OCTOBER 30, 1961.
A special meeting of the City Council of Delray Beach was held
in the Council Chambers at 1:00 P.M., with Mayor George V. l~arren in
the Chair, City Manager Louis ~. Smitzes, City Attorney John Ross
Adams, and Councilmen A1 C. Avery, Dugal G. Campbell, Glenn B. Sundy
and John A. Thayer being present.
Mayor Warren called the meeting to order announcing that same
had been called for the purpose of approving an expenditure for pub-
lic advertisement concerning all pha~ea of the proposed ~ewage System
Project and scheduling a public hearing thereon to be held at the
Council Mooting of November 6th, and for any other business which may
come before the meeting.
Mr. Thayer stated that an advertisement had been prepared con-
taining questions and answers concerning the whole proposed sanitary
sewage project, and that all members of the Council had seen this pro.-
posed advertisement.
Mr. Thayer then moved that a sum, not to exceed $300.00 be au-
thorized for expense incurred in placing this advertisement with the
Del~ay Beach News-Journal for publication in the issue of Thursday,
November 2nd, 1961, the motion being seconded by Mr. Campbell.
Mr. Avery took exception to said advertisement in that he said
he feels it does not give both sides of the general picture to the
public.
~. Campbell stated, for the record: "It certainly was intended
to give all sides, as different questions have been asked and as to
whether or not it has been covered I would assume we would have to
leave that to the general public when they see the ad. We have
covered, certainly attempted to cover, the reasons why it seems ad-
visable at this time. We~ve discussed the overall plan and so on,
so let,s leave it to the public to be the Judge whether or not we
have covered it."
Mr. Thayer said that he planned to have reproductions of the
advertisement for members of the audience to look over at the public
hearing.
Upon call of roll on the previously stated motion, Mr. Campbell,
Mr. Sundy, Mr. Thayer and Mayor Warren voted in favor of the motion
and ~M. Avery was opposed.
Mr. Campbell questioned: "If we do not have what would prove to
be a reasonable breakdown of the number of lots and possible houses or
stores that have been built within the area covered by the .present
sewer lines, I would like to suggest that if, on a quick study made
by the City Manager and the City Attorney, it is found that we do not
have what would appea~ to be as complete a study as we should have
that the City Manager be authorized to move as quickly as possible to
bring that situation about. We ought to have as complete a breakdown
in that a~ea as is possible to have."
City Manager ~mitzes suggested contacting the consulting engineers
to see what degree of data they have and if it is not enough to get any
of the details to support any arguments or questions that migt/t arise
on the structure of the rate survey, then he would proceed further.
~. Campbell then moved, if it is found that there is not the in-
formation that has been briefly discussed, that the City Manager be
authorized to proceed in any manner that is found necessary to obtain
that information as quickly as possible, the motion being seconded by
Mr. Sundy.
The City Manager asked, for clarification. "Does that also mean
if it requires a team to go out and survey the area?"
~v. Campbell answered that it did, and that was the reason that
he made the motion for the City Manager being authorized to proceed in
any manner that is found necessary to give that information as quickly
as possible.
Upon call of roll Mr. Campbell, Mr. Sundy, Mr. Thayer and Mayor
Warren voted in favor of the motion, Mr. Avery being opposed.
Mr. Avery moved to include in the proposed a. dvertisement, the
question and answer as to why this Council chooses to move so fast on
this particular thing instead of letting the new Council take it up;
also the question and answer as to why the Council doesn't see fit to

let the people have all the facts and vote on this. This motion died
for the lack of a second.
Lengthy general discussion followed concerning the proposed over-
all sewage plant and program.
City Manager Smitzes brought to the attention of the Council a
request pertainir~ to the Boy Scout project and the $15,000.00 set
aside by the Council for construction of a Boy. Scout Building.
City Clerk Wor..thing stated that on June 27th, 1960 the proceeding
Council authorized $10,000.00 fo~ this project and on March 27th, 1961
this Council approved an additlor~..1 $5,000.00.
Mr. Sundy moved to turn the ~15,000.00 over to the Boy Scouts lev
their building, the motion being seconded by Mm. Avery and unanlmou, sly
carried.
H~..Campbell stated that it should be made cleam that it is the
Cityts intention to use the old Boy Scout Building and then moved tha'~
in giving this !915,000.00 to the Boy Scouts for the purpose of their
new building it should be made clear that the city intends, or has
plans of using the old building back of the City Hall and it would
therefore not be possible for them to use any part of the materials
therein, the motion being seconded by Hr. Sundy and unanimously
carried.
The City Manager stated that there had been discussion of the
need of a second validating machine in the Finance Department during
tax season and that he had been authorized to secure bids which are
as follows:
National Cash Register (class 41
similar to the machine presently.
in use) $2,888.90
Burroughs (which does not satisfy
the needs of the City) $1,025.80
The City Manager further stated that he recommended the purchase
of the machine from National Cash Register Company in the amount of
$2,888.90 and that money for same should be appropriated from the
Contingency Fund, it being so moved by Mr. Campbell.. The motion Was
seconded by ~-~. Thayer and unanimously carried.
City Manager Smitzes stated that at the Council Meeting of
October 23rd, action was taken authorizing execution of a contract on
the Seacrest Boulevard and 22nd Street Storm Drainage Project and tha'~
the Attorney has forwarded an opinion on that and asked the Council to
postpone execution of the contract until such time as the public hear-
ing on the project is held, the anticipated date of which is November
20th.
Mr. Campbell moved to follow the Attorneyts recommendations eon-
corning this project, the motion being seconded by Mr. Avery and unani-
mous ly carried.
Mr. Avery read the following letter that he received from
Edward E. Berry, dated October
"Last Tuesday night our little girl Betty Joyee was stricken
with an acute case of appendicitis. Dr. Jerry Cox said she
had to have surgery and fast. While the doctor was making
arrangements at Bethesda Hospital m~ wife Margaret put Betty
in our car and called a passing police car asking the officer
to please help he~. He escorted her safely through the traffic,
helped her at the Hospital and was very courteous. I shall
always be grateful to officer Bill Hutton for possibly saving
the child,s life.
"People are very ~uick to criticize our policemen but seldom
give them credit for doing a good Job these days.
"I think our Delray Beach Police force is the best, and we
should all be glad it is made up of men like ~lll Hutton."

Mr. Avery then moved that the City Manager be directed through
his channels to see that this man is commended by this Coun$il, the
motion being seconded by Mr. Thayer and unanimously carried.
Mr. Alan Duncan, reporter for the Palm Beach.Post Times, asked
if it was possible for the members of the press, ov~er than the Delray
Beach News-Journal who will carry it as an advertisement, to re-
ceive copies at the present time of the advertisement concerning the
Sanitary Sewer System Project.
Mr. Thayer stated that he didn,t think it should be released to
them and gave his reasons for this opinion.
~. Campbell commented on the damages to the Beach due to the
winds and moved that whatever funds the City Manager finds necessary
to use be authorized on an emergency basis from the Beach Disaster
Fund, the motion being seconded by Mr. Sundy and unanimously carried.
The meeting adjourned at 1:40 P.M.
