07-24-61 JULY 2J$, 1961. A regula~ meeting ~f the City Council cf Delray Beach was held in the Council Chambers at 8:00 P.M., with Mayor George V. Warren in the Chair, City Manager George Mingle and Councilmen A1 ¢. Avery, Dugal G. Campbell, Glenn B. tundy and John A. Thayer being present. An opening prayer was delivered by the Rev. Paul Smith. On motion by N~. Campbell amd seconded by Mr. Sundy the minutes of ~uly 10th Council meeting were unanimously aPl~oved. Mayor Warren read the following Beautification Committee Meeting ~.~.utes dated 2~ly Z0th, 1961: "New members of the committee are N~s. C~ Weldon Evaul, Chaix-man of the President,s Parley of Delray Beach-Federated Garden Clubs and C. C. Gali~at, President of the Ments Garden Club, succeed- ing Mr. Ed ~chmidt who has resigned. "The minutes of the last meeting were approved. "Discussion of accepting palm trees from donors for use on the beach resulted in a decision to accept palms but wait until later in the year for moving these trees to the beach. "A letter from the Board of Realtors was read agreeing to underwrite the cost of installing a flag pole in the northern landscaped triangle approach to the city with the American Legion providing a flag and the V.F.~/. to provide pole and flag on the south entrance. Mr. Toth was given authority to look into poa~t~en and cement bases of flag poles and the recommended heighth of poles to be installed. "Still to be finished is the sprinkling system at the north approach. Mayor Warren agreed to look into the matter and immediate action will be taken." Mayor Warren suggested that Mrs. C. Weldon Evaul and C. C. Galinat be offic~tally appointed to the Beautification Committee, it being so moved by Mr. Avery, seconded by Mr. Thayer and unanimously carried. Concerning accepting palm tree donations fo~ use on the beach, Mr. Campbell moved that the City Engineer and Joe Sante together with a committee from the Beautification Committee, that committee to be appointed by the Chairman of said committee, study the need for im- proving the beach, not only regarding trees but also the grass, steps, etc., of the whole beach. The motion was seconded by Mr. Avery and ca~ried unanimous ly. Upon question, City Manager Mingle reported that he had not checked into the progress of the sprinkler system at the north ap- proach to the City. Mayor Warren also read the Beautification Committee Meeting Minutes of June 29th, 1961.. The following letter signed by David L. Tyson and dated ~uly Zlst was read by Mayor Warren: "The Delray Beach Golden Anniversary, Inc., a non-profit organization, would like to request that the City of Delray Beach, Florida, underwrite the 50th anniversary celebration, .'.~ which would amount to an advance of $6,000.00. "Would you be good enough to place this on the agenda for the next Council meeting on Monday, July ~th, 1961. Thank you." 7-2J~-61 246 JULY 2~, 1961. " Discussion followed regarding trying to get the Chamber of Commerce to take this over and iS was planned that the Council and Chamber of Commerce meet at 8:30 next Thrusday morning to discuss this. City Manager Mingle reported that following Council instructions he had gotten estimates of cost concerning raising of the press box, but since there are other projects in the Council room to be taken care of was waiting for further Council instruction. Ooncerning a letter from Joint Cooperative Council of Palm Beach County Freight Rate Advisory Committee asking for a $1,000.00 donation for the 1961-~-62 fiscal year, Mayor Warren asked for a report of other Cities and their participation in same. O0 Delray Beach 1,000.00 1,000.00 Boca Raton none 1,000.00 Lant aha none 500. O0 It was moved by Mr. Sundy that this item be referred to the City Manager for consideration in the new budget. The motion was seconded by Mr. Avery and carried unanimously. On July 10th the Council authorized a public hearing to be held tonight on the .application for Certificate of .Public Convenience and Necessity from Fred Jones of 118 N. W. 10th Avenue for the operation of a Taxicab service. Attorney Gene Moore, representing James Fashaw, Shadrick Fashaw, Freddie ~onroe, Mr. Claxton and Daniel P~ice, who at the present time hold taxicab licenses in the section of the city affected by said application, objected to granting of this Certificate of Public Convenience and Necessity, setting forth their objections as follows: "They feel that the particula~ area in question is adequately serviced by the six licensees that are presently operating out there and that the issuance of an additional certificate to operate a taxicab busi- ness would definitely be an economic detriment to them. Part of the individuals that are operating in that section at the present time are not actively operating all of their taxi fleets aS this particular time of the year, and in as much as the present licensees are not operating in full capacity they submit that that is evidence to the effect that there is no present necessity at this time for an addi- tional licensee, and they also feel that there would be no additional convenience to the sections to be affected and it would definitely be an economical detriment to them for additional competition to come in at this time. They feel that they are entitled to protection of this particular ordinance, also from the technical standpoint would ques- tion the sufficiency of the application that has been filed in this case, but of course if the Certificate of Necessity is denied I believe that would be a new question." Upon question it was reported that 11 cabs operated in that sec- tion during the season, and only ? are in operation at this time. Mr. Campbell asked that each of the six taxicab operatior filing this objection go on record as to whether or not they have used, in the past year, any cars over and beyond the 11 that they have licensed, and it was reported by' three operators of cabs that they used un- licensed automobiles as cabs during the season. During discussion, City Attorney Adams asked' if the applicant had been notified of this Public Hearing as well as the present taxicab operators and was advised by City Clerk ~orthing that he had been notified. City Attorney Adams further stated that this would be a decision that the Council would make of whether or not the applicant has al- leged facts showing that Public ConVenience and Necessity is warranted here, and that they could put the burden on the objectors or the applicant, but that they would first have to find that the Public Convenience and Necessity is there ~nd then they could go into the personal qualifications, and if those are satisfactory it would be alright to grant it. -2- JULY 2~, 1961. 1~. Thayer questioned, if the applicsnts personal qualifications were satisfactor-y was there any reason that the city would have for refusing a license? Campbell then asked Police Chief Croft if in his experience he has had unlicensed cams being used, and it was stated that as a result of a road block at the bridge one morning it was found that a number of unlicensed oars were being used. M~. Aver~ asked the Police Chief if, in his opinion, he feels there is further use for taxicabs in this particular area, and was infold that they werentt needed at this time but quite possibly would be during the season. Mr. Campbell moved that the permit to Mr. Jones be granted based on the information that has Just been received from the Police Chief, ~md also to the fact that four permits have been issued in good faith by the Council believing that they were to be used and by the ln- formation we have received tonight they are not being used. The motion was seconded by Mr. Avery. Attorney Gene Moore stated: "Could I get one point established for the record, that this particular finding is on the basis of some proposed necessity or anticipated necessity in the future and it is admitted that there is no necessity at this time. I'm not t~ying to restate the phrase." Mayor Warren: "I think it is what occurs in the season when a lot of station wagons are used as cabs without licenses, of which we are all very well aware, however I think the fact that licensed cabs are not being used now has no point because we are out of season and there would be no need for that many cabs." Attorney Moore: "I would like to submit that that is one of the strongest points for our case. I believe that there are licenses not being used now certainly wouldntt be any argument for the fact that additional licenses should be issued at this time. I would .also like the record to reflect that the applicant is not present here tonight to state any substantiating factors for his case and also that we object to the legality of the application as filed. There is no ex- perience set forth in the application as required by the Ordinance 26-6, there is no financial background set forth as specifically required by 26-6 and we would object to this among othe~ ~hings as to the legal sufficiency of this particular applicant,s application meet- ing the requirements of your ordinance. We would point out too that the particular 26-5 of your Ordinance, we submit, does definitely require that there be an absolute finding of Public Necessity and Convenience before an additional license is issued." Mr. Avery asked for a ruling from the Attorney on these state- ments and City Attorney Adams replied. "I haventt seen the appli- ,~ation but the 26-6 does set out that it is also to contain the ex- :oerience of the applicant in transportation of passengers; the number of vehicles to be operated controlled by .~he' applicant; color scheme or insignia to be used. Now I don't know if this application fails to have those in' it or not because I have .not swen the' applica- -"~'tton." M~. Avery: "Mr' Mayor, in view of the fact that it doesntt seem that this applicant has been property investigated as to his experi- ence, financial stability and all' I would like the chair to rule on ..~hether I can withdraw my second to the motion." Mr. Campbell: "Why not table the matter and get this information." Mr. Avery: "I'll go along with that. I~ll withdraw my second if you will withdraw the motion." M~. Campbell: "Let the motion stand but move that it be tabled until the next meeting. I accept the act of tabeling, but the motion itself stands." The amended motion was seconded by .~. Thayer and carried unani- SO. Sly, City :Clerk Worthing reviewed a report of alleged nuisances exist- ~ ~n violation of Ordi~nce No. G-I~? furnished the City ~anager by the Fire Department. It was moved by Mr. Sundy, seconded by Mr. ~ampbell and unan~mous!y carried to direct the City Clerk to comply with Or~inance No. G-388 as appllcable to this nuisance survey report. (Copy of list of nuisance violations is attached to and made a part of the official copy of these minutes.)Pages ~5~-A thru 2~-G. -3- 7- -61 JULY 24, 1961. Hrs. Ham~-y Brook complained about a nuisance violation in their vicinity and Mayor Wam~en informed her that it would be taken care of. City Clerk Worthing informed the the Council that Mm. Paul Enowlea, on behalf of the Beautification Committee, has obtained the endorsement and the c~peration of the P. EJ C. Railway Company for permission to beautify portions of it's R/W within the city. The Beautification Committee desires to beautify twelve specific areas listed in a report which they have Submitted plus the South Swinton Avenue and Dixie crossing and requests Council approval for such an improvement program at such time as determined'by the Beautification Committee to be undertaken. Hr. Worthing further stated that the reason for 'Council action regarding the twelve pieces of F. E. C. Railway property is that the Railway Company prepares the instruments which will permit tB~ City to beautify itts R/W. It was moved by ~r. Campbell that necessary action and authority be given. The motion was seconded by Mr. Sundy and carried unanimously. I~. Harry Brock complained of conditions existing at the property next to their residence, which condition he had complained of previ- ously and 'said property has been inspected by members of the Council and City officials. City Manager Mingle reported as follows on the different conditions that had been complained of: 1. That the Director of Public Works would have some trash removed that had been lying in front of the property. 2. Some g~owth on the City Street R/W would be taken care of by the Director of Public Works. 3. Regarding the growth around the house and the leaves, etc. the owner gave the assurance that within a two weeks period he would have that condition corrected. 4. Regarding the mangos that had fallen on the ground, it was pointed out to Mr. Brock that the city had no Jurisdiction or authori' ty in this matter as it was a public health matter and the County would have to take action on that. 5. Regarding the storage of certain materials or equipment in th~ house on this property, it was explained to Mr. Brock that the City had no Jurisdiction or authority over equipment inside the premises of the house. Following further complaints by Mr. Brock, Mr. Avery took excep- tion to the specific accusation of Mr. Brock and denied that his affiliation with the Trieste Construction Company had any bearing on his action as a Councilman. City Clerk Worthing informed the Council that a letter has been received from the developers of Tropic Isle S/D requesting abandon- ment and proposed re-platting of an area in Tropic Isle Subdivision. It Was moved by Mr. Thayer that this matter be referred to the City Attorney for his investigation and report at the next meeting re- garding the legality and the cityls position in ~the matter. The motion was seconded by M~r. Sundy and carried unanimously. City Clerk Worthing presented the following bids that had been received for a tractor-type bulldozer for the Water Department, all of the bids reflecting a trade-in allowance for a 1953 Terratrac, and stated that it is recommended that awsmd of purchase be made to the low qualified bidder: Llewellyn Machinery Company $4,982.0O' Trail Construction Equipment Company 5,350.00 Florida-Georgia Trac tot Company 5,974.00 It was moved by Mr. Sundy, seconded by ~ir. Avery and unanimously carried that the bid be awarded to the low qualified bidder. Regarding needed drainage in North Tropic Isle, City Clerk Worthing informed the Oouncil that authorization may be requested directing the City Manager to provide plans, specifications and estimated cost of same as well as providing for solicitation of bids for storm drainage facilities which were omitted by the de- veloper at the time of developmmnt, it being so moved by Mr. Thayer, subject to the City Attorney ts approval and to hold up further money if necessary, the motion being seconded by Hr. City Clerk Worthf~ng fr~o~med the Council that the frelimina~y Plat for Bellehaven S/D had been previously approved by the Planning/ Zoning Board and the Council and at this time approval is requested for the Final .Plat of Bellehal~en S/D - Unit "B" which lies between S. W. 3rd and 4th Streets and 10th & llth Avenues, this Final Plat having been approved by ~he Director of Public Works and is in full conformity with Chapter 23A, Section 23A-4' Para. (?) (a) of the Code of Ordinances. It was moved by M~. Campbell to approve said final plat, the motion being seconded by M~. Sundy and unanimously carried. City Clerk Worthing read the following letter from M~. O. F. Youngblood dated July 14th: "Since Mrs. Natelle Bush has not attended any of the Inter- Racial meetings, and having stated she would rather you get some one in her place, we thought we would recommend Mrs. Florence Barnes who is a very active citizen of the community and we feel she will reflect credit to the Inter-Racial Council. Her address is 1335 N. W. 3rd Street, Telephone 8-2226." ,., It was moved b2 Mr. Avery that/the resignation of Mrs. Bush be accept- ed with regret and that Mrs. Florence Barnes be appointed in her place. The motion was seconded by Mr. Thayer and carried unanimously. Regarding a request of Mr. M. F. Riley, Jr. for extension of time regarding abatement of nuisance, Mr. Riley is a Joint owner of an irregular parcel of land running southward from W. Atlantic Avenue adjacent to, and to the east of, 'State Road 9 for a distance of 600 feet. Not having survey markers, or not knowing the exact locations of his lands, Mr. Riley requests only a delay in the abating of the nuisance on his land owing to the veget, ation growth in excess of limits of such as set forth in Chapter 15 of the Code of Ordinances, until such time as State Road 9 becomes cleared of similar nuisances, the abatement of which nuisances on State Road 9 property having been assu~ed by Palm Beach County Commission and will be done in the near future as soon as State Road Department equipment is available. It was moved by Mr. Campbell that this matter be tabled unitl the next meeting, the.motion being seconded by Mr. Sundy and unani- mously carried. A petition for sidewalk improvement on the South side of S. W. 1st Street between 3rd and 4th Avenues and the West side of S. W. 3rd Avenue between 1st and 2nd Streets was presented, signed by property owners in Block 38 who represent 71% of the lands fronting on the strip desired to be improved, which lands will share the cost if such improvement is made. It was moved by Mr. Thayer that the .. City Manager be directed to prepare plans, specifications and esti- mated cost for this Job for submission at the next meeting of the Council. The motion was seconded by Mr. Sundy and carried unanimously. City Clerk Worthing read the following letter from William F. Koch, Jr., dated July 17th: "Pursuant to our phone conversation of this morning, I sm formally requesting from the City of Delray Beach the follow- ing information: "Would the City supply water to the 50 acres, more or less, located in Section 4, Township 46 South, Range 43 East, lying west of the Intra-coastal Watex-~ay in the Town of Gulfstream, Florida, for the RCR Co~poration and the RBR Corporation sub- division, and under what conditions would the City supply water. "I have already received the approximate cost to bring City water to the subdivision which amounts to about 416,700.00. "If and when the above subdivision would go into the City of Delray Beach, would it be possible to recapture the cost of the water mains out of water revenue. It was moved by M~. Sundy that the referendum, regard- ing the election of Mayor, be held the first ~uesday in October. The motion was seconded by Mr.. Avery and carried unanimously. Regarding Annexation, Mayor Warren asked that a coherent, advise- fy, straw ballot be put on the referendum the first Tuesday in October, asking the people within the City of Delray Beach whether this Coun- cil should continue w~th their program of Annexation to the bounda-~. ties of Boynton Beach on the North and Boca Raton on the South and have the visible support of the people within the City of Delray Beach. Mr. Avery moved that a straw vote be held the first Tuesday in October, at the same time the referendum is held, giving the people of Delray Beach an opportunity to express an opinion as to how they feel about the future action of this Council on Annexation by ac- clamation. Mayor Warren relinquished the chair and seconded the motion. Following lengthy discussion and comments and upon call of roll, Mr. Avery and Mayor Warren voted in favor of the motion, Mr. Campbell, Mr. Thayer and Mr. Sundy opposed. The motion did not carry. City Manager Mingle presented bills for approval as follows: General Fund $ 136,692.19 Water Fund - Operating Fund ..23,872.15 Special Assessment Fund 100,072.22 Refundable Deposits Fund 3,807.01 Improvement Fund 21,760.88 It was moved by Mr. Campbell, seconded by Mr. Thayer and unanimously carried that the bills be paid. Mr. Campbell called attention to a Resolution presented by Attorney Nail MacMillan in behalf of the Palm Beach County Taxpayers League, Inc. at the July 10th Council meeting, in which a statement was made that the city charges those outside of the city using the city water twice the city rate, but that is not a fact as they only pay 25% above the city rates, and have for some time. Mr. Campbell moved that the City Manager be directed to address a letter to Mr. Abberger giving him the rates that are charged within and without the city on water. The motion was seconded by Mr. Thayer and carried unanimously. City Clerk Worthing reminded the Council that on July 10th they had asked City Manager to contact Mrs. Grace Weirts attorney regard- ing an alleged nuisance violation on her proDerty and informed the Council that Mrs. Waif's attorney is not in Delray Beach at this time but after inspection of the property on North Swinton .Avenue and N. W. 4th Street, it had been determined that Ordinance No. G-390 con- · cerning vision at intersectmons is being applied to this corner and other corners of equally hazardous conditions~ which provides for notification of a five day period of time allowing the property owner to eliminate the violation of that ordinance or the city will abate the nuisance, and that this property will be handled in such The meeting adjourned at ~0:18 P.M.
