Res 117 BE IT RESOLVED BY THE Ci2~Y COUNCIL OF THE CITY OF DELRAY
BEACtt, FLORIDA:
Section 1. ~ny witness in a cause in the 1/[unicipal Court
shall be allowed as compensation for each day's attendance the
sum of fifty cents, which fee is to be taxed as costs against the
defendant in case of conviction and against the city in case of
acquittal.
Section 2. In case of a conviction of a violation of an
ordinance of this city, there shall be taxed as costs against
the defendant, the fees of all officers prescribed by the
ordinances and all of the costs that have legally accrued in the
cas e.
Section 3. That the City Clerk skall receive the sum of One
Dollar for drawing each affidavit filed in the ~[unicipal Court
of said City and ~he sum of fifty cents for issuing each warrant;
that the Chief of Police shall receive the sum of One Dollar for
the service of each warrant issued out of said court which said
sums shall be taxed as cost~ to be paid by the defendant in case
of conviction in addition to the sentence imposed, and to be
paid by the Complaining witness or the ~i:y in case of acquittal.
~ection 4 That where any complaint is made in the Municipal
court by any oerson oth'er than the Chief of ~olice or a police
officer or other department head or officer of said city, no
affidavit shall be filed or warrant issued until the complaining
witness shall deposit with the Clerk the ~qum of two a ollars ant.

to the complaining witness, an~ in case of acquittal, said

however that if any person is insolvent and unable ~o a~.vance
said costs, he may make an affidavit Zhat he has good grounds of
complaint and is insolvent and has no money with which to pay
said costs aha if said affidavit be supported by the affidavits of
two reputable citizens of said City who shall swear ~h. at they verily
believe ;he complainant to be insolvent an~ unable to pay said
fees in that case the Municioal Judge shall make an order that

said affidavit and warra~-Lt be issued and served without the
payment of said costs.
Section 5. When not otherwise provided, the same fees shall
be taxed in the Diunicipal Court as in Courts of Justices of the
Peace.
Section 6. That all fees and costs collected under and by
virtue of this resolution, be deposited by the City Clerk in
the General Fund of the City of Delray Beach, Florida, to be
u~ed in paying the. costs of the operation of the ~[unicipal
Court and Police Department of said City of Delray Beach,
Florida.
