A Regular Meeting of the City Council was held in the Council
Chambers, in the City Hall, at 7:30 P. H., with Mayor George ¥. Warren
in the Chair, City Hanager W. E. Lawson Jr., City Attorney Harry 7.
Newett, and the folloving Council Members being present; Col. Dugal G.
Campbell, Catherine E. Strong, R. J. Holland and Martha K. tiolland.
An ep®ning prayer was delivered by Att'y Neil HacHillan.
Hayor Warren inquired as to steps being taken relative to the
present Emergency Street Repairs necessary by the abnormal rains dur-
ing..the past two weeks.
City Hanager Lawson informed the Council that he, together with
the Supt. of Public Works, having recognized the urgent need for the
repair of many streets, have prepared and submit the following estimate
of Costs for'~those repairs considered to be most urgent;
Repaying of Streets By Contract:

The City Hanager further advised that the Public Works Department
has prepared a lengthy list of streets which he proposes to repairJdur-
lng the sunnier months with City equipment and personnel. This long list
of identified streets, to be repaired, is on file in the office of the
Su~t. of Public Works, Mr. Mark Fleming, where it may be viewed by in-
terested persons.
Con~nissioner Campbell moved to accept the Report of the City Han-
ager, as outlined therein, and to authorize him to proceed with his plan
for emergency repairs of Streets, providing necessary funds, not to ex-
ceed $12,000. from Unapnro~rtated Surplus, to cover the costs thereof.
Motion was seconded by Commissioner R. J. Holland and unanimously carried.
City Hansger Lawson, replying to Hayor Warrents inquiry regarding
improvement of N. E. 2nd Street, reminded the Council of having presented
an estimated cost for general improvement of said street, from N. Swinton
Avenue to the Federal Highway, several meetings ago.
Com~lssioner Strong moved that the City Hanager take necessary steps
to determine the area to be considered benefitted, and therefore propor-
tionately a~sessed in accordance with the City Charter, for Construction
of Storm Drains, Catch Basins and Hun-Holes, as well as to provide funds
necessary to cover the Cityts portion of such improvement cost. Motion
was seconded by Co~issioner R. J. Holland, and upon Call of Roll - Com-
missioners Strong, R. J. Holland, M. K. Holland and Mayor Warren voted
in favor thereof, Com~issioner Campbell abstaining.
Commissioner Campbell moved for approval of the Minutes cpvering
tbs regular meeting of the Council, held on April 22nd, 1957. Hotion
w~s seconded by Co~issioner H. K. Holland and unanimously carried.
City Manager W. E. Lawson advised the Co;~ncil of having received
the following bids for Resurfactng Teen To~n Tennis Courts:

Com~issioner Campbell moved that Contract for resurfacing 'Teen
Town Tennis Courts be awarded to the low bidder. Motion was seconded

into a New Contract Agreement with K. L. Sharpe, of Orlando, for main-
tenance of the City's elevated water tanks, to include two complete
clearings and paintings, at an annual cost of $1,250.00, as recom-
mended by the City Hanager, subject to the approval of the City At-
to-ney as to ffo~n. Hotion seconded by Commissioner Strong and unani-
mously carried.

AN EHEHGENCY 0HDINANCE OF THE CITY
COUNCIL OF TNE CITY OF DELRAY BEACH,
FLORIDA, AMENDING SECTION 16-3 OF THE
CODE OF ORDINANCES OF DELHAY BEACH TO
PROVIDE TIME FOR HAKING APPLICATION
FOR LICENSE.
WHEREAS, a question has arisen as to the time for making ap-
~lication for occupational licenses, as defined in Chapter 16 of
the Code of Ordinances of the City of Delray Beach; and
WHEREAS, in order to clarify the provisions of said Chapter,
and speedily remove any question thereto, the City Council does
hereby declare an emergency to exist.
NOW, THEREFORE, BE IT ORDAINED by the City Co,mcil of the
City of Delray Beach, as follows:
SECTION 1. That Section 16-3 of the Code of Ordinances of
Delray Beach be, and the same is hereby amended to read as follows:
"Application for licenses shall be made on
or subsequent to September first of each
year, and all licenses shall be payable on
or before the first day of October of each
year; and no license shall be issued for any
fractional portion of the year, except that
in the event that any person shall engage in
or manage any business, profession or occupation
mentioned in this chapter on or after the first
day of April, then and in that event, such per-
son shall be required to pay only one-half of
the amount for an occupational license as is
specified in this chapter.
SECTION 2. This Ordinance supplements existing ordinances
as specified.
UNANIMOUSLY PASSED on first and final reading this 13th day

Commissioner Strong moved that Emergency Ordinance No. 6-258, as
read, be passed and adopted on first and final reading. Hotion was
seconded by Commissioner R. J. Holland and unanimously agreed upon.
Commissioner Campbell moved for acceptance of Annexation of lands
described in the "Request" of Mr. William M. Yount, read by the City
Manager, said lands being contained in the NE¼ of the East-half of Model
Land Co's. Lot 19, Section 8, Twp. 46 S., Rge. 43 E., SUBJECT TO Amend-
ments thereto as agreed upon by Hr. W. M. Yount, namely that said lands
shall nOt be taxed in excess of an annual ad valorem tax of ~10o00 per
lot, (after subdivision thereof) for ten (10) years from date of annex-
ation except that in case of Sale of, or Improvement upon, any lot, such
lot shall then be subject to normal taxation, and further that said lands,
proposed to be annexed, will be subject to existing bonded indebtedness,
and Ordinance ~roviding for such Annexation shall be subject to the ap-
proval of the City Attorney. Hotion seconded by Commissioner Strong and
unanimous ly carried.
City Hanager Lawson read the "Request" for Annexation of certain
lands, submitted by the Ridge Construction Co. of Palm Beach County,
said lands comprising Blocks One, Two and Three, together with an ad-
jacent parcel of land lying to the east of a portion of Block 3 and
identiffied in acreage, all of which lands are in a Subdivision known
as "Lake Ida Shores" and shown on 'Exhibit B' which is attached to said
Request and forms a part thereof.
The City Hanager then read the 'Report' from the Planning/Zoning
Board, dated May 10th, pertaining to the foregoing Request of Hidge Con-
struction Company, wherein the Board expressed being in favor of such
annexation subject to amendment within Section 3, Par. (b), as follows;
Line 8 of said Par. (b), on Page 2 of said Annexation
Request should read, in part - - - "In the event, how-
ever, that any such lot is sold by the petitioner herein,
or built upon, then such lot etc".
The City Hanager advised the Co~mcil that the Ordinance providing for
annexation of the foregoing described lands would contain all normal
Urovisions concerning Drainage, Street Paving, Streets etc., similar
in effect to orevtously prepared Ordinances for such purpose.
Commissioner Strong moved for approval and acceptance of the
*Requestt for Annexation, submitted by Ridge Construction Company of
Palm Beach Co~mty, subject to amendment recommended by the Planning
Board as stated above. Hotion was seconded by Commissioner R. J.
Holland and unanimously carried.
Hr. H. Ben Adams appeared before the Co,moil and requested
consideration conce~ni,ng road requirements for development of Blocks
26 and 27, Homewood S/D, as well as possible sharing of expense for
installation of water distribution lines to said area from the current
mains in Breezy Ridge Estates.
Commissioner Campbell moved that Hr. Adams be required to sub-
mit, in writing, his proposal for the development of said Block 26 and
27, in accordance with policy and procedures required of all sub-di-
viders and developers, for consideration and action by the City Com~is-
sion. Hotion was seconded by Commissioner Strong and unanimously agreed
upon.
City Hanager Lawson read the "Set-back Deviation" Hequest of
Louis D. Tenerelli, pertaining to lots 2 and 3, Block 1, Ocean Park, sub-
mitted by Att'y. Nell .E. HacHillan.
General discussion followed conce~ning alleged commitments made
by prior Council or Councils to Hrs. Edith G. Slane in connection with
her dedication (0uit Claim) to the City of Delray Beach, on December 5th
1947, per Resolution No. 640, of approximately seventeen (17) Feet from
the east Oroperty line of the above mentioned Lots.
Commissioner Strong moved that this matter be tabled for. further
study and that the City Attorney be instructed to investigate the intent
of the alleged contract agreement or agreements as caused to be created
by prior City Council in consideration of the Quit-Claim action reflected
in Hesolutlon No. 640, dated December 5th, 1947~ Hotion seconded by Com-
missioner Campbell and unanimously carried.

The City Manager read a letter from the Lake Worth General
Hospital requesting financial aid from the City of Delray Beach for
hospital operation.
Commissioner Campbell moved that the request of Lake Worth Gen-
eral Hospital be denied. Motion seconded by Commissioner Strong and
unanimously agreed upon. ..
Commissioner Strong moved for granting the request of Patrick
Air Force Base to sell tickets, for one day on or about May 23rd,
profits from which sale go toward the support of youth activities
in the base, as boy scouts, girl scouts, Little League, etc. Motion
seconded by Commissioner Campbell and unanimously carried.
Commissioner Strong moved that fruit trees and shrubbery be
allowed to remain on those lots between S. E. 2nd and 3rd Streets,
facing on Federal Highway, Block 119, for Bird Sanctuary purposes,
as requested by Twyla B. O'Hara, but that otherwise all lots, as
ordered, shall be cleared in accordance with Ordinance No. G-147,
as well as Resolution No. 1044. Motion seconded by R. J. Holland
and unanimously carried.
Commissioner Campbell moved for payment of annual dues to the
Palm Beach Co~mty Association of Municipalities in the amount of
~64.00. Motion was seconded by Commissioner Strong and unanimously
agreed upon.

for the clearing, grading and paving that part of Andrews Avenue
lying between Atlantic Avenue and Beach Drive, and
WHEREAS, said report and assessment roll were approved by the
City Council in regular session on the 25th day of March A.D., 1957,.
and
WHEREAS, due notice concerning said assessment roll was given
by advertisement by the City Clerk, in accordance with the City
Charter of said City, for the purpose of hearing objections to said
assessment roll, and
WHEREAS, no sufficient objections were received to the confirm-
ation of the assessment roll,
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Delray Beach, Florida, as follows:
SECTION I. The assessments, as shown by said assessment roll,
which is annexed hereto and made a part hereof, are hereby levied
against the property shown and in amounts shown on said assessment
roll, said assessments to be paid in three (3) equal annual install-
ments, together with interest at the rate of eight (8) per cent per
annum, the first installment becoming due and payable on June 13th,

SURPLUS PUMPER FIRE ENGINE TO TRUSTEES OF DEL-
TRAIL VOLUNTEER FIRE DEPARTMENT: AND DIRECTING
CLERK TO GIVE NOTICE THEREOF BY ADVERTISE~ '~T.
WHEREAS, the City of Delray Beach is the owner of a certain 1936
Dodge fire truck equipped with a 500 gallon per minute champion front-
end pumper, and a 300 gallon booster tank, which personal property is
now surplus and not needed by the Fire Department of said city; and
WHEREAS, areas adjacent to the municipal limits of said City do
not have fire protection, and thereby it is to the best interests of
said City that said personal property be sold to Volunteer Fire De-
partments located in such adjacent areas; and

WHEREAS, The Del-Trail Volunteer Five Department has been organ-
ized to serve and furnish fire protection to the mlincovporated areas
immediately west of and adjacent to the municipal limits of Delray
Beach, and is in need of equipment, and has offered to purchase the
above described small pumper fire engine for the sum of $1,500.00 pay-
able as hereinafter set forth, which is deemed to be the fair value of
said pronerty.
NOW, THEREFORE, BE IT RESOLVE]) BY TIlE CITY COUNCIL OF THE CITY
OF DELRAY B~tCH, FLORIDA, as follows:
1. It is proposed that the above described personal property be
sold to the Trustees of the Del-Trail VolUnteer Fire Department for
the sum of $1,500.00 payable as follows: $150.00 cash at the time of
transfer of title, and the balance in semi-annual installments of
$150.00 each, commencing six (6) months after the date of transfer and
a like sum every six months thereafter, until the entire sales price
is paid, and until full payment, the City shall retain a lien upon
said personal property for the unpaid balance as aforesaid.
2. That the City Clerk is hereby directed to advertise the
terms of this proposed sale in a newspaper published within the City
of Delray Beach, Florida, once a week for two consecutive weeks as
required by Section 7 (2) (b) of the Charter; that said notice shall
further require that any objections to such proposed sale must be made
in writing, and filed with the City Clerk on or before 5 P. M. on Mon-
day, the 10th day of June, 1957.
3. That any objections to such proposed sale shall be consider-
ed at the regular meeting of the City Council to be held on June 10th,
1957, and such proposed sale shall either be authorized or denied.

Commissioner Camobell moved that, in view of an apparent hard-
ship, the request of Mr. Burghardt be granted and permit be is-
sued for a three foot extension of present garage. Motion sec-
onded by Commissioner Strong and unanimously carried.
3. RE Request of Jane F. Colwell for Deviation on Lots 89 and 90, Blk.

Commissioner Strong moved that the request of Jane F. Colwell be
granted as recommended by the Planning Board. Motion seconded

League, dated May 8th, 1957, wherein many recommendations for the im-
mediate and satisfactory operation of the Public Beach in Palm Beach
Shore Acres, were submitted:

Dear Sir:
The Delray Beach Civic League, after conducting a survey re-
garding the usage of the beech facilities, respectfully submit
the following recommendations:
1. The employment of a Certified Life Guard. (In this
resnect it was found that there were no local resi-
dents who could meet the requirements. However the
services of Mr. Winifred Mosely of Miami, Florida can
be secured. Mr. Mosely meets the requirements and has
a wealth of experience.
2. That a permanent 24 Hour Patrol Service be instituted
immediately to safeguard the lives and property of the
people and the City of Delray.
3.That the hours for usage of the swimming facilities at
the beach be set from 9:00 AM to 6:00 PM daily.

4. That Mr. A. H. Walker of Delray Beach be immediately
employed to set up and maintain the 24 Hour service.
This recommendation of Mr. Walker, by the Delray Bch
Civic League is based uuon our confidence in his in-
tegrity and ability, and the fact that he is thor~
oughly familiar with the situation as it exists. We
further feel that his services would prove beneficial,
not only to the bathers, but to the City of Delray
Beach in that he is qualified and capable of handling
the many problems which will inevitably arise from our
usage of the beach facilities.
5. That an additional room be constructed adjoining the
bath house to house the personnel of the Patrol. It
is also felt that the future employment of an additional
person will be necessary to assure the 24 hour coverage.
6. That the present facilities be opened immediately for
use as a picnic, boating, and play area to meet the needs
which will arise as early as May 20th, the first off the
summer holidays.
Two members of the Delray Beach Civic League visited the
beach on Sunday April 29th, at separate hours, with the follow-
ing observations:
Broken glass was strewn over the ,arking area apparently
to discourage the parking of cars thereon.
Was a-,roached by three men, and one man respectively
identities unknown, who inquired as to whether the
Negro residents planned to use the beach. Upon being
assured that such was the case, these men levelled
threats of dynamiting and Klan activity.
Based upon this, we resnectull request that the Patrol be
established immediately, without fanfare or publicity, to pre-
vent further m,,~tilation of the area and the possible., planting
of any devices which would jeopardize the lives and safety of
the bathers.

The City Manager further informed the Council of the estimated
cost, in the amount of $12,000. to ~13,000., for making necessary im-
provements, and supplying needed equioment and personnel for operation
of this Public Beach.
Commissioner Campbell moved that the City Manager be authorized to pro-
ceed as follows, at this time, and provide necessary funds, from Un-
apnropriated Surplus, to meet the expense thereof;
1. Proceed with the erection of a building on Lot 14, Block "A",
Palm Beach Shore Acres, for the purpose of furnishing toilet
and dressing room facilities, at a location which the Manager
shall determine to be most feasible with respect for possible
storm damage as well as practicalness for installation of
water service.
2. To su~uly necessary Beach Equipment such as Buoys and Life Lines,
Safety e0uipment, Picnic Benches, Trash Cans, Water and Phone
Service.
3. To provide for the emnloyment of a Property Guard, as well as a
qualified Life G,mrd.

Commissioner Strong moved that Bills, in the amount of ~264, 925. 07,
be paid, subject to the aporoval of the Finance Committee. Motion sec-
onded by Commissioner R. J. Holland and unanimously carried.
Commissioner Campbell moved that the City Manager be authorized
to execute the standard agreement with the Florida Power & Light Company
for furnishing power needs for operation of the NEW ~ELL located at $.
Swinton Avenue and 10th Street. Motion seconded by Commissioner Strong
and unanimously agreed upon.
Commissioner Campbell moved that payment of the City Attorney's
Bill, in the amount of $50.00, covering services rendered in connect-
ion.with the necessity, if any, of granting a franchise for natural
gas pipe line service, be effected. Motion seconded by Commissioner
R. J. Holland and unanimously carried.
City Manager Lawson advised the Council that a study had been
made of Water Service Charges in various other towns and cities in
South Florida, by the Public Works Department, resulting in the re-
commended proposed Schedule for k'ater Service Connection Charges for
the City of Delray Beach, as shown below:

Commissioner Campbell moved that the Schedule of Water Service
Connection Charges, as recommended by the City Manager and listed in
the foregoing paragraph, be adopted and made effective as soon as
possible. Motion seconded by Commissioner Strong and unanimously
carried.
The City Manager referred to a list of Water Consumption Bills,
for the period October let, 1955 to Se0t. 30th, 1956, PAID BY the City
of Delray Beach, previously submitted to the Council Members.
Commissioner Campbell moved that Churches and the Woman's Club
be billed for all water consumed. Motion seconded by Commissioner R.
J. Holland and unanimously carried.
Concerning water consumption by the Little League Ball Field,
and the Pony League Ball Park, operations thereof, respectively ad-
ministered by the American Legion and the Veterans of Foreign Wars,
Commissioner Campbell believed that said parties should be billed
for all water consumed, and that such expense, together with all
other expenditures for a fiscal year, should be anticipated in ac-
cordance with budgetary procedure, as expected of all departments
within a government, by both groups and incorporated in their Budget
Request.
Following a general discussion on this matter, Commissioner
Strong moved that, for the present, Water be furnished both Play-
grounds by the City of Delray Beach. Motion was seconded by Com-
missioner R. J. Holland and unanimously carried.
City Manager Lawson informed the Council of having received a
request from Mr. John MacNab, who desires to move an existing house
from Lot 10, North Ocean Beach Lots, to Lot 1 of Ocean Breeze Estates.
Commissioner Campbell moved that the Building Inspector provide
for a public hearing concerning the request of Mr. MacNab. Motion was
seconded by Commissioner Strong and unanimously carried.

Co~missioner Strong moved for the appointment of Att'y. Arthur
Holloway, as an additional judge ad litum, as requested by John C.
Williams, Judge of M~micipal Court. Motion was seconded by Commission-
er R. J. Holland and unanimously carried.
Commissioner Strong moved that the City Attorney be instructed to
prepare an amendment to Section 20-2 of Chapter 20,' Code of Ordinances
for the City of Delray Beach, Florida, to provide for two (2) addition-
al members to the Planning Board, appointment for which will be in com-
pliance with Sec. 20-3, of said Chapter Twenty (20). Hotion was second-
ed by Commissioner Campbell and unanimously carried.
Commissioner Strong suggested that the City Attorney prepare, for
Council consideration, an Ordinance providing for requirement of BOND,
to be executed by House Movers, in favor of the City of Delray Beach,
Florida, prior to any movement of construction through the City of
Delray Beach.
The City Hanager was requested to prepare a List of Streets which
he and the Chief of Police determine should be FREE from Truck Traffic,
For consideration by the Council at the next regular meeting.
City Manager Lawson informed the Council, concerning Liability
Insurance Coverage previously discussed, as follows;
Letter from "The Plastridge Agency, Inc.," dated May 13th, 1957, In
Part:
1. The City's Liability Policy, as presently written, affords no
coverage Fo~ the individual policeman who might hurt someone
and be held individually liable. All references to individual
policemen herein pertains only to 'Volunteer Policemen',
2. It is felt there is coverage under the Workmen's Compensation
Policy, but since the present carrier (Ohio Casualty Company)
seems in doubt, we have asked that coverage specifically be
made a matter of contract by an endorsement to the policy.
Further information and clarification of this issue will be furnished
the Council as soon as received.
Hayor Warren read a letter from Robert C. Roy Agency, Inc., and
also one from the Ohio Casualty Insurance Company, wherein high praise
was extended to the Manager For the City of Delray Beach, as evidenced
by the fact that the insurance company's investigators have only a
limited number of minor recommendations for safety measures ~liability
insurance wise) in and around local city owned buildings, there having
been such an apparent corrective measures and careful planning program
effected during the past two (2) years, which has resulted in favorable
comment by Liability Insurance Carriers for local conditions For the
first time in the City's history.
The City Manager advised that steps have been taken to comply w±th
the recommendations of Ohio Casualty Insurance Company, with the single
exception of the wiring in the Civic Center building.
Commissioner Campbell moved that the request of Mr. Boldt, con-
cerning construction of a quonset type building on S. E. 2nd Avenue,
be tabled for fm~ther study. Motion seconded by Commissioner Strong and
agreed u~on.
Mayor W~rren announced that, due to vacations of various Commiss-
ioners, the next regular meeting of the Council will be advanced to May
20th, 1957, at 7:30 P.M., in the Council Chambers.
At the request of the City Manager motion was made by Commission-
er Strong that engineering services be employed to survey and recommend
proner method for .~rovidtng DI~AINAGE for that area South of Atlantic
Avenue and East of the Intracoastal Waterway, through the Village and
southerly through Seagate "A" and "B". Motion was seconded by Com-
missioner R. J. Holland and unanimously carried.

use of 2-way Radio Communication Service on the Radio Frequency of
the Police Department, as recommended by the Chief of Police, subject
to all equipment and installation expense to he borne by Boyd's Body
Shop, and, further, that this consideration is not to be recognized
as an exclusive commitment. Motion was seconded by Con~nissioner Camp-
bell and unanimo~sly carried.
