06-23-58 JUNE 23RD, 1958 A Regular Meeting of the C~ty Council of the City of Delray Beach, Florida, was held in the Counczl Chambers at 7:80 P.M., v~th Vice- Mayor Fred B. McNeece in the Chair, City Manager W. E. Lawson Jr.~ City Attorney Harry T. Newett and Commissioners George Talbot' Jr., and George V. ~Varren being present. An opening prayer was delivered by City Manager.W.E. Lawson. On motion of Commissioner ~'larren and seconded by Commissioner Tal- bot, the Council unanimously approved the Minutes for the Meeting of June 9th, 1958. City Manager Lawson reviewed, to the Council, a resume of the Bids having been received for construction of Storm Drainage in Section "H" of Seagate, as per following tabulation: Dargel Construction Co., Ft. Lauderdale $11~795,75 Oneman Engineering Co., Delray Beach 15,157~00 EltonHarvel do 14~594;$8 Seminole Construction Co., "Lauderdale 16~410~05 R. H. Vlright & Son Inc., do 16,515.15 Comm!ssionerWarren moved that contract for construction and in- stallation of Storm Drainage in Section "H" be awarded to the low bid- der. Motion seconded by Commissioner Talbot and unanimously carried. The City Manager informed.the Council of financial assistance, i~ prior years, having been provmded to local schools for su,~___er recrea tional activities and further advised of having received a similar re- quest in writing, under date of June 18th, 1958, from Seacrest HiEh School, Nm. Robert W. Fulton, Principal, for a donation of $100.00 to aid their summer activities in recreation; also a request, dated Ju~.e llth, 1958, ?om the Delray B?ch. ElemenSary Schgol,.Mr. H. R. Alex ander, Princmpal, for a contrmbutlon of $100.00 mn amd of their sum- mer recreational prggram; a~d ~ like request from Carver High School, Mr. Anthony H. Hollmday, Prmncmpal, under date of June 17th, 1958. On motion of Commissioner Talbot, seconded by CommissionerWarren, the Council unanimously approved granting each o~ the above named lo- cal schools, $100.00 for summer recreational equmpment, a total of $300.00 for such aid to be provided from Unappropriated Surplus. City Manager Lawson read the following letter: DELRAY BEACH CITY COUNCIL May 28th, 1958. I wish to advise that I have as of this date, tendered my resigna- tion from the Palm Beach County Resources Development Board as Direct- or for Delray Beach. Inasmuch as my work presently demands so much of my time and at- tention, I do not feel that I can offer enough to the Board to make a continued association worthwhile for the board or the 9ity. I do feel that the Board is a worthwhile organizatzonwhich will contribute much to the growth and future economy of Delray Beach and Palm Beach County as aw hole, and I will continue to support them in amy way I can~ Thanking you for your kind consideration, I am /S/ ROBERT V. On motion of Commissioner Warren, seconded by Commissioner Talbot, the Council unanimously agreed to table the matter of appointing a successor to fill the vacancy on the Palm Beach County Resources De- velopment Board resulting from Mr. Cameron's resignation, until the next regular meeting. The City Manager informed the Council of having received the fol- lowing letter: June 9th, 1988. "Please consider this an initial gesture toward a proposition we are making to the town of Delray Beach. - We will be brief since a ny detailed arrangements, percentages etc. can be taken up later should you wish to go through with our proposal. There are a quantity of municipal benches along the beach front area.f .acing the ocean on which we see a possibility, of pla.cing ad- vertising copy. May we sug?st that such copy be limited mn amount and to color so as not to distract from the beat~ty of the area. You would have nothing to lose since it would cost you nothing in either time or money and we feel sure that you will find many uses for any such extra revenue. All labor and materials would be furnished and supplied by your local dealers or individuals as the case might be. City Manager Lawson read the following letters: June 9th, 19§8. "I would like for the City of Delray Beach to pass an ordinance prohibiting dogs running loose in the city. It seems to us that all the dogs from blocks around are using our walks, patio and lawn as a place to expel their dung. Our grandchildren come over and get all messed up and even older folks have this unfortunate thing to happen to them. ~e go around each morning .cleaning up the dung in the yard, the patio and even the walks, but still every time you step out of the house you must be on the alert, watching your step because a dog may have passed by making a mess since the last mess you cleaned up. We have a large lawn for children to play in so that they are off the street but you never feel at ease for fear that they get into a mess. Surely, it is not for us to build a fence around our property to keep the dogs out, but rather it should be the business of the dog owmer to build a fence and keep his doe in." /s? MR. & MRS. City Nanager Lawson then submitted and read the Planning Board's Report of June 19th, concerning re plat of the ~ of Block 3, Priest's Addition to Atlantic Park Gardens: "In view of the eastern half of this Block having been-improved without being required to provide for a north and south alley, the Board unanimously approved acceptance of the proposed development as reflected on said Preliminary Plat SUBJECT to the.developer providing. for granting a~ EASENENT, for public utilities, over the East five (5) feet of said W~ of the Block. The developer, Nr. H. ~cWethy, for Year around support, by the City of Delray Beach, for the operation of a year-round Water-Ski Clinic at Lake Ida to supplement the City's Recreation Program, be acknowledged and tabled for study. The City Council were unanimous in their support of the Proclama- tion designating the month of July as a Safe and Careful month, as submitted by the Florida Safety Council, and requested that publica- tion of same, by the Mayor of the City of Delray Beach, be provided. Commissioner Warren moved that the License Application of Frank T. Geroulo, to permit the sale of BEER only, on the premises or in package, at "Ray's Drive-In", 201~No. Federal Highway, be approved. Motion seconded by Commissioner Talbot and unanimoUsly passed, Commissioner Warren moved that a survey'be made of Ward One and that, as a result thereof, a List be provided showing any and all lots, in violation of Chapter 15 of the City Code of Ordinances, and which have never been. included in a Resolution requiring abatement of alleged nuisances. ~otion seconded by Commissioner Talbot and unanimously approved. The City Manager was requested to obtain, if possible, coDies of Ordinances from Ft. ~lyers, understood to be yery'sa~isfactory/in the Control and abatement of NuiSances within the City, and submit his recommendation concerning an Ordinance which might aid the City of Delray Beach in control and abatement of nuisances. City Manager Lawson read a letter fromM r. C. W. Hagemeyer, which had been directed to Mr. George Talbot, and dated June lSth, 1958, wherein Mr. Hagemeyer referred to previous requests of his for re- quiring the vacant lot, directly north of his duplex (rental property) at 182-154 Venetian Drive, to be cleared of over-growth and to abate all nuisance violations thereon. Mr. Lawson informed the Council of regretting the fact that the ~roperty to the north of Mr. Hagemeyer, namely Lot 2, Block M of The ~illage, had inadvertently been omitted from the original survey list of properties in that area, c6mpiled by the Chief of the Fire Department following past procedure, alleged to be in violation of Chapter 15 of the CoS.e of Ordinances.
