09-07-61SpMtg 277 SEPTEMBER ?, 1961. A st~ecial meeting of the City Council of Delray Beach was held in the Council Chambers at ~:00 P.M., with Mayor George V. Warren in the Chair, City Attorney John Ross Adams, and Councilmen A1 C. Avery, Dugs1 G. Campbell, Glenn B. Sundy and John A. Thayer being'present. Mayor Warren called the meeting to order announcing that same had been called for the pttrpose of a possible conclusion to the employment of a City Manager. It was moved by Mr. Campbell and seconded by point Mr. Louis J. Smitzes as City Manager effective as of Septembsr 8. Mr. Avery asked if there had been any interviews held with other than Mr. Smitzes during the past sixteen months and was informed that there had not been. Mr. Avery further asked if any applications had come in for this Job since }ir. Mingle resigned end was informed that five applications had been received but none of these applicants had been interviewed. · he motion to appoint Mr. Louis J. Smitzes as City Manager car- ried unanimously. It was moved by Mr. Campbell that the City Manager's salary be $10,300.00 per year as established when the last appointment was made, effective as of tomorrow morning, September 8th. The motion was sec- onded by Mr. Sundy and carried unanimously. Mr. Avery stated that he felt it very important that the Council give Mr. Smitzes a very positive statement of policy as to what this Council expects. Mayor Warren read the following letter written to him by Mr. Mingle, dated August 18th: Mrs. Virginia Meyers, of 114 N. W. 6th Street (CR 6-!;;!65) called on me yesterday afternoon to discuss a series of meetings on government which the Service Committee of the League of Women Voters are planning to conduct. "The first meeting, to be on 'Municipal Governmentl, is slated for October 12th, to be held at the Commaunity Center from 10 a.m. to 12 noon. They would like members of Council to participate in this'program. "In order for them to set up their program, they would like a confirmation from the Council members, of their participa- tion." Mr. AVery expressed his willingness to participate. It was moved by Mr. Campbell to accept the invitation as a group. The motion was seconded by Mr. ~very and carried unanimously. City Clerk Worthing read the following letter from the State Board of Health, signed by David B. Lee and dated September 5th: "This date we have received a report of sewage works program for Delray Beach prepared by your consulting engineers, Russell & Axon. It is our understanding that this report was prepared in cooperation with the Sewer Committee of your city. "We have reviewed this report and in general it meets with our feeling of progress. As I stated to you when I appeared before your Commission, your city will grow4~and in the opin- ion of the Florida State Board of Health the size of the proposed plant is not commensurate with the need of your city. It is the responsibility of the Florida State Board of Health to advise you, your Commission and the people of Delray Beach of your needs from an environmental health standpoint as we see it based on our experience. 9-7-61 278 SEPTEMBER 7, 1961. "The report calls for a !/2 million gallons per day plant to serve approximately 1~00 connections, thus giving you only approximately 400 new connections; therefore in our opinion your plant could be overloaded by the time it is completed. It is our strong recommendation that you plan a minimmmplant of one million gallons per day which would give you approximately 2860 connections or serve a popula- tion of 10,000 people. This plant should be designed to be expanded in the years to come to a minimum of three times this population for the year 1970. Even if you had a plant of one million gallons per day at this time, you still could not serve the entire population of 2ou~ city which is somewhat over 12,000 people. Therefore, we think it is the responsibility of your Commission to provide adequate treatment facilities to clean up the pollution in the Int.e~coastal Waterway and provide facilities for added connections and expansive growth which your city will have. "We trust that your Commission will consider this progressive step and we will be pleased to work with you and your con- sulting engineers in the development of this program with the understanding that lust,her expansion will be necessary when indicated." It was moved by M~. Avery, seconded by Mr. Campbell and unani- mously carried that this letter be recognized and the Press be given a copy. Mr. Campbell stated that this suggested plan had not been arrived at hastily as there had been man, hours spent on this by the Council, the Committee and the Consulting Engineers, and although he has re- spect for Mm. Leers position and ability as an er~ineer would like for the Council to go on record to Mr. Lee that they wish to continue to build the 'plant that has been accepted by the Council as a whole, the plans of which he has seen, end would like to get started on that as soon as physically possible. Mr. Aver~y requested that the City Engineer be asked to review the report from Russell and Axon and the letter from M~. Lee and sit with the Council in consultation before the letter from Mr. Lee is an- swered. Following lengthy discussion, Mr. Campbell moved that the Mayor be authorized to answer the letter to Mr. Lee with the hopes that he would include the fact that this has been studied and believe that this is best for the City and that we are told it will be built in such a manner that the increase or improvements can be made at any time, and that we would like to go ahead with this situation now. The motion was seconded by }-~. Thayer and up°n call of roll, Mr. Campbell, ~.~. Sundy, Mr. Thayer and Mayer Warren voted in favor of the motion end ~. Avery abstained from voting. Since the City Engineer was on vacation recently and not present for some of the study, Mayor Warren asked that the Engineer review the minu.~es of August 28th regarding Council action as well as the Russell & Axon report and confer with him before said letter to Mm. Lee is written. City Clerk Worthing brought attention to the condition of the wall in the south end of the Council room and Architect Kenneth Jacobson reminded the Council that there is a one year guarantee on the build- ing and a twenty.year roofing bond. Mayor Warren asked that the entire Council, possibly tomorrow, visit the Community Center to look over the building and some of the existing conditions also that the City Engineer, contractor and archi- tect be asked to:be present.
