01-31-57AdjMtg JANUARY 31st, 1957. An adjourned meeting of the City Commission was held in the Commission Chambers at 2:00 P.M., with Mayor Warren in the Chair, City Manager W. E. Lawson Jr.· City Attorney Harry Newett and Com- missioners Catherine E. Strong and Dugal G. Campbell. The purpose of the meeting was to hear testimony from licensed taxi cab o~erators and other interested parties relative to the ap- plication of Acme Taxi for one additional taxi cab license. After stating the purpose of the meeting, Hayor Warren opened the floor for discussion. He then asked Percival B. Yell, owner of Acme Cab, to state reasons why he was requesting an additional cab permit. Mr. Yell replied that his request was made besause of an increase in business and one additional cab would enable him to serve the public to a better degree. He also stated that the extra cab would assist his operations by being available for use in the event that the single cab, now in use, disrupted service by need of repair. City Attorney Newett called attention to the fact that the de- cision to be reached involved whether or not Further taxi cab changes in the city are required by the Public Convenience and Necessity. Mr. Gordon Lee, owner and operator of Palm Taxi Cab, objected to having Acme Cab being granted per2ission for an additional cab. Mr. Lee stated that, in his opinion, such an additional cab was not necessary for Public Convenience and Necessity. Att'y. Charles Byron, counselor for Palm Taxi, asked Mr. Yell if his present cab had been out of operation for a period of 30 days or more. Mr. Yell replied in the negative. Hayor Warren said that the o~iinance calls for an established place of business for taxi cabs and inquired as to how Acme Cab is reached by telephone in view of the fact that there is no phone listed for Acme Cab. Mr. Yell replied that Acme Cab is reached through Beach Taxi and that both cab companies have their headquarters at the Greyhound Bus Station on North Federal Highway. Commissioner Campbell mentioned the fact that a few of the taxi cabs· now carrying certificates of Public Conveniences and Necessity through cab companies other than Acme, have not been placed in ser- vice during this year. The city records also indicate that one cab company which was in operation last year is now out of business at this time. Mr. Lee informed the Commission that' his practice has been to with-hold purchase of licenses until the volumn of business requires that all of his cabs be placed in service. He further stated, that, in his opinion, there was not sufficient business at this time to require all of his authorized cabs to be in service. Following additional discussion regarding the Public Convenience and Necessity· Commissioner Strong moved that Acme Cab be granted a Certificate of P'~blic Convenience and Necessity for one (1) addition- al taxi cab PROVIDED that all requirements of the governing Ordinance are met. Motion was seconded by Commissioner Campbell and upon call of Roll - Commissioners Strong and Campbell voted in favor thereof, with Mayor Warren abstaining from voting.
