A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF D~Y BEACH, FLORIDA,
ORDERING THE CONSTRUCTION OF CERTAIN SID~ IMPROVEMEET WORK.
~ the City Council of the City of Delray Beach,
Florida, did on the 8th day of August, 1938, adept a resolution
ordering the City Engineer to prepare plans and specifications for
certain street improvement work and did also adopt a resolution on
the 22nd day of August, 1938, accepting the plans and specifications
of the City Engineer for said street improvement work and also the
estimated cost of said proposed improvement and ordered said plans
and specifications and the estimates of the cost thereof to be filed
with the City Clerk and kept open for the inspection of the public.
NOW, ~0RE, BE IT RESOLVEDBy the City Council that
the following improvements be made, to-wit:
Construction of a sidewalk along the South side of
Atlantic Avenue from the East property line of Gleason Avenue to the
West property line of Bronson Street, said sidewalk abutting on
Lots one (1) to six (6), Block Three (3), and Lots one (1) and
two (2) and the East ten feet (E. 10') of Lot Three (3) of Block
Four (4), all in Ocean Park, a subdivision in the City of Delray
Beach, Florida. The estimated cost of which improvement is $
BE IT FURTHER RESOLVED That the entire cost of said
improvements shall be assessed against all lots and land adjoining
and contiguous or bounding and abutting on such improvements in
proportion to the benefits to be derived therefrom, said special
benefits to be determined and pro rated according to the foot
frontage of the respective properties specially benefited by said
improvements.
BE IT FURTHER RESOLVED That said special assessments
against the lots and lands specially benefited and adjoining and
contiguous or bounding or abutting upon such improvements shall be
and remain liens superior in dignity to all other liens, except
liens for taxes, until paid from the date of the assessment upon the
respective lots and parcels of land assessed and which bear interest
at the rate of eight percent (~) per annum and may be paid in ten
(10) equal yearly installments with accrued interest on~ all dsferr.d
payments~ Payments shall be made ~t the same time and in the same
place that taxes payable to the City of Delray Beach, Florida, are paid,
namely: from November 1st t~ April 1st of each fiscal year at the
office of the City Tax Collector each year and, upon the failure of
any property owner to pay any annual installment due or any part
thereof or any annual interest upon deferred payments, the City of
Delray Beach may bring necessary legal proceedings by a bill in
chancery to enforce payment thereof with all accrued interest,
together with all legal cost incurred, including a reasonable
attorney's fee. The total amount of any lien may be paid in full
at any time with interest from the date of assessment.

IT IS ORDERED That the foregoing resolution be published
once each week for two consecutive weeks in the Delray Beach News,
a newspaper published in the City of Delray Beach, Florida.

NOTICE
All persons who may be interested in the proposed
improvement work, to-wit, the construction of a sidewalk along the
South side of Atlantic Avenue from the East property line of Gleason
Avenue to the West property line of Bronson Street in the City of
Delray Beach, Florida, are hereby notified that the City Council of
the City of Delray Beach, Florida, has determined that it is necessary
for said improvements to be made according to the plans and specifica-
tions on file in the office of the City Engineer and that it is required
that said improvements be so made. The City Council will sit at the
Council Chambers in the City Hall of the City of Delray Beach, Florida,
at 7:30 o'clock P. M. on the 10th day of October, A. D. 1938, for the
purpose of hearing objections to said proposed improvements.
