A special meeting of the City Council of Delray Beach was
held in the Council Chambers at 9:00 A.M., with Mayor George V.
Warren in the Chair, City Manager George Mingle, City Attorney
Richard F. Zimmerman and Councilmen A1 C. Avery, Dugal G. Campbell
and John A. Thayer being present.
Mayor Warren called the meeting to order announcing that the
same had been called for the purpose of advising the public of a new
ordinance, which is an emergency ordinance, covering the method of
billing the garbage collection service charges along with the water
charges on the same statement. This does include some changes which
we felt that the public should know from publication in the local
and neighboring newspapers prior to adoption of this ordinance, an
emergency adoption, for the health and benefit of the City functions,
as of next Monday night. This is a revision of the present ordinance
in billing procedures and they are for the following reasons:
1. To simplify billing by combining both the water
and collection service bills.
2. To avoid the necessity of compelling property
owners to paste tpaid-upt stickers on containers
every quarter.
3. To have an effective means of enforcing collection
of garbage bills so that all who have a collection
of garbage shall pay their proper share.
4. To eliminate delay and confusion.
Mayor Warren also pointed out that when this ordinance goes into
effect, anyone who leaves their water service on during the summer
for watering of yards will be charged the collection service charge,
and that there will be a proration of charges for commercial col!ac~,
tion services read into the ordinance. That is the purpose of this
meeting, the ordinance will not be acted on this-morning, but we do
hope that the press will give this proper publicity so that next
Monday night any of our citizens may be heard from at a hearing
prior to adoption of the ordinance.
Following general discussion, which in the main was seeking
clarification of such proposed ordinance to provide for revised
billing of collection service charges, by individuals from the
audience, Councilman Avery moved that this be tabled with the
assurance to the public that the proposals will be published in
detail and that a public hearing will be held before the final
ordinance is drafted. The motion was seconded by M~. Thayer and
carried unanimously.
Upon question by Mayor Warren as to how the Council wanted
to handle this matter, Councilman Avery stated that he agreed with
~. Campbell in that he thinks the Council should discuss the things
that they want, publicize them as to what they propose, schedule a
public hearing and at the following meeting have the first reading
of the redrafted ordinance and two weeks later the reading of the
ordinance and its public hearing in the regular procedure of passing
an ordinance.
The meeting adjourned at 10:15 A.M. on motion by Mr. Campbell.
