06-26-61 JUNE 26, 1961. JUNE ~6, 1961. A regular meeting of the City Council of De]may Beach was held in the Council Chambers at 8:00 P.M., with Mayor George V. Warren in the Chair, City Manager George Mingle and Councilmen A1 C. Avery, Glenn B. Sundy and John A. Thayer ~eing present. An opening prayer was' delivered by the Rev. Gustave Malmquist. On motion by M~. Sundy and seconded by Mr. Aver~ the minutes of June 12th, 1961 meeting were unanimously approved. Mayor Warren read the following Beautification Committee Meeting Minutes of June 15th, 1961: "Members present were: Lora Britt, Gladys Little, George Warren, Stuart Lankton, Bud Merritt, Ed Schraidt and Joe Santo. "Minutes of the last meeting were approved as read. "Chairman Britt asked the committee to consider a replacement for the vacancy of Mr. J. Ross Adams. "Joe Sante repo~ted work had begun at the city nursery. "It was the unanimous feeling of the committee that the city .. be asked to include the following items of landscapirg; and beautificati°n in their 1961'1962 budget: 1. Regarding the replacement of Mr. J. Ross Adams on the Beautifi- cation Committee, Mayor War~en announced that would be postponed for a couple of weeks to give it more consideration. Mayor Warren announced that if anyone was interested in what the Beautification Committee was doing it could be observed at the North entrance to Delray Beach and several othe~ Jobs. City Clerk Worthing presented the following bids Which were re- ceived covering equipment necessary for installation on the Cityts water reserve tanks, as directed by the Safety Industrial Commission of the State of Florida and stated that it had been recommended that the award be made to the low qualified bidder: Safety Equipment Co. of Florida $910.50 Heyer Machine, Inc. $935.00 It was moved by Mr. Sundy, seconded by M~. Thayer and unanimously carried that the bid be awarded to the Safety Equipment Company of Florida. ~ ? /-' The City Clerk informed the C~uncil that M~. George J. Binns of ?09 S. E. 9th Street requests transfer of Beer License No. 171~ issued to the recently known Doll's Restaurant at 2~ S. E. 6th Avenue to the Reef Restaurant at that same location; also that Mr. Binns had been checked and approved by the Police Department in compliance with Code of Ordinance requirements and that it is recommended that trans- fer of the above referred to beer license be approved. It was moved by Mr. Avery, seconded by Mr. Thayer and unanimously carried that said transfer of beer license be approved. 6-26-61 JUNE 26~ 1961. City Clerk W°rthing reviewed a report of alleged nuisances exist- ing in 'violation of~ Ordinance No. G-I~? furnished the City Manager by the Fire Department. It was !moved by Mr. Thayer, seconded by Mr. Sundy and unanimously carried to d~rect the City Clerk to comply with Ordi- nance No. G-388 as applicabl$ to this nuisance survey report. (copy of list of nuisance violations is attached to and made a part of the official copy of these minutes.) Pages 224-A thru 22~-I. Mayor~Warren announced that a resignation as a member of the Board of Adjustment had been received from John Ross Adams due to him having been appointed as City Attorney and he cannot serve in both capacities. It was moved by Mr. Avery, seconded by Mr. Thayer and unanimously carried that his resignation be regretfully accepted. It was moved by Mr. Sundy, secnnded by M~. Avery and unanimously carried that Harmy T. Newett be appointed to the Board of Ad. Justment as a replacement of John Ross Adams, term to expire March 15, 1964. City Clerk Worth.ing informed the Co.uncil that Ordinance No. G-342 adopted on February 15, 1960, authorized the appointment of a BOard .of Adjustment, and further provided that alternates for such board mem- bers could be apbointed, and the Board of Adjustment now recommends appointment of the following named citizens of Delray Beach to serve as Alternates for its Board Members and their respective terms of office: ALTERNATE ~E~U~R ~TER~ TO EXPIRE John H. LeR0y Croft and Marshall DeWitt be appointed as alternates to' th® BOard of Adjustment as recommended in the above schedule, with terms to 'expire as stated. ~The motion was seconded by M~. Avery-and-carried unanimously. City Clerk Worthing read the following request from Dr. Charles C. Dugan of the Seacrest Medical Center dated June 16th' and stated that it had been recommended that this request be referred to the Planning Board for consideration and for public hearing thereon, it being so moved by Mr. Avery, seconded by Mr. Sundy and unanimously carrled. "t would like to request pe~mission ~0. opera.to a nursing home at: 646 SW 4th Avenue, De..lray Be.ach, Florida. The legal of this property is Lots # 13, 1~ & 15, Block # 1, Rosemont Park. "The use of this house as a nursing home would not include the care of alcoholics. "Thank you for.your consideration in this matter." The City Clerk read the following letter from Mr. William E. Blomgren of the Atlantic Realty Company, Fort Lauderdale, Florida, dated June 20, 1961: "As a follow-up to our discussions regarding the purchase of that part of the north 331~ m/1 of the south half of Lot 10, Block 1, Model Land Co,s. Map of Section 21-46-43 and lying. West of Southeast 5th Avenue, I would like to have you sub- mit to the Commissioners a definite proposal on our part to purchase this property for $35,000. We are prepared to pay cash and in view of the fact that we will have to be prepared to give up a considerable amount of this property for the. eventual right-of-way on Southeast 10th Street, I think that this is a fair price. -2- 6-R6-61 JUNE 26, 1961. "In addition to the foregoing I would like to have you read as a part of the record'.the proposal I made in my letter of May 8, 1'961, which also should be made a pa~t of this offer. "We have tried to c~nf-orm to the 'wishes of the City in regard to Working out a'.'~roposal in this connection, and may I add that we would like to have a definite answer and shall be happy to send a check as a binder on this offer as soon as the Commission has expressed it ts wishes as to whether or not they would be willin, g to accept this pPoposition as out- lined." It was moved by Mr. Sundy, seconded by ~. Avery and unanimously Carried that the purchase of this city owned property be denied. City Clerk Worthing informed the Council that application has been received by the Building Inspector to move the Ritter house from Lots 22 & 23, Block 73 to Lots ~11 & 12, Block 4, Del Ida Park, approv- al of which is recommended by the Building Inspector who has received no objections to such proposed relocation. It was moved by Mr. Avery that the request be granted. The motion was seconded by Mr. Sundy and carried unanimously. The City Clerk informed.'the Council that application has been received to move the Fitzgerald house from Lot4-5, Haller Grootman to Lot 34, Lincoln Park, approval of which is recommended by the Building Inspector who has received no objections to such proposed relocation. It was moved by Mr. Aver,j, seconded by' Mr: Thayer and unanimously carried that said request be granted. Col. Ellis F. Altman, Director of the Civil Defense of Palm Beach County was invited by Mayor Warren to give a resume of ~the Civil De- fense Program and what it means to Del~ay Beach which follows: "I had the pleasure to appear before your City Council at a recent meeting with reference to Civil Defense and I was com- plete~7 pleased with the..~reception I got and the method and the way they received me.' It was very apparent that they are going to do something about Civil Defense in you~ City. I presented them with a Resolution which is a normal Resolution of all cities in the State to adopt. It is a law in the State of Florida and they assu~ed me of their cooperation and the appointment of a Civil Defense Director here. As soon as I get such a director from this City Council I will work with . your City Director and help establish an agency here. "We have a very complete Civil Defense set-up in Palm Beach County. We have thirty eight incorporated communities lake De]may Beach, each with it ls own organization, and in case of emergencies you can see with the thirty eight of us,with all of our resources,we are able to do a great deal of good. We have perfect communications throughout the county. I passed out quite a few of these hurricane warning issues showing you eu~ communication network and what we are responsible to do. I have more of these issues for the ones who did not get them. There are about eight hundred fifty beds in all the hospitals in Palm Beach County and in addition to ou~ communications set- up I have packaged hospitals, government hospitals, on hand each of two hundred be~' capacity fully eqUipped to the latest degree. There is no e~uipment in the Good Samaritan or St. Mary's Hospitals any more modern tha$ what the Government furnishes us in these hospitals, completely packaged, completely equipped for two hundred beds. I have five of these hospitals in a radius' of forty miles and can set up one thousand beds here or anywhere else where needed. In addition to that we are also (thanks to ou~ County Commission, Ben Sundy is 100% behind our Civil Defense Program) protecting your records. We are going back to 1909 when this county was first .organized and are microfilming all the records in the coumt house, in duplicate, storing a duplicate set six hundred miles from here in another county which is a non target county. That is a great step because it will protect you~ records if something happens to ~hat cou~t house like happened to me when -3- 6-26-61 .... JlYNE 26, 1961. I tried to get my Social Security some seven years ago. I found that the little town in Georgia where I was bo~n that the court house had been wrecked and it took me about eight months to prove to the Social Security group that I was born. That could happen to any of you in case your records are lost, so we are protecting your records. "Another thing we are doing through your County Commission too, is your continuity~ of government. Now, Just like you mentioned a few minutes ago where your group in your Board of Adjustment, giving your alternates in'case one steps out. We are doing that with county officials and the Judiciary, in depth of two. Government must go on...' If something happened and the present County Commissioners were wiped out or the Judges were incapaci- tated through an act of war it would be chaos if you didntt have _ government. We are appointing alternates to take their place. Those men selected are going to take the oath of office, the Governor will administer the oath, ready to take office in case something happens. They can take office only in the event of a nuclear attack or act of war, not through normal channels . because we have our regular elections to take care of normal affairs, but in case of an attack of any sort we won't have time for that, therefore we have what we call our continuity of government which took effect by law January first of this year, which has been solely through Civil Defense efforts. "We have all the resources in this county, personnel and equipment, law enforcement officers, fire equipment ready to go anywhere where needed and there is where your city comes in, in case of need. If you need law enforcement officers here, regardless of how many, we will get them to you; fire equipment, we will get it to you; Doctors and nurses, thatls my Job and we will see that you get it. "The steps that your City Council is taking by organizing a Civil Defense Organization and Council is the first step. The second step is the appointment of a director. Under the law of the ~tate of Florida, your City COuncil here with the Mayor is responsible to your town for safety in case of an emergency. Civil Defense is Just civil law, that ls all it is. It's Law, and itls the normal function that you would do anyway in case there was no Civil Defense. The city would clear your streets and do all it could, but with Civil Defense we merely augment that by giving you mutual aid from all of the county and from any other county or any Other state in the event you need it. I want to thank the City Council for the stand you have taken and if I can be of any service to your Director in setting it up I will be very happy to do so. "Concerning hurricanes, we had a meeting this afternoon and we had the law enforcement officers, the weather bureau, all the news media, all of the agents of the Red Cross and we perfected our plans. You will notice in the pamphlet I gave out here to- _ night, on the next to back page, our communication set-up be- tween all the services. Your Red Cross is responsible for clothing, housing, feeding and rehabilitation during the hurri- cane. Civil Defense, all of its resources that I have in thio county, are at the beck and call of Red Cross when they need it. The two disaster committees work very closely together, conse- quently everything we have is available to the Red Cross. "In case of a National emergency, a nuclear attack or .any war attack, the Red Cross becomes part of Oivil Defense and they do the same thing for Civil Defense that they ordinarily would do in case of a normal disaster, the difference being that Red Cross is a private organization with private funds. When I am called into the picture it is Federal funds for everything and we take over and operate them in the same capacity that they normally would do in case of a normal disaster like a hurri- cane, so~ the two disaster committees in the event of a hurri- cane work very, very closely together. You wouldnft know one from the other because when a thing does happen we are ready. The last one, Donna, we alerted all the towns in the county. -4- 6'26-61 "I believe, Mayor, you were here at that time. We alerted Delray and all the personnel in your departments. Fire, Police and Public Works .stayed on the Job, on the' alert, and they were ready, and we were all ready and could have done a lot of good had it hit, but thank goodness it passed us by. '!We are watching the tides very closely this year. There is . a lot of land here, a lot of land you people own. You do not know yourself your contour elevation level. We are mapping that and will be able to tell you the contour elevation of your land. If we tell you to expect a six foot tide, from the weather bureau,' and your land elevation is five feet, then we advise you and will advise you over radio and T. V. to get to higher ground. When that alert comes in you will find all your radio and T. V. stations carrying it and you will look for that. In the meanwhile we are going to try to tell you individually where you live what your land elevation is. We are going to mark it in the areas, so if we do have high tides and it may be advisable for you to come over to the main- land we will advise you to do so. In case of a disaster of a bomb which we camuot foresee nor can we overlook, when we get that alex~t that chap in Colorado Springs, Colorado, which is the alerting point for the United States Air Force, picks up his phone and without ringing is automatically connected to the fifty states, Jacksonville is our warning point in Florida, and he gives the alert. Jacksonville then picks up his phone without ringing and the seven warning points in Florida, of which ~we are one, get the alert. In less than a minute the entire .United States is alerted. That's fast-. The next question is how to get it to you. The first thing I do is close down all the T. V. and radio stations, put them off the air, no commercials, no news and we broadcast and televise the Civil Defense Alert. It is commonly called CONELRAD..We have no CONELRAD station nearer than Miami, also one in JackSOnville and in Tampa and one other in the state, but we will get it to you over any station that you have a radio or T. V. tuned to. We are now putting a little gadget on the market that you plug in on your baseboard or your plug in the room and when we throw the switch on the alert you will get a shrill whine that will tell you to get on your radio or T. V. and listen for signals and we will stay on the air and give you the correct informa- tion as long as it comes through until the emergency is over. That has been a very good step because up to maybe three months ago you would listen' to radio and T. V. and all of a sudden the announcement came that they were going off the air on a Civil Defense Alert. That was a test, and we are going to do Just . that to keep you people informed accurately of what is happen- ing. Ail that will come through your Civil Defense Director here and whoever he is we will post him right up to the minute on everything that he is supposed to do so that you will be properly informed." City Clerk Worthing then read RE~OLUTION NO. 1334. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ESTABLISHING AND ORGANIZING A MUNICIPAL CIVIL DEFENSE COUNCIL FOR SAID CITY IN ACCORDANCE WITH CHAPTER 268?5, GENERAL LAWS OF FLORIDA, ACTS 0~ 1951. WHEREAS, It has been found and determined by the City Council of the City of Del~ay Beach, Florida, that public welfare and necessity demand that a local organization for civil defense be formed; and WHEREAS, Chapter 268?5, General .Laws of Florida, Acts of 1951, authorizes the governing body of municipalities in the State of Florida to constitute themselves as a local Civil Defense Council; NOW, THEREFORE BE IT AND IT IS HEREBY RE~OLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA: -5- 6.26-61 JUNE 26, 1961. Section 1. There is hereby authorized and established a Civil Defense Council for the City of Delray Beach; said ~Council ahalI be known as the DELRAY BEACH CIVIL DEFENSE COUNCIL and its membership shall be composed of the members of the City Council of such city. Section 2. The "said DELRAY BEACH CIVIL DEFENSE COUNCIL shall be and is. hereby empowered to do all such things as it shall deem ne- cessary to the promotion of civil defense in said city and which are authorized by Chapter 268?5, General Laws of Florida, Acts of 1951, with. regard to municipal civil defense councils. Section 3. There shall be appointed a Director of the DELRAY BEACH CIVIL DEFENSE COUNCIL who shall be subject to the over-all supervision and direction of such Council. PASSED AND ADOPTED this 26th day of June, 1961. Mayor Warren announced that there would possibly be a civil defense office established in the old city hall building where people can get more information concerning all these things mentioned by Col. Altman and a director will be appointed by next council meeting. It was moved by Mr. ThaYer,. seconded by Mr. Avery and unanimously carried that Resolution No. 1334 be passed and adopted. Resolution No. 1333 provides for levying the costs incurred in the abatement of .nuisances on various lots within the City which were not voluntarily cleared during the period of time for Uoluntary abatement of alleged nuisances in compliance with. Code of Ordinance requirements was read by City Clerk Worthing. RESOLUTION NO. 1333. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ASSESSING COSTS FOR ABATING NUISANCES UPON CERTAIN LANDS LOCATED WITHIN SAID CITY: SETTING OUT ACTUAL COSTS INCURRED BY SAID CITY TO ACCOMPLISH SUCH ABATEMENT AND LEVYING THE COST OF SUCH ABATEMENT OF SAID NUISANCES, AND DE- CLARING SAID LEVY TO BE A LIEN UPON SAID PROPERTY IN AN AMOUNT AS SHOWN BY REPORT OF THE CITY MANAGER OF DELRAY BEACH, FLORIDA. It was moved by Mr. Sundy, seconded by Mr. Thayer and unanimously carried that Resolution No. 1333 be passed and adopted. City 01erk Worthing read the caption of 0BDINANCE No. G-399. AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING CERTAIN LANDS HEREINAFTER - DESCRIBED AND BEING IN SECTION 8, TOWNSHIP 46 SOUTH, RANGE [~3 EAST. It was moved by Mr. Thayer, seconded by Mr. Avery and unanimously carried that Ordinance No. G-399 be placed on first reading. Mayor Warren expressed thanks to the owner of this land, the Lake Ida Development Corporation, for their outstanding cooperation in this matter of voluntary annexation. Mayor Warren asked Councilman Thayer who is Chairman of the Annex- ation Committee to comment concerning same which is as follows: "Ladies and Gentlemen: I am going to talk to you for a few minutes about some proposed annexation of properties to the City of Delray Beach. I know for a fact that, generally speaking, the voters and property owners of Delray Beach, will approve, for the most part, in such annexations. And I also know that there are people, who live on the edges of this city who will be glad to become taxpayers. And, of course, there are some, who enjoy all of the privileges of a Delray Beach -6- 6-26-61 JUNE 26, 1961. "address, who do not want the financial responsibilXty of either · voting in its problems, participating in its affairs, or to help Carry the load and privilege of being, in the true senses, a mem- ber of the De]may Beach community. "And so, I say tGR~..~TINGB~ ~o all of you, be you now a resident, 'be you one of those who are willing to be, or be. you one who does not wish to be~ "Several months ago, the Mayor and the other members of the Oity Council felt that the geographical shape of De]may Beach was dangerously small and limited. They found out also, that the City is, in shape and general conformity, pretty much chopped up. The City did not decide to grab up all available lands in its environs, but ~a-'~er, to gradually acquire a community which it could serve and which logically, geographically and otherwise, should be a part of the Delray Beach Community. "I think that you will agree, that the modest start originating tonight with the first reading of ordinances is for the good of the community which you use as an address and is for your gener- al benefit, be you now a resident or otherwise. "First of all, let me point out this: To-night there will be some first readings of ordinances of annexation. Well before th~'2nd reading $f these ordinances, which will come two weeks from now, each property scheduled to be annexed will receive notice by certified mail, and, with that notice will come a letter from me as chairman of the annexation committee - which I shall read to you in a moment. "But perhaps I should read that letter now as it pretty much explains the reasons for what the City plans to do - and the advantages gained by those scheduled for annexation. "Dear Property Owner.' "Wouldn't it be nice to REALLY be a resident of Delray Beach? "You probably now list your property as a'part of this fine community. You may even consider yourself to be living in it, and may well be proud to be a resident of it. But, at the moment, you arentt really a part of it. "So this is a friendly but official notice that it is the intent of the City to annex your property as shown on the attached map. We hope that you will welcome our proposal. "If your property is annexed, you will benefit by the ex- tension of all convenient city services: police protection, fire protection, road construction, and all the other ad- vantages which a city offers. And it is our pledge that the extensions of services will be made as soon as practicable. "You now profit by many other City advantages. You use the streets. You patronize the stores. You enjoy the beach, the parks, the Community Center, the other cultural facili- ties. But can you, in a spirit of fair play, say that you · are paying your fair share toward all of this? "There is no question that you will, if annexed, pay some City taxes which you do not now pay. But, do consider the advantages offsetting these. "You will, for instance, benefit from reduced fire insurance premiums that will go'a .long..way toward paying the tax in- crease. The value of your property will be increased. And, you will have a voice, through your vote, in the affairs cf this your commrnity. "Eventually you will be annexed by someone. Property on the East Coast of Florida is far too valuable to remain unincor- porated for long. Palm Beach County is filling up very rapidly. "Let me say at this point, that; following this rather brief speech of mine, there may be several questions you may have which may require meticulous and exact answers as to procedure or technical details. In such case I shall call upon either Tax Assessor Worthing or our City Attorney to answer such questions. "But first, let,s take a look at the map of Delray Beach as ~'~ is to-day. I shall try to point out to you what the Council and the Annexation Committee feel are gross inequalities. "I regret, of course, that some stories have been published which would indicate that a group has been formed to protest all annexations. To me, this is very strange, since it is hard to figure how any g~oup could be formed to protest par- ticipating in a city which benefits them or, could form an overall policy of condemnation when it does not know what is scheduled for annexation. "In any event, Ladies and Gentlemen, first readings of pro- posed annexation will be held to-night on what I consider a sound and modest scale. Two weeks from to-night the second reading will be held. At that time, when those who are scheduled for annexation and who may object to it, there will be opportunity for objection. "However, it is rather difficult for me to believe that those who have a Delray Beach address, are not willing to be a real part of it, in privilege and in voting. "The County of Palm Beach is shrinking - as to open spaces, rapidly. Soon, very soon, wherever you live in this county will be identified with some township. "It is not easy, to ~o.t belong to some municipality. Or' rather, it won!t be easy. "Why not be a true resident o£ Delray Beach which does really serve you and is proud to do . "In a rapidly shrinking county I truly believe that those who live in and enjoy Delray Beach ~should be willing - and most of the people, I believe, are willing te be, in fact, a part of this fast-growing and forw'"'ard looking municipa-~." That assessments in the individual amounts as shown by the report of the City Manager of the City of Delray Beach, involving the City's cost of abating the aforesaid nuisances upon the lots or parcels of land described in said report, a copy of which is at- tached hereto and made a part hereof, are levied against the parcels of land described on said report and in the amounts indicated there- on. Said assessments so levied shall be a lien from this date upon the respective lots and parcels of land described in said report, of the same nature and to the same extent as the lien for general city taxes and shall be collectible in the same manner and with the same penalties and under the same provisions as to sale end foreclosure as city taxes are collectible. 2.
