Upon call of roll, Mr. Avery'Mr. 8undy and Mayor Warren voted in favor of the motion and Mr. Campbell abstained from voting. In compliance with Charter requirements, the proposed budget for the coming fiscal yeam. has been published in condensed form and sched- uled a public beaming to be held at this time on said budget. Chamber of Commerce Manager Xenneth Ellingsworth stated that the Chamber of C~mmerce has requested that the City, in past years, es- tablish an advertising and publicity budget, and'this yeem it is in the amount of $20,500.00. Mr. Ellingsworth then'gave a short report on the use of last yearls funds and what was intended for the use of this years request if the Council approves it. Mm. Arthu~ J. Michael questioned a couple of items in the Fire- mens budget and explanations were madeconcerning same. RalphPrieSmeyer, P~esident of the Chamber of Commerce, informed the Council that there a~e two items that the Chamber are particularly interested in because they embody the work in which they are engaged, one being the product that Delmay Beach has to sell to newcomers and visitors of the community and the other is the means of selling that product. He further stated that he felt a fine step of progress had been made Jointly by the City and Chamber in establishing a City Beautification Committee and feels that it is essential that ample funds be provided for the maintenance of the vamious beautification projects &also hopes that the Council will approve the well planned advertising and promotion budget of the Chamber. Mr. Spencer Pompey asked if there was anything in the budget concerning the construction of a new Corauunity Center inthe west sector and ,if not,would there be any consideration for same as was promised at a meeting with the Council recently. Mayor Warren in- formed himthat a request had been made for another meeting with the Naciremas Club of which he would be notified shortly and that he couldntt say at this time whether or not it is in the budget. City Clerk Worthing reviewed a report of alleged nuisances exist- ing in violation of Ordinance No. G-I~? furnished the City Manager by the Fire Depamtment. It was moved by Mr. Campbell, seconded by Mr. Sundy and unanimously Carried to direct .the City Clerk to comply with Ordinance No. G-388 as applicable to this. nuisance survey report. (Copy of list of nuisance violations is attached to and made a part of the official copy of these minutes.) (see pages 276-A thru 276-D) Mayor Warren introduced Captain James W. ahebs who will serve as the Delray Beach Civil Defense Director from an office that has been provided in the PoliCe Building. It wasthen moved by Mr. Campbell to officially appoint Capt. Shebs as Civil Defense Director of De]may Beach. The motion was seconded by Mr. Sundy and Carried unanimously.. Concerning a request for extending water service to a fifty acre tract of land North of the City,. the. Council, at a previous meeting, requested study and~report from the City Engineer,'said report being ~s follows: "Subject: Water Main Extension to Subdivision in Section ~-46-~3, West of-Intracoastal Waterway, Town of Gulfstream, Florida. "Water connection to the subject subdivision' as requested by Mm. Bill Koch, was discussed 'by the Council at their regular meeting of ~uly 234, 1961. Smith approximately $15,000.00. "On page 6, Paragraph 22 of the present lease M~. Smith now has with the City he has been granted an option of renewing said lease for a term of five years, and there- after given a further option of renewing for an additional term of five years. Mr. Smith feels that in order to realize a profit from the contemplated capital outlay he should be granted an option to renew at the e~pirati0n of the present lease period for a period of ten years, and thereafter a subsequent renewal of five years. "Mr. Smith informed me that he has discussed this matter with Mr. Worthing and Mr. Sundy and I suggest that you take the matter up with these gentlemen if you have any questions. "Kindly contact me or Mr. Smith as soon as you have had an opportunity to consider Mr. Smith's request. "Naturally Mr. Smith would like to begin construction as soon as possible so that the new facilities may be com- pleted prior to November 15th." It was moved by Mr. Sundy that this matter be referred to the Planning/Zoning Board and that it also be checked by the City Attorney. The motion was seconded by Mr. Campbell and carried unanimously. Concerning a detailed report from Mr. Paul S. Enowles concerning abatement of nuisances Mayor Warren appointed the following committee to make a study of this proposed plan of nuisance abatement: Mayor Warren, Chairman Councilman Campbell City Engineer Fleming Paul S. Knowles Regarding the Junior Chamber of Co~erce request that the City lease them a parcel of land on South Swinton Avenue for the purpose of erecting a Club House at such time as the necessary funds are available, City Clerk Worthing informed the Council that the Planning Board recommends that any such lease should be of short 'term with options for renewal and subject to any building to be located thereon be of movable nature similar to the Chamber of Commerce Building. The City Clerk further informed the Comncil that should it be their pleasure to grant this request and location, such action should be ~' with the understanding that at such time as the Junior Chamber be- comes financially able to locate thereon that a public hearing will be necessary to provide the property owners in the general area the opportunity of expressing approval or disapproval of such proposed use of the land prior to permit being issued. It was moved by Mr. Sundy, 'seconded by Mr, Avery and' unanimously carried that a letter be w~itten to the Junior Chamber of Commerce in- forming them that the Council looks upon the location and idea with favor but there will be no final decision until they are better pre- pared financially to undertake this project. Also that they be in- f~med as to the suggested term of lease, kind of building and public hearing concerning the proposed use of land. Resolution No. 1338, expressing the intent of Council to con- struct a Sidewalk on S. W. 1st Street between 3rd and 4th Avenues, also on the west side of S. W. 3rd AVenue between 1st and 2nd Streets, was passed and adopted on August 14th and in c~ompliance with Charter requirements, said resolution has been advertised in full setting forth ~therein provision for public hearing thereon at this time. There being no objection to Resolution No. 1338, the following resolution was read. RESOLUTION NO. 1341. HIGHWAY NO. 1 AND SPANISH TRAIL IN NORTH TROPIC ISLE SUBDIVISION, DELRAY BEACH, FLORIDA. WliEREAS, the City Council has deemed it a matter of public safety and welfare to construct drainage facilities in that area between U. S. Highway No. i and Spanish Trail in North Tropic Isle SubdiVision, Del~ay Beach, Florida, the entire cost of such improve- ments to be borne by the developer of the aforesaid subdivision as agreed previously; - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Delray Beach, Florida, as follows: SECTION 1. City Clerk Worthing read ORDINANCE NO. G-410. AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTIONS 15=8 and 15-.9.~ CHAPTER 15, CODE 0F ORDINANCES OF THE CITY OF DELRAY BEACH PERTAINING TO EPFECTIVE DATE OF RESOLUTION LElrfING COSTS FOR THE ABATEMENT OF NUISANCE. On motion by Mr. Avery, seconded by Mr. Sundy and unanimously carried, Ordinance No. G-410 was placed on first reading. Concerning authority for paying on-call and off-duty firemen and policemen in case of emergencies, City Manager Mingle submitted a de- tailed report which reflected reference to Section 1~-14 of the Code of Ordinances and Chapter 7 of the 1946 Code, Section 17 and the es- tablished policy of 1938 concerning compensation to be paid for volun- teer or off-duty regular firemen. A copy of said detailed report is - on file with the official minutes of this meeting. Mm. Campbell moved that a committee from the Council be appoint- ed to study the entire operation of the Fire Department including re- vision of pay schedule. The motion was seconded by Mr. Sundy and carried unanimously. Mayor Warren then appointed the entire Council as said committee. Mr. Campbell, Chairman of the Comittee to study the sewer pro- Ject reported that said committee had met last Th~sday and as a re- sult of this meeting and study, Russell & Axon have prepared a Sewage Works Program Report which sets up a very definite plan with an over- all cost of $400,000.00 and will give the City a plant which will take care of the present users plus fou~ or five ~hundred additional connec- tions. The plant itself may be converted at a later date, with the assurance from the Engineers, for out-fall or continued as a plant with future expansion City Clerk Wcrthing then read RE~OLUTION NO. 1344. -6- 8-28-61 AUGUST 28, 1961. A P~O~ION OF THE CITY COUNCIL OF THE OITY OF DELRAY BEACH, FLORIDA, DECLARING THE INTENTION OF THIS CITY TO PROC~ WITH THE IMMEDIATE PRO- CRAM PROPOSED BY RUSSELL & ~Y. ON, CONSULTING ENGINEERS, IN A REPORT DATED A~G~T 1961, AS THE BASIC SEWAGE WORE$ PRO~RAM OF THE CITY OF DELRAY BEACH, FLORIDA. WHEREAS, it is deemed in the best interests of the City of Del~ay Beach, Florida, to immediately provide for more suitable sewage facilities, and WHEREAS, an engineering report, dated August, 1961, has been submitted by Russell & Axon, Consulting Engineers, which provides for an immediate program for an estimated total cost of $400,000.00, and WHE~S, said engineering fi~m has volunteered at no cost to the City to make the necessary revisions of the master Sewage Works Program in cruder that this basic program may become a part of the ultimate overall city-wid6 program, NOW, THEREFORE, BE IT RESOL~ by the City Council of the City of Delray Beach, Florida, as follows: 1.That the City of Delray Beach hereby intends to proceed with the immediate program proposed by Russell & Axon, Consulting Engineers, in a report dated August, 1961, as the basic sewage works program of the City of Delray Beach, Flortd a. 2.That an appropriate city official be authorized to apply to the House and Home Finance Agency for the necessary forms for securing a Federal loan under Public Law 560. 3. That the Engineering fLrm be authorized to proceed~with fu~nishing plans, specifications and estimated cost for a 500,000 gallon activated sludge type plant subject to the approval of the State Board of Health, the City Engineer and in accordance with te~ms and conditions of the omiginal con- t~act dated September 30th, 1959. E. 1st Avenue and 2nd Street on Which the neighbors have complained of a nuisance existing and upon investigation found that the lot had been cleared but that there .are two piles of trash that have not been moved to the street right-of-way, therefore the City is not in a position to remove them. Lengthy discussion followed but no action was taken. City Clerk Worthing brought to the attention of the Council the unexpired lease between the City an~ Milton J. Boone of the property that ia now being used as a city nursery, and to the conditions of annual rental fee and buildings placed thereon. Following discussion, Mr. Campbell moved that the City Attorney _ be asked to write a letter to Mr. Boone relieving him of the responsi- bility of the existing lease which expires March 23rd, 1963, that he be asked to leave the building on the premises and that his man live on the property as watchman and that he be given the use of the build- ing without rent during the period of tenancy, and to provide for waiving the $50.00 annual lease charge as of March 23, 1961 and re- cognize the fact that it is M~. Boonels building and can be moved at his request at a later date. The motion was seconded by M~. Sundy and carried unanimously. City Clerk Worthing read a letter from Mr. Arthur Dummett to A1 C. Avery dated August 26th regarding information, specifications and cost of construction of a Garbage Incinerator built in Bcarsdale, New York. City Clerk Worthing read the following letter to the City Man- .. agar from Mr. William H. Gantner: We wish to bring to your attention the condition of the road of Lewis Cove, Delray Beach, This road is nothing more than rock covered with oil and is a poor excuse for a city street. In the last year two new houses have been constructed on the street, from Which you will receive additional revenue. Our 1960 taxes to the city of Delray Beach were $480.00. After driving a~ound the southwest part of the city, where we own an apartment, and seeing all the new roads in that neighborhood, it seem~ to me that Lewis Cove deserves at least as good treatment as that district. Turning in to Lewis Cove from AIA you feel that you are driving down an alley instead of a street in Seagate Extension. We would like a personal inspection of this street, to see what can be done about having a new top put on it, so that the .lot lines can be defined and standing water be eliminated." City Manager Mingle reported that he had' received this letter today and that it had been replied to today and that said street would be inspected on the return of the City Engineer. It was suggested that since only l~alf of Lewis Cove lies within the city that the County Commission be contacted regarding improvement of same. The meeting adjourned at 9=40 P. M.
