12-11-61 DECEI~BER 11, A regular meeting of the City Council of Delray Beach was held in the Council Chambers at 8:00 P.M., with Mayor George V. Warren in the Chair, City Manager Louis J. Smitzes, City Attorney John Ross Adams and-Councilmen A1 C. Avery, Glenn B. Sundy and John A. Thayer ~,eing present. 1. An opening prayer was delivered by the Reverend Paul Smith. 2. On motion by Mr. Thayer and seconded by Mr. Sundy, the minutes of the December 4th and 8th Council meetings were unanimously approved. 3. Mr. Paul Ledridge asked if there had been a report from the Planning/Zoning Board on their public hearing last Friday on a request for permissive use to operate a business limited to boat dock rental, sale of yachting supplies, as well as the sale of gas and oil perti- nent thereto, as well as the operation of a social club maintained by membership. City Clerk Worthing read the Planning Board report after which Mr.~ Sundy moved that this item be placed on the agenda for the next meeting. The motion was seconded by Mr. Thayer and carried unani- mous ly. 3. Mr. Eugene T. Berry of Tropic Palms Subdivision representing a delegation of residents from that area presented the following peti- tion to the Council and stated that they feel they are not asking for anything unreasonable but only that which they are entitled to as tax payers of Delray Beach and asked that a committee or someone in au- thority come down to Tropic Palms and meet with their committee to see the conditions that are an annoyance to them. "We, the undersigned residence and property owners of Tropic~ Palms, Delray Beach wish to call your attention, to the unsightly, poorly maintained, hazardous conditions that exists in our neigh- borhood. "We feel that these conditions do have a depreciating effect on the values of our properties, and we request the co-operation of the Council to see that th$se conditions are corrected. "For your information you will find attached to this petition a list of complaints and our recommendations. "1. Operating through trucks in such a manner that they create a hazard and public nuisance. Trucks are operating at excessive speeds; and the loose sand, being loaded considerable higher than the beds of the trucks, blows over the homes, automobiles, and other property. Some of the trucks are of the diesel variety that give off nauseating odors and fumes. Also the oily film from the exhaust collects over the homes. "These trucks are not being used to develops Tropic Palms. Tropic Palms is Just being used as a short-cut for these people to haul fill from a canal bank, west on Germantown Road, to Tropic Isle#. It is our desire and request to have all through trucks routed over State and County Roads, according to city ordinance. We wOUld appreciate signs being erected accordingly. e~. Repairing and finishing streets in Tropic Palms as was promised for the past two years. We understood that the de- re_loper was given a 'dead-line' three months ago of December 15th. To date nothing has been done. "3. Removing of top-soil from vacant lots and digging sand pits. Adjoining property is covered by sand when the wind blows. Also, scrap lumber and rubbish is left by building contractors on vacant lots. "4- Maintaining the entrance of Tropic Palms. The neon on the Tropic Palms Sign at the entrance on U. S. 1 needs to be 12-11-61 DECE}~ER 11, 1961. "repaired and the timing device needs to be reset. We recom- mend the removal of the McKinny Homes sign at the entrance on U. S. 1, as we feel that this is not an asset. Residents are making every effort to participate in the Beautification Pro- gram of Delray Beach. We have picked up litter and mowed grass along the entrance to try to improve the appearance. "5. Working hours and days have not been according to the City Ordinance. This applies to drag-lines, front-end loaders, and heavy trucks operating in Tropic Palms. "Failing to obey Lawful Posted Traffic Signs by Operating Truck of 1 ton or larger on Public Street other than State or County Roads in Violation of Chapter 25, Art.ll, Sec. 25-21 of City Ordinance (Ref. Chapt. 25, Art. 1, Sec. 25-1, Par. 10 of City Ordinances; and Minutes of Council Meeting May 20, 1957. Fine: $25.00" (petition signed by 43 residents) M~. Sundy moved that said petition be made a matter of record and that the Mayor appoint a committee to look into this situation, the motion being seconded by Mr. Thayer and unanimously carried. Mayor Warren then appointed said committee members as follows~ ~. Eugene T. Berry, City Manager Smitzes, Councilman Elect 0. W. Woodard, Jr., City Engineer Fleming and Mr. Roy H, Snider. Mr. Berry asked whose department the enforcement of the Zoning Ordinance was under as he felt that said ordinance was being violated in that area. Mr. Berry also thanked the Oouncil for the street lights that are being installed in Tropic Palms Subdivision. 4. Mayor Warren read the following minvt~s of the December 7th, 1961 Beautification Committee Meeting. 1. "Mr. Merritt reported that he expected to have the unified civic c3ub signs up within the neat week. 2. "A motion was made by Mr. Galinat, seconded by ¥~s. Evaul, that a recommendation be made to the City Manager that the city purchase fifty poinsettias (offered by Floral Acres at a special price~ for use in the north and south entrance islands. Motion carried.'' Concerning Item 2, ~-'~. Sundy moved that $75.00 be approved from the Contingency Fund for purchase of said plants, the motion being seconded by Mr.. Avery and unanimously carried. 6.a. Regarding consideration of bids on Water and Sewer Revenue° Bonds, City clerk worthing asked that Finance Director Carl Gessler assist in opening said bids. Mr. Avery stated that he would like to call a few pertinent points to Council attention before the bids were opened, and referred to a recent article in the Miami News concerning the odor from the sewage plant in Coral Gables. ~.~ Avery also stated that he felt the city would be doing a great injustice to the residents in the area of the proposed sewage plant and asked that the City Manager read a letter from Russell & Axon, dated December 6th and was informed bY the Mayor that this could be considered after the bids had been open- ed and a motion concerning them had been made ~nd· seconded. City Clerk Worthing and Finance Director Gessler proceeded to open and give the information on the nine bids that were received. The Finance Director and Fiscal Agent retired to tabulate said bids. 6.b. City Clerk Worthing presented a Survey Report of alleged nui- sances existing in violation of Chapter 15 of the City's Code of Ordinances that had been furnished,by the Fire Department. It was moved by Mr. Thayer, seconded by Mr. Sundy and unanimously carried to direct the City Clerk to comply with Ordinance No. G'3~8 as applicable to this nuisance survey report. City Manager Smitzes reported that there had been a Joint meet- ir~ on December 6th of DeLay Beach and Boca Raton concerning the in- cinerator and read the followir~ recommendations from Glace Engineer- lng Corporation. "1. The two cities should proceed with the incinerator project witl~ a minimum of delay so as to assu~e completion of construc- tion before the presently used land fill areas a~e entirely "2. Because of the long range advantages, serious consideration should be given to the financing of a 300 ton per day unit. If for some reason this is notpossible, the project should be author- ized on the basis of the ~-2~ton per day pl.~nt. "3. Discussions should be started with financial advisors to develop the most economical means of financing. During this phase, a careful comparison should be made between the bond issue and private lease financing. "4. So as to minimize the period of time required prio', to start of construction, authority should be given to the Engineer to start immediately to prepare working drawings and specifica- tions which will require approximately four to six months. "5. Concurrently with paragraph 4 above, authority should be given to the Engineer to obtain necessary soil and foundation borings and other required testing laboratory work." Mr. Avery moved that the City Manager be instructed to meet with the authorities from Boca Raton relative to selection of a financial agent at this time. The motion was seconded by Mr. Thayer and carried unanimously. 6.d. City Manager Smitzes informed the Council that it has been re- commended by the Contractors Board of Examiners that Mr. C. Herrick Hammond and alternate Mr. Richard T. Hanna Be reappointed for a three hear term, and that Attorney Jack Spinner with alternate Attorney arles Byron be appointed for a three yea~ term to fill the vacancy .~n said board of the recently expired term of Attorney William L. arpenter, it being so moved by Mr. Avery. The motion was seconded y Mr. Sundy and carried unanimously. ~a. City Clerk Worthing read RESOLUTION NO. 1364. A RESOLUTION OF THE CITY COUNCIL OF DELRAY BEACH, FLORIDA, ADOPTING A PRACTICE OR PRO- CEDURE OF RECOGNIZING ON A RECIPROCAL BASIS INDIVIDUALS WHO ARE LICENSED UNDER THE BUILDING CODES OF BOCA RATON AND BOYNTON BEACH, AND PRO- VIDING WHEN SAID PRACTICE OR PROCEDURE SHALL BECOME EPFECTIVE, AND W~EN T~E SAME WILL T~RMINATE. WHEREAS,. in order to facilitate the flow of commerce and trade between the CI~f OF DELRAY BEACH and its neighboring cities BOCA RATON and BOYNTON BEACH in Palm Beach County, it is deemed necessary to establish reciprocal licensing agreements with such cities rela- tive to the Building trade; and WHEREAS, the city building inspector has heretofore ascertained that the neighboring cities of BOCA RATON and BOYNTON BEACH have pre- viously enacted building codes, equal in quality to the building code of the CITY OF DELRAY BEACH, thus insuring that all persons' issued licenses under said codes, by having passed the examinations provided for thereunder, possess the requisite competency qualifi- cations to be issued a similar license by the CITY OF DELRAY BEACH, without further examination, NOW, THEREFORE, be it resolved by the City Council of the CITY O~ DELRAY BEACH, FLORIDA: 1. That when each of the municipalities above named officially adopts a practice or procedure of recognizing on a reciprocal basis, DECEMBER 11, 1961 and issuing licenses to, individuals licensed under the building code of the CITY OF DELRAY BEACH, without the necessity of passing a quali- fying examination, t.~en and in such event the building inspector of the CITY OF DELRAY BEACH, shall be and he is hereby authorized to~ ap- prove the issuance of licenses within his department without examin- ation to applicants who have previously passed an examination and been issued a Building Contractor's license by such reciprocating munici- pality. In the event that any municipality initiates a reciprocal agreement practice with the CIT~ OF DELRAY BEACH, as contemplated herein, and subsequently terminates such procedure, the practice of reciprocating with said municipality shall be automatically termin- ated. Applicants applying for licenses from the CITY OF DELRAY BEACH on the basis of the ~oove reciprocal agreement procedure shall be ex- empted only from the examination requirements of the city building code and shall in all other respects comply specifically with the _ licensing requirements thereof. PASSED AND ADOPTED this llth day of December, A.D. 1961. Resolution No. 1364 was unanimously adopted on motion by Mr. Avery and seconded by Mr. Sundy. ?.b. In compliance with Section 169 of the Charter, Assessment Rolls were submitted by the City Manager to the Council for alley and drain- age improvements in Block 100. City Clerk Worthing then read ORDINANCE NO. G-423. AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA LEVYING THE ASSESSMENTS AS SHOWN BY THE ASSESSMENT ROLLS SUBMITTED BY THE CITY MANAGER OF SAID CITY CONCERNING THE FOLLOWING IMPROVEMENTS IN BLOCK 100; GRADING AND PAVING OF THE EAST-WEST ALLEY TO A WIDTH OF SIXTEEN FEET; OPENING, GRADING AND PAVING OF THE NORTH-SOUTH ALLEY TO A WIDTH OF SIX- TEEN FEET; AND CONSTRUCTION OF STORM DRAINS TO- GETHER WITH THE INSTALLATION OF CATCH BASINS, MAN- HOLES AND APPURTENANCES IN CONJUNCTION WITH SUCH STORM DRAINS. The Council accepted the report of the City Manager and his prOPosed assessment rolls and it was moved by Mr. Thayer, seconded by Mr. Sundy and unanimously carried to place Ordinance No. G-423 on first reading. 7.c. City Clerk Worthing read ORDINANCE NO. G-~2~. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, FIXING THE SALARIES OF THE CITY COUNCIL~ AND THE MAYOR. Ordinance No. G-424 was unanimously placed on first reading on motion by Mr. Thayer and seconded by Mr. Sundy. 8.a. Concerning a Christmas Bonus for city employees, City Manager Smitzes made the following detailed recommendation. "Two days pay - approximate cost - $4,400. "Regular employees with city less than 90 days from December 31, 1961 to receive pro-rated bonus with minimum amount fixed at $15.00. Part time and tom, or.StY employees to be given minimum flat rate of "Appropriation to be made from Contingency Fund with actual final amount to be determined by pay- rolls as of December 31, 1961." It was moved by Mr. Avery to approve the recommendations of the City Manager and the necessary money be taken from the Contingency Fund, the motion being seconded by Mr. Thayer and unanimously carried. -4- la-n-61 DECE}.,{BER 11, 1961. 6.e. (supplemental) City Manager Smitzes presented the following bids for reappraisal o£ all real property and improvements in Delray Beach and stated that if a decision ia reached tonight the appraisal would be made to apply on the 1962 tax roll, and that if it is the Council's ~leasure to award a contract, it is recommended that the low bid of ~20,900.00, using city maps, submitted by Erik Ehrenborg Appraisal Company, be accepted. Hunnicutt & Associates Providing maps $2?, 900. Using City Maps 25,600. Erik Ehrenborg Appraisal Co. Providing Maps 27,000. Using City Maps 20,900. The City Manager also presented a recap of the Reserve for Contingency balance as of December llth, 1961 and informed the Council that the 100 foot beach account in the current budget has an antici- pated surplus of $15,000. at this time and could be transferred to the Contingency Fund. The City Manager further informed the Council that the Director of Finance has ascertained the actual unappropriated surplus will be $40,~O0. It was moved by Mr. Sundy to accept the recommendation of the City Manager and approve the low bid of $20,900. to Erik Ehrenborg Appraisal Company and authorize the City Manager to execute a con- tract with said low bidder, also that the money be appropriated from the Contingency fund for same. The motion was seconded by Mr. Thayer and carried unanimously. It was then moved by Mr. Avery% seconded by ~r. Thayer and unanimously carried to transfer the $15,000. from the beach fund operating account to the Contingency Fund. X. Mayor Warren informed the Council that he had received a re- · quest from the Retail Merchants Division of the Chamber of Commerce concerning the placement of benches in the downtown business area that they be limited to one or two per block with no advertisement on them. Mr. Avery moved to authorize the placing of no more than two benches, and with no advertisement, as requested by the Retail Merchants Division of the Chamber of Commerce. The motion was sec- onded by Mr. Thayer and carried unanimously. 9.a. City Manager Smitzes presented a bill in the amount of $3,500.00 from Attorneys Burns, Middleton, Rogers & Ferrell, covering services rendered from March 16, 1960 to date, covering certain trial proceed- ings and also presented Bills for Approval as follows: ~ 168 29 General Fund Water Fund - Operating Fund ?00.73 It was moved by Mr. Sundy that the bills be paid including the attorney's bill, the motion being seconded by Mr. Thayer and unani- mously carried. X. Mr. Avery stated that he felt i~ proper that the City Attorney submit his bills for special services in sufficient time for the pre- sent Council to approve payment of same, and so moved, the motion being seconded by Mr. Avery. The Council was informed that action was not necessary at this time and the motion and second were with- drawn. 6.a. City Manager Smitzes then presented the following bids on the Water and Sewer Revenue Bonds, and stated that the lowest responsible bidder is declared to be Leedy, Wheeler and Alleman, Inc. at 3.9317 per cent. Avery' s question as to how much money the City will receive to execute the project, Fiscal Agent McCreedy stated that there would be $441,000. for construction purposes, which the consulting engineers said would be adequate. Mr. Avery stated that in view of the fact that the appeal made on the validation of the bonds has to run twenty days and in view of the fact of the letter from the Consulting Engineers which states that it is indicated from the bidders that construction costs will run considerably more than estimated, and would be about $59,000. sho-t, moved that the bids be tabled until after the rest of the situation is finalized. Mr. McCreedy informed the Council that it is not practical to table the bids, that they should either accept or reject them, and that within the week the engineers had assured the Fiscal Agents that, in their opinion, bids totaling this amount of money would be suffi- cient, and that, in any event~_ the City has validated $500,000. worth of bonds wh~ich gives another ~:~50,000. worth of bonds that can be sold should the $450,000. be insufficient. l~ir. Sundy moved to accept the bid of Leedy, Wheeler & Alleman, Inc., the motion being seconded by Mr. Thayer. City Manager Smitzes then read the following letter from the Consulting Engineers Russell & Axon, dated December 6th. "Subject: Project No. 5964-8 Sewage Works City of Delray Beach, Florida "In our capacity as your Consulting Engineers, recent develop- ments require that we advise the City that contractors have in- dicated to us that there is a tremendous lack of interest on the part of subcontractors and suppliers to quote the sewage works project due for bidding on December 13th. So far as we can determine, this lack of interest is due primarily to the publicity attendant to your Just-completed election and the validation hearings, which have cast considerable doubt on the probability of the City going forward with this program. We have found that municipalities, in general, depend upon keen interest for developing a competitive market for construction bidding. At this time, we feel there is some considerable lack of interest and, therefore, there is a possibility that the bid prices will not be in line with bid prices normally obtained on a project of this type. "We sincerely hope that competitive interest will develop be- tween now and the letting date but did feel that we should advise the City of the results of recent publicity. Our Production Department advises me that there have been several sets of plans returned on this project indicating that there would be no bid from these parties. We regret the necessity to advise the Council of this situation and hope that subse- quent developments will solve this problem." Mr. Avery stated that he felt it to be good business to wait on selling the bonds until it is known what the project will cost as he feels that it will be higher than the estimate. Mr. Avery then asked: "Suppose we approve this tonight and then the project is way over our budget for the project, what is the City's liability then because we can,t go through with the project and we don't want the money and we don't want to sell the bonds, as opposed to our liability if we reject the thing tonight?" -6- 12-11-61 DECE~ER 1t, 1961. Fro. McCreedy: "Presumably you are going to build a sewer system sooner or later. I don't recall, and I have been in this business a long time, I don't recall when a project has failed because you had come up short with the necessary funds and have not been able to raise the additional funds and complete the project. I assume the engineers have made reasonable calculations and they have allowed for contin- gencies in this thing and we have allowed for another $50,000. which, if you recall, I insisted upon. ~..e fact that you have had some bad publicity is beyond our control and what I would like to point out is that now you have some r,~.al publicity, and if a contractor has any interest in doin~ some work he can well be assured now that the money is going to be forthcoming." Mr. Avery: "Mr. McCreedy, I need this for clarlfication. You see I am not a financial genius, and you are assuming a lot. These are assumptions. Let's assttme then that the bond validation is ap- pealed and that it gets out past the realm of this Council, and the new Council takes over and this new Council has promised the public that they will put the thing to a referendum before they proceed with any construction, so they choose to do that but we have voted to sell the bonds tonight .... " Mr. McCreedy: "I can anticipate your question. The successful bidder thoroughly understands that. He understands that the appeal period does not expire until December 2?th." Mr. Avery: "And so they appeal and on the 27th it goes to 'the Supreme Court in Tallahassee. Is that correct?" )~r. McCreedy: "If you take it there it does, otherwise it does not." Mr. Avery: "If they are successful with their appeal it will, won't it?" Mr. McCreedy: '~Zes, sure, but you've got to take it there." YLr. Avery: "But assuming that it is appealed, that they file notice of appeal and then they appeal it and then they take it to the Supreme Court. This appeal I understand doesn't go through a court of appeals, it goes to the Supreme Court. On the 27th they file this appeal. It doesn't go to Tallahassee by carrier pigeon and back over night. It takes a week or two at least to get to Tallahassee and back, so it means that it is out past the realm of this Council, then it's a dead duck and the City has not ...... if we pass this thing tonight, then the City has not assumed any obligations?" Mr. McCreedy: "Whether you pass this or not you have assumed no obligations because the bidders, as I have told you, understand that this validation is now in the appeal period and that there could be an appeal which would make it impossible to deliver." M~. Avery: "So there would be definitely no liability to the City. In fact the city couldn,t go to the Judge and say there would be a liability in this thing. Is that correct?" Mr. McCreedy: Oh, I might sue you for a fee, understand, but so far as a liability, that's correct." Mr. Avery: "It wouldn,t be any more fee than we owe :.or tonight whether we pass this or not. That answers my question." Upon call of roll to accept the bid of Leedy, Wheeler & Alleman, Inc., on the bonds, Mr. Sundy, Mr. Thayer and Mayor Warren voted in favor of the motion and ~ir. Avery was opposed. City Clerk Worthing then read RESOLUTION 1365. A RESOLUTION CONFIRMING THE SALE OF $450.000 WATER AND SEWER REVENUE BONDS OF THE CITY OF DELRAY BEACH, FLORIDA, AND FIXING THE INTEREST RATE TO BE BORNE BY SAID BONDS.
