04-08-57 APRIL 8th, 1957 A Regular Meeting of the City Council was held in the Council Chambers at 7:30 P.M., with Mayor George ¥. Warren in the Chair, City Manager W. E. Lawson Jr., City Attorney ~arry T. Newett and Commission- ers Col. Dugal 6. Campbell, H. J. Holland, Catherine E. Strong and Martha K. Holland present. An opening prayer was delivered by the Hon. John A. Thayer. Co2~issioner Strong moved for approval of the Minutes covering Me,tings of March 25th and 29th. Motion seconded by Commissioner Campbell and unanimously carried. City Hanager Lawson Dresented and read the following "Heports" received from the Planning/Zoning Board. 1. Deviation ap~lication pertaining to Side-yard Set-Backs on Lot 17, and the West 15 ft. of lot 18, Block "B", Pineridge Heights. Commissioner R. J. Holland moved that said Deviation application be denied as recommended by the Planning Board. Motion seconded by Commissioner Campbell and unanimously carried. 2. HE: Proposed Subdivision of Bonniecrest Addition by Jerome Portman and Alfred Denig. Planning/Zoning Board's report of April 7th mentioned the imposit~on of an undue hardship upon the developers of the property should they be required to meet existing lo% area regulations for the following reasons; (a) To meet minimum requirements, either lo% depths would have to be increased, %hereby sacrificing one tier of lots, or lot widths would have %o be increased, thereby sacrificing approximately 25% of the proposed lots. (b) Other lots surrounding are of lesser area than required. These lots being recorded prior to re-zoning. (c) Distance between paralleling streets, N. E. 17th and N. E. 18th Streets, is only approxi- mately 400 feet, thereby making it impractical to subdivide other than as proposed. The Board, therefor, recommends that tentative approval be given this Proposed subdivision. Commissioner R. J. Holland moved that this request be tabled for fur%her study. Motion seconded by Commissioner Strong and unanimously carried. 3. ' The Board's Report of April 7th advised of said Board having studied the plat of "Lake Ida Shores", a subdivision created by Mr. H.~'' L. Blits, and finds that it would meet the requirements for a Single Family Dwelling District (R-1AA) with modification of set-back requirements on certain water-front lots therein, and therefore recom- mends tentative aporoval. Commissioner Campbell moved that the proposed plat of Block One, Two & Three in "Lake Ida Shores" as shown on plat at%aohed to the Board's Report of April 7th, as to street pattern, be tentatively approved~ pro- vided, however, that such approval shall no% be construed as binding up- on the City of Delray Beach, Florida, should the subdivision regulations be different at the time the developer determines to re-submit a "Final" Plat for aoproval and annexation. Motion seconded by Commissioner H. J. Holland and uttanimously carried. 4. Planning/Zoning Board's Report of April 7th - RE: Florida Power & Light: A public hearing was held on this request for re-zoning, and, although there were no objections voiced thereat, the Boar~i is of the opinion, since the proposed use of subject land is for expanding the facilities of a public utility, it is not necessary to rezone the pro- petty but instead a permissive use ~hould be granted. APRIL 8th, 1957. Commissioner Campbell moved that the request for re-zoning be denied, but that pe~issive use be granted the Florida Power & Light Company, on lands described b~low, when complete intentions. of expansion of facilities have been submitted by the Light Company for approval: "The West-half of Block 15, 0sceola Park; and that parcel of land bounded on the North by So Eo 8th Street, on the East by S. E. 1st Avenue, on the South by So Eo 10th Street, and on the West by the F.EoC. P~. R/~; all the above described lands being within Section 21, T~p. 46 South, Rge. 43 East." Mot/on was seconded by Connnissioner Strong and unanimously carried. 5. RE: Rezoning Request concerning Lots 15, 17, 18 and the West~ 37.5 feet of Lot 15 Wheatley*s Subdivision The Planning/Zoning' ' Boardts report of April 7th, referred to a public hearing held on March 29th, 1957, at which time there were numerous objections received relative to such zoning change, and also to the Boardts report and recommendations of December 31st, 1956, at which time the Board recommended that this p~operty be re-zoned to Hultiple Family Dwelling District (R-3), based upon the original recommendation for general rezoning of the City in April,· Commissioner R. J. Holland moved that this request, for the re-zoning of Lots 16, 17, 18 and the West 37.5 feet of Lot 15, Wheatley~s Subdivision, be denied. Hotion was seconded by Commissioner M, ~olland and unanimously carried. 6. Commissioner Strong moved that the request for the re-zoning of Lots 10, 11 and 12, in Block 28, be denied, as recommended by the Zoning Board in its report of April 7th, 1957. ~otion was seconded by Commissioner Campbell and unanimously carried. 7. RE: Re-Zoning request concerning Ocean Beach Lots 29, 30, 31 32. A General discussion followed, relative to this area being re-zoned at this time. A petition from the Beach Tax Payers League, incorporating the signatures off many property owners in Ward 1, objecting to any change f~om the present zoning in that area was received, and Messrs. C. Y. ~rayson, A. A. Lipscomb and A. B. Muller voiced specific objections to further re-zoning of any Residential area, as now zoned, in that general area. Commissioner R. J. Holland moved that this Request for Zoning of Ocean Beach Lots 29, 30, 31 and 32 be tabled for further study and consideration. Motion was seconded by Commissioner M. Holland, and unanimously carried. . Commissioner R. J. Holland moved for approval of the prelimi- nary plat of the proposed subdivision for l~m. M. Yount, in Section 8, T~p. 46 S, R. ge. 43 E., as submitted by Mr. Yount, ap- proved by the Planning/Zoning Board on A~ril 6th, 1957, as re~om- ' : mended by said Board. ~otion was seconded by Commissioner Strong and unanimously carried. 9. RE: Re-zoning Request of Delray Split Rock Company concerning Lots 1 through 7, Block 3, Southridge S/D. Commissioner Campbell moved for acceptance of the Petition, submitted by Mr. Raymond Thomsen, reflecting the objection to such re-zoning by many property owners whose alleged signatures appeared thereon. Motion seconded by Commissioner Strong and unanimously Carried. Commissioner R. J. Holland moved that, as originally tentat- ively agreed, Lots 1 and 2 of the above described lands be re-zoned to C-l, and Lots 3 through 7 of said Block 3, in Southridge S/D be re-zoned to C-3. City ~anager Lawson read a pro,os ed "Letter Of Intent", on be- half of Hessrs. Roberts and Smyth, trustees for the Sun Coast Gas Company, submitted by Hr. Roberts, concerning the desire of said Sun Coast Gas Co., to ultimately obtain a Franchise from the City of Del- ray Beach for the installation and operation of a natural gas dis- tribution system in this area. Att'y. Robert L. Totterdale, speaking in behalf of Hessrs. Roberts and Smyth, warned the City of the time element and advis- ability of effecting preliminary steps toward an eventual agreement between Sun Coast Gas Co., and the City of Delray Beach, inasmuch as April 21st is an alleged deadline for said Company to establish 'its over-all allotment with the Federal Power Commission. Commissioner Campbell reminded the Council, as well as Roberts, the importance of a clause being incorporated in any agree- ment which may possibly be entered into, to the effect that the lowest rates and all beneffits be made available to the City, of Delray Beach that may be offered any other area in South Florida by Sun Coast Gas Company or by any other Natural Gss Distributor. Commissioner Strong expressed the advisability of obtaining the consideration of the Financial Advisory Board after advising them of all the information available concerning this matter. City Hanager Lawson cited the satisfactory operation of such. distribution by some Florida municipalities with very gratifying Financial return. Commissioner Campbell moved that the City Attorney prepare a revised Letter of Intent along with Hessrs. Roberts and Smyth and re-submit same to the Council For consideration and study by the Co,moil and the Financial Advisory Board. Hotion was seconded by Commissioner R. J. City ~anager Lawson reminded the Council that this meeting provided an op,ortunity, through legal advertisement of the approved Assessment Rolls covering the Paving, as well as the Drainang pro- jects in the Andrews Avenue area, for objections, if any, to be made. ·here were protests offered, against the Drainage Assessments, by residents of Lowry Street, who claim the Storm Drains and Crown of Andrews Avenue paving being higher than heretofore, and higher than the lands upon which their Lowry Street homes exist, cause more water to accrue on their lands than ever before. Hessrs. C. Y. Grayson and John A. Dittrich protest the City hold- ing their lands liable for any share of the Drainage assessment as no beneffits to said lands result from the improvement referred to, and. recently completed. Commissioner Campbell expressed his desire that immediate action be taken to effect relieff from the present condition in the Lowry Street and Basin Drive area. Hr. Fred B. Scott also ~rotested the assessment against Ms pro- perty relating to the Drainage project, referred to herein. Commissioner Campbell moved that, prior to consideration of an Ordinance levying the above mentioned Drainage Assessment, the City Hanager together with the City Engineer, employing any other necessary additional aid, review and study the effects of the Drainage project and particularly the established "Drain Field Area" which is the basis 101 APRIL 8th, 1957. for effecting the various "Assessments" as shown on the Assessm~t Roll approved by the City Council at its regular meeting held on March 25th. RESOLUTION HEO,UIRING OWN~IS OF CERTAIN DESCRIBED LANDS TO ABATE NUISANCES THEREON OR BE ASSESSED COST THEREOF FOR ABATEMENT BY CITY. WHEREAS, the City Council did, in regular session held on the llth day of March, 1957, enact a resolution declaring the existence of a nuisance upon certain lots or parcels of land for violation of Chapter 15 of the City Code and Ordinance 6-147; and WHEREAS, pursuant to said resolution, the City Clerk of the City of Delray Beach, Florida, did furnish each of the owners of the lands therein declared nuisances with notice that the City Council would sit on April 8th, 1957, at 7:30 o'clock P.M. at the City Hall in Delr~y Beach, Florida, for the purpose of allowing said owners to show cause, if any, why said nuisance described in said resolution should not be abated; and WHEREAS, pursuant to said resolution, the City Council of the City of Delray Beach, Florida, did on April 8th, 1957, at 7:30 o'clock P.M. at the City Hall in Delray Beach, Florida, hold the hearing pro- vided for in such notice, and did consider such reasons and facts as were presented by the owners of said lands, and such other material and pertinent evidence as was adduced before it. Commissioner Strong moved that the "Sale" of Lot 7, Block 87, Linn's Add. to 0sceola Park, PI.Bk. 1-133, held at 1:00 P.M., on April 1st, 1957, be rejected and that the offer of $2,025.00 for said lot submitted by the Bach~ Industrial Park, Inc., of Pompano Beach, Florida, be refunded. Motion seconded by Commissioner R. J. Holland and upon Call of Roll - Commissioners Strong, R. J. Holland, M. K. Holland and Mayor Warren voted in favor thereof, Commissioner Campbell abstaining. Mr. Martin V. Case, President of the Delray Beach Little League Committee, submitted a letter dated A~ril 4th, 1957, wherein the said Little League outlined its programs, benefits to the general area as a whole, and the fact that f,mds are necessary for tile furnishing and installation of additional light units, poles, transformers, re-wiring and all necessary labor pertaining thereto. Mr. Case further advised that Mr. Gearhart, engineer for tile Florida Power & Light Company, quoted the Little League ~2,778.00 as over-all cost for additional lighting, stated to be necessary for satisfactory operation of the Little League ball field. Mr. Gearhart, however, stated that an allowance of ~416.50, for equipment unusable in the re-lighting plan of the park but now the property of the Little League, would be made. Commissioner Campbell moved that, for this most worthy project, the City provide necessary funds, in the amount of ~2,361.50, for supplying sufficient monies to cover the cost of expanding the exist- ing lighting facilities at Little League Park, said funds to be pro- vided from Unappropriated Surplus. Motion was seconded by Commission- er R. J. Holland and unanimously carried. City Manager then read Ordinance No. G-252. ORDINANCE G-252. AN ORDINANCE OF THF, CITY COUNCIL AMENDING SECTION 27-3 OF TIlE CITY CODE OF ORDINANCES OF DELRAY BEACH, REVISING AND FIXING RATES FOR WATER SERVICES FURNISHED TO CONSUMERS WITHIN AND WITHOUT THE CORPORATE LIMITS OF DELRAY BEACH. Commissioner R. J. Holland moved that Ordinance No. G-252 be placed on first reading. Motion seconded by Commissioner Campbell and unanimously carried. The City Manager presented Bills for Approval, amounting to $280,264, 92, explaining that ~224,000.00 thereof were not expend- itures but actually Fund transfers, the major portion off which is merely the transfer of surplus funds to ~Time Deposits~. Commissioner Strong moved that said Bills be paid subject to the approval of the Finance Committee. Motion seconded by Commission- er R. J. Holland and unanimously carried. 106 APRIL 8th, 1957. Commissioner R. J. Holland moved for approval and acceptance of the recommendation made by the City Manager, as a result o£ the Manager's recent survey, and for authorizing the City Manager to proceed with the installation of 117 additional 2500 lumen lights and the conversion of 218 existing 1000 lumen street lights to 2500 lumen lights, sufficient funds to cover the cost thereof are provided in the current budget. Motion seconded by Commissioner Strong and unanimously carried. Commissioner Campbell moved that the request for a Beer and Wine license for consumption on the premises, to be located at 27 N. Wp 5th Avenue, be denied in compliance with the provisions contained in Section 4-24 of the City Code of Ordinances. Motion was seconded by Commissioner R. J. Holland and unanimously carried.
