A Regular Heating of the City Commission was held in the Com-
mission Chambers at 7:30 P.H., with Mayor George V. Warren in the
Chair, City Hanager W. E. Lawson Jr., City Attorney Harry T. Newett
and Commissioners Catherine E. Strong and Dugal G. Campbell being
present.
An opening prayer was delivered by Attorney Nail E. MacHlllan.
Commissioner Campbell moved for approval of the Hinutes cover-
ing the March llth, 19th and 21st meetings. Hotion was seconded by
Commissioner Strong and unanimously carried.
City Manager Lawson read the report of the Planning-Zoning Board,
of March 25th, concerning the Board*s recommendation relative to ac-
ceptance of dedication for an 18 ft. R/W and easements into and servin&
the interior of Block 159, as shown on Survey of Property, submitted by
Attorney Nail HacMillan on behalf of Vivian P. Johnson.
Commissioner Strong moved to grant the request of Hr. H.,C. Lawson
and Vivian P. Johnson, pertaining to an 18 ft. R/W serving the interior
of Blk. 159, as recommended by the Planning Board and submit to the pro-
visions of said report, dated March 25th, as well as the approval of the
City Attorney. Hotion seconded by Commissioner Campbell and unanimously
carried.
The City Manager informed the Commission that he had arranged a
tentative meeting urith the Financial Advisory Board for Friday, at 2:00
P. M., concerning investment of City funds, together ~r~th Hr. HcHeady
of Miami, and recommended deferring action on this issue until said
meeting.
Commissioner Campbell moved for acceptance of the City Manager's
recommendation and to defer action on Investment of City Funds pendin&
outcome of Friday*s meeting. Motion accorded by Commissioner Strong and
unanimously carried.
Hr. H. Lo Blits, of Ft. Lauderdale, developer of Lake Ida Shores
S/D., again appeared before the Commission seeking information as to
whether the City would furnish that area with Water if he did not effect
Annexation at this time. Mr. Blits further stated that he had comenced
construction of his own home, within the S/D of approximtely 70 acres,
cost of which home would exceed $45,000.00, and estimated an additional
15 to 20 homes to be built therein within a year. He also again in-
quired as to the City*s taaation procedure relative to undeveloped and
unsold lands within a S/D being developed.
City Engineer Hark Fleming had discussed tentative cost estimate
for water distribution installation to the S/D, during this afternoon,
and the City Hanager further advised Hr. Blit8 that the consensus of the
Commission is not to supDly water to S/Ds outside the corporate limits
of the City, and further that a subdivider or developer shall provide
extension and distribution lines and mains within a S/D in accordance
with City specificati~ns, and the City shall share in the extension
costs of mains to a S/D.
It was suggested that Mr. Blits submit a proposal and petition
for annexation, indicating the extent thereof to be desired at present.
ComMissioner Campbell moved that the Commission go on record to
deny extension of Water Mains to Lake Ida Shores Subdivision, until
such time as said lands become a part of Delray Beach. Motion seconded
by Commissioner St,ong and unanimously carried.
Discussion followed concerning a Natural Gas Franchise, with
Messrs. Neeley Jr., and Rebel, of Florida Public Utilities, and Mr.
Roberts, both ~arties bein~ desirous of obtaining assurance of such
a franchise, but unable to furnish definite allocation for Gas supply
to Delray Beach.
City Attorney Newett advised the Commission that when an u~timate
decision is reached by the Commission as to its desire and intent, rel-
ative to any Franchise Agreement, it is mandatory that such be placed
before the people by Referendum.

Commissioner Campbell moved that the City Attorney and. City
Hanager take the necessary steps to effect an application fo~ a
Natural Gas allotment on behalf off the City of Delray Beach.'Hot~on
seconded by Commissioner Strong and upon Call of Roll - COmmisS~on-
ers Campbell and Strong voted in Favor thereoff, Hayor Warren
staining.
The City Hanager mentioned the advisability of effecting a
feasibility survey prior to making said application and was so
authorized and Further stated that, with such date, the City would
be in a much better position to negotiate.
City Hanager Laeson reviewed the discussions held on the recent
Hatch 16th special meeting pertaining to the water works imprOVements
and the recommendations of Hr. Scott, on behalf of Smith & GillssPie,
and suggested deferring ef any action at this time until conferri~
with the Financial Advisory Committee and Hr. Hc~eady on Friday.
Co~issioner Strong moved that the City Hanager proceed with
installation of two (2) Test Wells on the North side of the C~ty.
Hotion was seconded by Commissioner Campbell and unanimously carried,
Commissioner Campbell moved that the City Attorney prepare, the
necessary ordinance providing ffor establishment of
rates ~rlthin the City based upon recent survey and agreed rate
schedule, and ffor an overall twenty-ffive (25) percent increase there-
of For service outside the City limits. ~otion seconded by Commiss-
ioner Strong and unanimously carried.
The City Manager then read the Assessment ~oll covering the
Drainage Project in the Andrews Avenue area from Atlantic Avenue to
Beach Drive, as authorized by Resolution No. 1019, ffor which, a
public hearing will be provided on April 8th, at the regular meet-~
lng to be held at 7:30

ously carried.

Comissioner Campbell moved that Contract be entered into frith
Hr. Neal W. Knight for Services to be rendered by Hr. Knight for
locating leaks in the Water Distribution System of the City, marking
locations thereof, testing of all meters 4~ in size and larger,
other detailed tests in accordance ~rtth his proposal o£ February l~th
1957, and for submitting a ~eport on the ~ork tn detail with ap-
propriate reco~endations covering conditions disclosed by the survey,
for an agreed FEE of $3,000.00, which funds shall be provided f~om
Unappropriated Surplus of Water Revenue. Hotion was seconded by Com-
missioner Strong and unanimously carried~
Co~issioner Strong moved that the request of Gulf Stream, con-
cernlng fire protection, and the request of the ~edgewood Apartments
for fire protection, be deferred to the Friday special meeting at
which time a full Comission attendance is anticipated. Hotion
seconded by Com~issioner Campbell and unanimously agreed~
The complaint of Mr. ~. A. Barden, 721 No. Ocean Blvd., con-
cerning excessive water bills was deferred to the Friday meeting, to
allow additional study of his consu~ption record.
City Hanager Lawson info,ned the Co,lesion that Gulf Stream
desired the privilege of hooking up thei~ water mains to those of
the City of Delray Beach, in the case of emergency, on a mutually
agreed rate to be charged and any expense incurred thereby to be'
borne by Gulf Stream.

Co~missioner Strong moved that the City Hanager advise Gulf
Stream of the willingness of the City of Delray Beach to cooperate

BE IT OHDAINED BY THE CITY COUNCIL OF THE CITY OF DELHA¥ BEACH,
FLORIDA:
SECTION I. It shall be unlawful to operate any boat or vessel
upon any waterway ~rlthin the City of Delray Beach, Florida, at a
rate of speed which causes or may cause waves to damage docks,
wharves, sea walls or boats moored or tied to a~dock or wharf
along said wate~ay.
SECTION 2. It shall be unlawful to operate any water craft
~rlth outboard motor or inboard motor not having properly muffled
exhaust within the municipal limits of the City of Delray Beach,
Florida in such manner as to annoy or disturb the quiet, comffort
or repose of any person or persons in any dwelling, hotel or any
other type of residence, or of any person in the vicinity.
SECTION 3. The Police Deplrtment of the City of Delray Beach,
Florida is hereby given the poser and duty of enforcing the pro-
visions of this ordinance and shall have the power to make lawful
arrests for the violation of the provisions hereof; and to prose-
cute offenders in the municipal court of said City. In case a
violation is not commi~ted in the presence of a member of the
Police Department or cannot be detected by observation of such
member, he may require an affidavit of any complaining person
with assurance that such complaining witness will appear to testi-
fy at the trial before making any arrest.
SECTION 4. Any person or persons violating any of the pro-
visions of this ordinance shall be punished by a fine not elceed-
lng $500.00 or by imprisonment for not more than 90 days in jail;
or by both such fine and imprisonment in the discretion of the
municipal court.
SECTION 5. All ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.

WHEHEAS, Chapter 15 of the City Code and Ordinance 6-147 of
the City of Delray Beach, Florida, declares all lands in the City
not kept free f~om debris, vegetation (including trees) or ether
matter, which may become a dan~er in time of hurricane, and from
weeds exceedin~ in heitht of 18 inches, and from filth and trash,
constitute a nuisance; and
WHEHEAS, pursuant to said Ordinances, the Chief of the Fi~e
Department of Delray Beach, Florida, has made a survey report, in
writing, to the City Hanager, describing certain lots or parcels
of land in said City and more specifically described as the area
from Atlantic Avenue to North East 8th Street between the F.E.C.
Railway and the Intracoastal Waterway, wherein conditions such as
specified in Chapter 15 of the City Code & Ordinance exist.
WHEHEAS, the City Council of Delray Beach, Florida, after
consideration of said survey report, is of.the opinion that a
prima facie case showing the following lands constitute a nui-
sance within the provisions of said Chapter 15 of the City Code
and Ordinance referred to herein.
NOW, THEREFORE, BE IT RESOLVED that the existence of a nui-
sance be, and the same is hereby declared, upon the following de-
scribed lots or parcels of land for violation off the provisions
of said Chapter 15 of the City Code and Ordinance as specified
after each description, and the City Clerk of the City of Delray
Beach, Florida, is directed to furnish the owners of each parcel
of land, as hereinafter set Forth, a notice in accordance with
Section 6 of said Ordinance, and that the City Council will sit on
the 22nd day of April, 1957, at 7:30 P. H. at the City Hall in
Delray Beach, Florida, for the prupose of allowing said owners'to
show cause, if any they can, why said nuisance should not be abated.

AT INTERSECTION OF N. E. 8th STREET AND HIGIiWAY

WHEREAS, in order to eliminate congestion, reduce driving
hazards, and promote the free flow of traffic, the City Council
of the City off Delray Beach deems it necessary that a traffic-signal
be installed at the intersection of N. E. 8th Street with Highway AIA
(State Road No. 140) in said city.
NOW, THEREFORE, BE.IT RESOLVED by the City Council of the City
of Delray Beach, Florida;
1. That the State Road Board of Florida be and it is hereby
requested to study traffic conditions at said intersection of N.E.
8th Street with Highway AIA, to determine whether a traffic signal
should be installed and placed at said intersection to regulate the
flow of traffic.
2. That thereafter, with the a,~roval of the state highway
engineer, as requested by law, a proper traffic signal be ordered,
installed and ~laced at said location.
3. That a copy of this resolution be furnished the State Road
Board of Florida in Tallahassee, with the further request that the
matter be considered at the next ensuing meeting of said Board.

Ci. ty Hanager Lawson then read the following "Reports" from the
Planning/Zoning Board; ·
1. The Planning/Zoning Board held a public hearing RE: Rezonlng
quest of Thomas Kemp as pertains to the West half of the South
half of Block 30. No comments were received, for or against such
a proposed change, though many property owners were notified of the
hearing. The Board flet that if it seems practical, that a shop-
ping center, somewhere in the south west area might be su~eSted
by a conference with those actually living in the south west, as
the present extension is one of strip zoning that the Board has
tried to discourage. Otherwise, the Board has no recommendation.
Commissioner Strong moved that the present C-2 Zoning on both
sides of S. W. 5th Avenue be extended southward to a point 150
feet South of S. W. 2nd Street. Notion seconded by Commissioner
Campbell and unanimously carried.
2. The Planning/Zoning Board recommended "Denial" of the Hequest to
rezone the West half of Block 15, Osceola Park, f~om B~A to C-2,
proposed and submitted by Florida Power & Light Co.
Hr. Charles Senior, local District Hanager of the Light Company,
informed the Commission that land for expansion of the southside
plant is needed, and it is not possible to go southward or north-
ward, and the FEC BR adjoins the present Light Company's property.

Col. Andrew Fabens, Hr. Charles Senior and Commission Hembers

3.'~ The Planning Board reoo~snended that deviation be granted allow-
ing a twenty (20) foot set-hack on the north side of Lots (3)
and (4) which comprise the north 100 Feet of Block 3 in Ida Lake
Terrace.
Commissioner Strong moved that a set-hack deviation of
Feet From the north lot lines of Lots (3) and (4), Block 3, Ida
Lake Terrace, be granted, as recon~uended by the Planning Board.

4. The Planning Board recomnended that permission be granted-for con-

Coneuissioner Camphell moved that Hr. Krusell be granted
permission to construct a duplex on each of Lots 29 and 30, Block
8, Dell Park, as recommended by the Planning/Zoning Board. Hotion

5. The deviation request of Hr. Joe Sante relating to Lot 7, Block
100, was deferred until Fridayts scheduled meeting, that a
Further study of the request may be made.
6. The Plat of Tropic Isle - Section 3, has heen approved hy the
Board so Far as size and lay-out of lots is concerned.
Consideration of ~Vetition" For annexation of this Section

Commissioner Camphell moved that Bills, in the amount of ~36,
970.86, be approved For payment subject to the apsroval of the

Commissioner Campbell requested deferrment For discussion of
"Charity Water~ grants, until the next meeting, to allow Further
study of the intent concerning Ordinance 6-74, as well as to review
existing applications for such consideration.
City Hanager Lawson informed the Commission of the satisffactory
service being rendered the City, and ~articularly the Police Depart-~.
ment, by the use of the Traf-0-Teria system of ~arking violation
collections, which are estimsted to slightly exceed the violation
"collections~ over the counter and resultant complaints in many
cases.
Commissioner Strong moved For the purchase of thirty (30:) Boxes
and 5,000 carbonized tickets, cost of which, in the amount of
$718.95, be appropriated From Unappropriated Surplus, Hotion
seconded by Commissioner Campbell and unanimously 8greed.
Commissioner Camphell requested Council discussion of the 8dvls-
ability of continuing the past practice of budgeting Funds For various
Fire Department Hemhers to attend the State Fire College at 0cala,
believing that, possihly, suchattendance might well be in order For
the officers, who through the weekly drill proirams, should be ahle to
convey such knowledge to department personnel.
Hayor Warren relinquished the Chair, and, as Commissioner, moved
that discussion of Fire Department Personnel Training be tabled until
the next regular meeting. Hotion seconded by Commissioner Strong and
upon call off loll - Commissioners Warren and Strong voted in Favor
thereof, Commissioner Camphell heing opposed.

City Attorney Newett informed the Council that he had not been
able to complete the opinion, requested at the last regular meeting,
concerning sufficient and proper insurance coverage, in all phases,
relating to operation and function of police cars, equipment and
auxiliary police, but will have such report at the next regular meet-
ing.
Connnissioner Campbell moved that, due to the fact that Insurance
Coverage is apparently unknown, there shall be NO HIDING of police
equipment by auxiliary police, unless ordered to do so by the Chief of
Police, ,mtil insurance coverage be established, such coverage to be;
for the men involved;'
for their acts;
for the effect ef their acts to citizens and their rights;-
and the City's liability.
Motion seconded by Commissioner Strong and unanimously carried.
Commissioner Campbell, being reminded by Mr. Albert DiCampli, that
the flood lights on the driving range in Block 45 had been promised the
Little League, requested the City Manager to, regretfully, inform the
Teen Town Civic League of this prior commitment, further stating that
the Commissioner had assumed the Little League had made other plans as
they had asked for, and been promised, said Floodlights many months ago.
Commissioner Campbell moved that the inquiry from Mr. John Thieme,
concerning the action of the court in a recent case involving an employee
of Mr. Thieme, be referred to the City Attorney for reply. Motion was
seconded by Commissioner Strong and unanimously agreed.
Commissioner Campbell moved that the City Attorney take the ne-
cassary steps to provide legal cause, in view of present circumstances,
to revoke Occupational License No. 1413, dated November 26th, 1956, is-
sued to Kay's Art Gallery - Harold A. Brand, Operating Manager. Motion
seconded by Commissioner Strong and unanimously carried.
Commissioner Campbell moved that, on the basis off findings off
fact effected by the Building Inspector in and for the City of Delray
Beach, Florida, pursuant to sub-section (c) of Section 9-11 of the
City Code of Ordinances, L. N. Quince and Ida Lee quince, 407 S. W.
1st ~treet, Delray Beach, be ordered to demolish the wooden structure
on the rear (westerly part) of Lot 27 in Block 29, Delray Beach, is
owned by said parties, within ten (10) days from receipt of this notice
or, in the event of failure to comply with this order, be subject to
the provisions outlined in sub-section (3) of Section 9-11, City Code
o2 Ordinances. Motion was seconded by Commissioner Strong and unani-
mously carried.
