A Regular Meeting of the City Council was held in the Council C.ha~bers at 1:00 P.M., with Mayor George Talbot Jr. in the Chair, C~ty Manager W..E, Lawson Jr., and CommisSioners J. LeRoy Croft, Charles H. Harbxson, Fred B. McNeece and George V. ~arren. An opening prayer was aelivered by Reverend Paul J. Smith. "At its regular meeting on October $0, 1959, the Planning and Zoning Board considered a letter from Mr. Lawson, City Manager, dated October §th, 1959 ask~ng the Board's recommendation for a system of directional signs for subdivisions. NOVEMBER 2nd, 1959. The Board unanimously recommends that no signs other than street signs be permitted in the public right-of-ways e~cept as permitted in Paragrpah $-10-L of the Co~e." /S/ PAUL S. KNO~VLES Chairman On motion of Commissioner McNeece and seconded by Commissioner Croft, the Council unanimously agreed on acceptance of the Planning Board's recommendation concerning a system of directional signs for subdivi s ions. 2. "At its regular meeting on October $0, 1989, the Planning and Zoning Board considered the request of Jane R. Nears for per- mis. szve use for the operation of a ~ay nursery for pre school age chzldren, two to five years of age at 311 S.E. 3rd Ave. . One person other than Mrs. Nears appeared at the hearzng. He objected. Four letter objecting were received and read and one let- ter approving was read. Seventeen _ people we.~e notified. The Board voted that Mrs. Nears be permztted to operate her school at the above address. You will be interested to know that the whole Board unanimously approved a motion that the Planning Board make a comprehensive study of nursery schools and ,s, ubmit general recommendations to the City Council at a later day. /S/ PAUL S. Board considered the request of Mr. Louis Tenerelli for a parkxng devxation on Lots 2 and $, Block 1, O.cean. Park. The Board voted that the request for devxatzon be granted pro- viding they furnish eight (8) of~-street parking spaces and supply the aervice access or alley equivalent to that shown on their sub- mitted plat." /S/ PAUL S. On motion of .Commissioner Harb~son and seconded.by Commissioner McNeece, the Councxl approved grantxng of the Deviatzon Request, sub- mitred by Mr. Louis Tenerelli, as recommended by the Planning Board and subject to the Board's requirements as contained in its 'Report' of Nov. 2nd, and further, sub sect to the approval of the Building In- spector concerning compliance with the City's building codes, and the approval of the Chief of Police as to no hazard in traffic flow being created by the manner in which Mr. Tenerelli provides the required Parking Places as well as ingress and egress therefore. 4. "At its regular meeting on October SOth, 1959, the.Planning. _ and Zoning Board considered the request from the Czty Counczl to name the new extension of S.E. 2nd Ave south of 2nd Str and west of the F.E.C.RR. R/W. The Board voted that this extension be continued as S. E. 2nd Avenue. The railroad divides the two S.E. 2nd Avenues, so that odd numbers can be south of :2nd Street and east of the Railroad, while the even numbers would be on the west side of the Railroad RyW, and would be easier to identify than would a new name." /S/ PAUL S. "At its regular meeting on October SOth, 1959, the Plannin~ and Zoning Board considered a deviation request from Pope _and Blake to permit a sign on the face of their place of business on N.E. 8th Street. The Board voted that the request be denie since it is in direct conflict with ordinance G-2S4, Par. 29-?.6-12. The Council, on motion of Commissioner Warren and seconded by Commissioner McNeec.e, unanimou.sly approved acceptance of the Planning Board's recommendation for denlai of the request from Pope & Blake. On motion of Commissioner Harbison and seconded by Commissioner Croft, the Council unanimously agreed to reject all bids received for construction of NEW tennis courts and that re-advertising for Bids on amended and improved specifications, as recom~_ended by the City Mana- ger, be provided. On motion of Commissioner Croft and seconded by Co,,m~ssioner McNeece, 'the Council unanimously approved PAYMENT of Bills, as sub- mitted by the City Manager, subject to the approval of the Finance Committee, and being as follows: GENERAL FUND $ 18,606.50 WATER FUND - Operating 1,895.45 PAYROLLS ACCOUNTS 16,168.34 The Council, on motion of Commissioner Harbison and seconded by Commissioner McNeece, approved the PLANS for construction of Five (5) buildings in the proposed group of co-operative Villas, to be known as "LAN/KAI" and located on South Ocean Blvd. City Manager'Lawson submitted an application received for pemmit to move a frame house from Gulfstream to the 700 Block of S.W. 4th Street, informing the Council that, according to the Building Inspect- or, the house will meet all building and zoning requirements of the City. Commissioner McNeece stated that he believed this City should take steps to eliminate the bringing into the City from other towns and cities, any fra_me buildings for location within the city. The Building Inspector informed th.e Council of having mailed the usual notices of sUch proposed re-location of a frame house to persons apt to be affected and had received NO. objections, whereupon . Commissioner Harbison moved that in view of the Council having previously been told that it could not arbitrarily refuse such a  uest meeting all requirements, this request for moving a frame house rom Gulfstream into the City, to be locat, ed on Lots.27-28, Block 8, on S.W. 4th Street, be granted on the basis'of a similar request and grant for re-location of a frame house to N.E. 10th Street. Motion was seco.haled by Commissioner Croft.and upon Call of Roll -.Comm~ssion- ers Harblson and Croft, together with Mayor Talbot, voted in favor thereof, Co,missioners McNeece and Warren being opposed. Motion car- ried. On motion of Commissioner Warren and seconded by Commissioner Harbison, the Council unanimously approved granting the Sherwin- V~illiams American Legion Post No. 188 permit to sponsor the same car- nival which the "Post 188" employed here last year, for an Amusement program to be held at the same location November 22nd through the 28th, subject to the same requirements as heretofore provided by the City Manager. . Nayor Talbot, with the consent of the Counc.[1, requested the City Nanager to review the "List" of names subm.tted by the Planning and Zoning Board, and provide the Council with his recommendation of ~those avai.lable and livin$ within the limits of the City of Delray Beach, to Include, specifically, an attorney and an architect, for fi- nal consideration and selection by the Council. NOVEMBER 2nd, 1959 · · Mr. Dowart, of Boca Raton, requested permission from the Council to install a Sign on the V6n. Pfund~ton Apartments, as shown on a s~etch which he presented..The Building Inspector informed the Coun- cxl that the.Sign might be.xn conflict with Signs permitted by vir- tue of th? C~ty's Sign Ordinance. . Commissioner Harbison stated that he believed the Zoning in this area was changed after the property was purchased for such ~ntended usage, and he felt that permit for such sign should be granted based on the privilege being considersd retroactive due to said zoning change, and moved that the Permit be granted. Commissioner~!arren stated that it was based on the Low Bid. Commissioner Harbison inquired if any definite study is being made concerning park.ing requirements for Atlantic Avenue and was in- formed that the over all study now being conducted by Er. George Simons Jr., should result in a report of such proposed parking con- trols and requirements being available for presentation to the Coun- cil about January 1st. MEETING ADJOURNED: R.D. WHEREAS, the City Council did, in regular session held on the 5th day of October,1959, enact Resolution No. 1196 declaring the existence of a nuisance upon certain lots or parcels of land for violation of Chapter 15 of the City Code and Ordinance G-147; and WHEREAS, pursuant to said Resolution, the City Clerk of the City of Del~ay Beach, Florida, did furnish owners of the lands therein declared nuisances with notice that the City Council would sit on October 19th, 1959, at 1:00 P.M., at the City Hall in Delray Beach, Florida, for the purpose of allowing said owners to show cause, if any, why said nuisance described in said resolution should not be abated; and WHEREAS, pursuant to said Resolution, the City Council of the City of Delray Beach, Florida, did on October 19th, 1959, at 1:00 P.M., at the City Hall in Delray Beach, Florida, hold the hear- ing provided for in such notice, and did consider such reasons and facts as were presented by the owners of said lands, and such other material and pertinent evidence as was adduced before it. NATURE OF NUISANCE SPECIFIED: "4" Ail lands in the City shall be kept free from weeds of a height exceeding eighteen inches. The word weeds as used herein shall be held to include all rank vege- table growth which exhale obnoxious or unpleasant odors, or which might be a source of disease or physical distress to human beings, and the word shall also be deemed to include all high and rank vege- table growth that ~,~y conceal pools of water, trash, filth or any other deposits which may be detrimental to health. The existence of any such weeds is hereby declared to be a nuisance. AND, BE IT FURTHER RESOLVED that the City Clerk of the City of Delray Beach, Florida, furnish owners of the lands herein- above listed and described with a copy of this resolution at their last available address within ten (10) days from the date this Reso- lution is adopted. AND, BE IT FURTHER RESOLED that said owners be and they are hereby notified that they are required to abate the nuisance hereinabove adjudged and specified within thirty (30) days from the receipt of a copy of this Resolution; otherwise, in default thereof, the City of Delray Beach, Florida, will ente~~ upon said lands and abate the said nuisance hereinabove specified and will levy the cost of such work as an assessment against the property hereinabove de- scribed.
