Beach (except the taxable property within the former Town of Delray), ~O/lOOths l~ills on the dollar of the assessed valuation of said property, and that all the revenue~ and proceeds derived from said levy be and they are hereby appropriated for the purpose of paying said interest upon the bonds aforesaid, acmuing or to accrue during the fiscal year 1937-1@38, whether represented by coupons or being interest at the contract rate du2ing said fiscal year on the bonds include~l and described above; and it is hereby declared and resolved that the purpose and intent of this resolution is to levy said ~O/lOOths Mill (.~0) as above stated and to appropriate the collections therefrom exclusively to be p~id on the interest maturing during the fiscal year 19g?-19~8 on said bonds above described, and the Tax Collector, Clerk and Treasurer of said City of Delray Beach is authorized and directed to make such collection and pay the proceeds of such collections for the purposes aforesaid.
