04-22-57 109 APRIL 22, 1957. A Regular Meeting of the City Co,moil was held in the Council Chambers, in the City Hall, at 7:30 P.M., with Mayor George V. Warren in the Chair, City Hanager ~'. E. Lawson Jr., City Attorney ttarry T. ~ewett, and the Following Council Members being present, R. J. Holland, Martha K. Holland and Catherine E. Strong. An opening prayer was delivered by Chaplain Hayes. Commissioner Strong moved for aD9roval of the Minutes, covering April 8th and 12th Meetings. Motion was seconded by Comnissioner R.J. Holland and unanimously carried. City Manager Lawson informed the Council of having received the drainage area, which Formed the basis For the Andrews Avenue Drainage Assessment Roll, with the aid of MB. 'Elliott Gross, who did the engi- neering worm For t~e Andrews Avenue imgrovements, together with Mr. Mark Fleming, Supt. of Public Works who personally checked the ele- vations on Lowry Street, in F~ont of the homes of Messrs C. Y. Grayson and John A. Dlttrich. This re-check of the conditions on Lowry Street, as a result o£ the recent Drainage Improvement on Andrews ~venue, disclosed a low spot in the center of the Block, between Andrews and Seabreeze Avenues, on Lowry Street which can be corrected by one catch basin and suffic- ient 8 inch storm sewer %o connect with the catch basin, and Andrews Avenue,.according to the Supt. of Public Works, who recommends that such installation be made to solve the drainage problem on Lowry Street. Mr. C. Y. Grayson stated that he did not Feel such installation would be of any benefit to %he properties on Lowry Street and further Felt %hat relief From assessment, therefor, should be granted both he and Mr. Dittrich. Upon being questioned by %he City Manager, Mr. Fleming asserted that the above suggested installation of a catch basin and storm sewer line would result in satisfactory drainage of the Lowry Street area into the Andrews Avenue Drainage System, and Fully .correct the present situation. Commissioner R. J. Holland moved that the proposed assessment roll For the Andrews Avenue Drainage Improvement remain as compiled, as re- co~mended by the City Manager, and ths t necessary steps be taken immedi- ately to provide complete relief and correct the situation on Lowry St. by installation of catch basin and storm sewer line of sufficient ca- pacity and construction to effect proper draining to the Andrews Ave. Drainage System. Motion was seconded by Commissioner Strong and unani- mously carried. The City Msnager informed the Council that the Parking Lot Improve- ments to the Public Beach, on Lot 14, Block "A", Palm Beach Shore Acres, are now completed, and read a letter From the Beach Committee,as follows: "Delray Beach, Florida April 13, 1957 Honorable City Commission ])elray Beach, Florida Gentlemen: The Beach Committee met at 5 P.M. on April 12th. We respectfully submit for your consideration, the following recommendations relative to the 100 Feet of Bathing Beach north of Briny Breezes. Plans be drawn immediately and bids obtained, for the constrllction of a small bathhouse with showers and toilet Facilities. We would suggest concrete .block building with aluminum Framing' ~ for doors and windows, For durability. Life ropes be installed in the water. Life guard he employed. (Fully qualified). 110 APRIL 22nd, 1957 Benches, tables, and trash cans be placed on the ground S, Position of Supervisor of the Grounds be created, and that Mr. A. H. Walker be employed to fill this position. It is the opinion of our Committee and many other persons who will be using the grounds, that Mr. Walker due to his familiarity with the problem and area, is the best person qualified for this important ~ Dost. Holland moved for acceptance of the Beach Committee's recommendations and requested the City Manager to obtain estimated cost for the various facilities contained in the request'of said Committee, for consideration at the next regular meeting.. ,Motion was seconded by Commissioner Strong and unanimously carried. Commissioner Strong moved that consideration of the City furnish- ing water to certain accounts, such as Churches, ~omen's Club Building, Junior League and Pony League Park, be tabled for further study,., Motion seconded by Commissioner M. K. Holland and unanimously carried. Commissioner H. J. Holland moved that the City Manager determine how much equipment was intended to be removed from the old '36 Dodge Fire engine in order to ascertain if a possible lease of said ~Fi.r~e Er~g~ne might not be more beneficial than disposal by public sale. Mo- tion was seconded by Commissioner M. K. Holland and unanimousl'y carried. City'Manager Lawson read the Bids, received, for Clearing of Lots in the area East of the Waterway (per tabulation a[~Dearing below), only two (2) having been returned from ten solicited: For Ten (10) Lots To Be Cleared Total Cost. Mike Blank Nurseries $ 3,325.00 W. J. Snow Construction Co., ~ 13,225.00 Commissioner H. J. Holland moved that order be placed, for clear- in~ of Lots specified in said tabulation, with the low bid4er. Motion seconded by Commissioner Strong and unanimously carried. City Manager Lawson informed the Co,mci1 of having solicited Dids for a Maintenance Kettle from eight (8) manufacturers and only receivin~ returns from three firms, only one of which was based on and met all specifications contained in the original request called for by the Supt. of Public Works for use by the Street Maintenance Department. Commissioner Strong moved for the acceptance of the Bid sub- mitred by Neff Machinery, Inc., in the amount of ~1,085.00, whose equipment meets all specifications and is recommended by both the City Man~ger and Supt. of ?ublic Works. The City Manager then submitted Bids, shown below, having been received in response to requests from seven (7) manufacturers, for an Emergency Generator to be installed at the Central Fire Station: H. Holland moved to accept the recommendation of the City Manager and Fire Chief and award the contract to the low bidder, for furnishing 1 10KW 12.5 KVA., A.C. 120/208 V, 60 Cycle, 3-Phase, 4- Wire, Remote Control 0nan Generator comglete, Gasoline Engine of not less than 20 H.P. at not over 1800 HPM, and to include Muffler, Gas flank, Cop- per Tubing and fittings complete and ready for installation. Notion se- conded by Commissioner M. K. Holland and unanimously carried. Commissioner H. J. ltolland moved for a~noroval of the 21at of Bonnie- crest Add}tion, Oresented by Mr. Jerome Portman, as recommended by the Planning/Zoning Board, and subject to re-submiSsion of the Final Plat, to the City Manager, reflecting proper set-backs as provided on the initial- ed Plat referred to herein. Motion was seconded by Commissioner H. K. Holland nnd unanimously carried. Mayor Warren read the Heoort of the Planning Board, dated April 7th, concerning aoolication for Re-Zoning of Ocean Beach Lots 29, 30, 31 and 3~ from R-1AA to H-3 Zoning, wherein the Board recommends re- zoning of said lots. Att'y Rhea Whitley again expressed his belief that the general area is best suited for Multiple Family Dwelling District (1(-3) and further requested Co,moil consideration thereof. Mr. John Thayer, speaking for the Beach Tax Payers League, re- ferred to the ballot of the League's members, presented to the Council at a previous meeting, wherein 136 were opposed and only 18 in favor of re-zoning, and f,~ther advised of h~ving received many more objections since having submitted the above mentioned ballot. Commissioner R. J. Holland moved that further consideration of this prooosed re-zoning be deferred u~ltil a November meetin& and that, in the meantime, Mr. George Simons, consultin~ engineer and who was employed by, and greatly aided, the Planning/Zoning Board in its over- all study and re-zoning of the City of Delray Beach, in 1955, be re- called and, together with said Board, review the established zoning of %his general area, to possibly find cause for, and if found warranted to conduct a public hearing subsequent to December lat. Holland and unanimously carried. City Hanager Lawson referred to a request from Mrs. Evely? C. Foote, conce~ning a prior abandonment of a once dedicated in what was known as Rice's Addition, which entire subdivision was purchased by a developer in 1952, all easements, alleys and rights- of-way abandoned and the entire area Re-Platted, now being known as Chevy Chase, Mrs. Fbote feeling that such abandonment was illegal. Commissioner R. J. Holland moved that the sub-division of Chevy Chase, per Plat Book 24, Page 27~ a~proved by the City C~ouncil on February 9th, 1953, remain as is, Mrs. Foote being advised, that investigation of the abandonment of ~Rice's Addition" discloses that all action relative thereto was in accordance with legal steps pro- viding for such abandonment. Motion was seconded By Commissioner Strong and unanimously carried. The City Hanager infformed the Council of having received complaints from Mr. Thomas Bruder, concerning parking off trucks in residential zones and of business (unlicensed) operating in such zoned areas, however, no specific case was cited. Commissioner R. J. Holland. moved that a letter of thanks be extended to Mr. Bruder for calling these items to the attention of the City Manager and that the City Council will take steps to elimi- nate parking on sidewalks, or the parking of large trucks which create undesirable and obnoxious noises in residential areas, but that the Council Feels that the working person d~lving to and from work is within his rights to park a small panel or pick-up truck on city property or his own d~iveway. Motion seconded by Commission- er H. K. Holland and unanimously carried. City Manager Lawson advised the Council of the American Legion's desire to clear and grade some additional land at the Little League Ball Park to provide practice area and playground space, and for such improvement are requesting that the City provide approximately 75 yds of Marl For the field. The City Manager informed the Council that he had scheduled a meeting with Smith & 6illespie's Engineer, together with Supt. of Public Works - Mr. Mark Flen~ng, for Tuesday, April 23rd, concerning location of drilling the 2 test wells on the North side. Commissioner Strong moved that the County of Palm Beach be requested to transfer, to the City off Delray Beach, Co~mty owned lands in Section 8, Twp. 46S, Rge 43E, lying between St ~te Road 9 and Lake Ida, for Public Park Purposes. Hotion was seconded by Commissioner H. J. Holland and unanimously carried. Commissioner Strong moved that a set-back deviation off three (3) feet be granted Mr. Joe Sante, permitting construction of a proposed Store and Orifice Building on Lot 7, in Block 100, with a front set-back of seven (7) feet. Grimes for his contribution of ~2,400.00 to the Library Assoc. The City Hanager read a telegram from the Executive Secretary of the Florida League of Hunicipalities conce~ning a proposed one cent State Tax Increase on Gasoline, to be refunded to ~unicipali- ties and County Governments. No action was taken on this matter. 121 APRIL 22nd, 1957. City Manager Lawson reported on the following items: 1. A scheduled meeting this week with Mr. Steve Middleton and Mr. Elliott Gross relative to the start of survey for establishing a Bulkhead Line for presentation to the County Con~ission and Beach E- rosion Committee. 2. Ratification of Ordinances will be provided for in action being taken this week. 3. Land re-valuation program is progressing and will be presented to the Council for consideration in time for effective assessment date as of January 1st, 1958. 4. Traffic Light, for N. W. 8th Avenue and 2nd Street, is on hand. Installation is held up awaiting the Necessary Pole to be furnished by Florida Power & Light Company. 5. Tennis Courts and Teen Town Center Bldg., are in the process of being painted. 6. Specifications should be completed this week for Sidewalk Cons~ruct- ion on the East side of N. W. 8th Avenue from 2nd Street northward. 7. Work is ~rogressing on the preparation of proposal for a Central Store Room and Perpetual Inventory System. 8. The City Attorney is engaged in preparing the "Jitney" Ordinance. 9. The Insurance Coverage program for Soecial Police Officers is being developed. 10. Will have Bids for Opening, Grading and Paving of S. E. 5th Street, Eastward from Federal Highway (US 1), for the next meeting. 11. Rock, for necessary repair of streets as well as opening rights-of- way on the Westside, is being sought. 12. Am working with Mr. Charles Senior, of Florida Power & Light Company, on the Street Light Expansion Program. 13. Together with the Supt. of Public Works, Mr. Fleming, proper methods for eliminating the drainage vroblem in the Basin Drive area are now being determined. 14. Contemnlating feritlization off trees and efffecting larger openings around Base of trees on Atlantic Avenue to provide better watering and breathing space. 15. Will have recommendation for Water Service Charges to various public buildings and grounds for the next meeting. City Manager Lawson further advised the Council of very satisfactory results in the present over-all Youth Activities Program of the iiecreat- ional Director - Mr. Tom Boyce. The Council requested the City Manager to express appreciation to the Seacrest Hotel Management for the "Open-House~ extended to the pub- lic following the Easter Sunrise Service.
