05-12-61SpMtg MAY 1E.~ 1961. A special meeting of the City Council of Delray Beach was held in the Council Chambers at 11:00 A.M., with Mayor George V. Warren in the Chair, City Manager George Mingle and Councilmen A1 C. Avery, Dugal G. Cmmpbell, Glenn B. Sundy and John A. Thayer being present. Mayor Warren called the meeting to order announcing that same had been scheduled for the purpose of considering an offer r~ceived for the purchase of a City owned parcel of land, and for any other _.~business that may come before .the meeting. 3~i~',~ May~or Warren stated~tha~ the property in question is about 2 and acres of City owned pr6~rty lying South of S. E. 10th Street and west of S. E. 5th Avenue. City Clerk Worthing informed the Council that a base bid had been Peeeived on said land which is the only method of procedure for con-. sideration by the municipal government for disposition of City owned land and that the Council should direct that this base bid be retUrned or direct the Cit~ Clerk to proceed in accordance with provisions set forth in the Charter to advertise for public auction of said land~ which is the N~ of the S~ of Model Land Company,s Lot 10, Section Township [~6 South, Range [~3 East, and in so doing at such time as a public auction, which is the only manner or means that this land can be disposed of, follows two.consecutive weekly advertisements of such proposed sale, the City Council may then either accept the high bid or ~eject all bids. During lengthy discussion, ~. Campbell asked that City Manager Mingle get an opinion from the Attorney as to whether or not the Council can take into consideration anything othe~ than the dollar consideration; in other words, if one party comes through with a definite plan to build a certain expensive project while another person is just bidding on it for an investment, would the City have the right of decision between the two. Mr. Campbell moved that the property in question be put up for sale, it being understood that the Council has the right to accept the high bid or reject any and all bids. The motion was seconded b~ Mr. Thayer and carried unanimously. Upon question from the audience it was reported that the Oase bid on said City owned property was received from Mr. Blomgren of the Atlantic Realty Company in Fort Lauderdale. Mr. Sundy moved that the City owned 2% acre tract of land about ~i~x mlles West of Delray Beach be p~*. u~ for public sale at this time. motiom was seconded by Mr. Thayer a~,~ ~arried unanimously. Campbell asked that this report be avai~t~,e the next Council me~ting if possible. ~.e at Mr. Avery moved that the City Manager be directed to see that every attorney in town who is qualified, according to the City Charter, be circularized to see who is interested in being City Attorney~ to stipulate the Job and pay; also the services that he would · extra pay for. The motion was seconded by Mr. Sundy and carried unanimously. Mr.. Sundy moved that Attorney W. C, Williams, III., be officially notified that he does not qualify to serve as City Attorney and that the regrets of the Council be expressed.
