A Special Meeting of the City Council of Delray Beach, Florida,
was held in the Council Chambers in the City Hall, at 2:30 o'clock
P.M., with Mayor George V. Warren in the Chair, City Manager W. E.
Lawson Jr., City Attorney Harx~y T. Newett and the following Com-
missioners being present, Col. Dugal G. Campbell, R. J. Holland,
Martha E. Holland and Catherine E. Strong.
City Manager Lawson read tentative Reports from the Planning
Board as presented by said Board's Vice,Chairman James I. Sinks.
Commissioner Campbell moved that permissive use of the proper-
ty located on the N.E. Corner of N.W. 1st Avenue and 3rd Street,
Lot 14, Block 57, owned by Dr. Charles W. Vogler, be granted Dr,
Vogler, as recommended by the Planning Board, for establishing his
office for the practice of Osteopathic Medicine. Motion seconded
by Commissioner R. J. Holland and unanimously carriede
Commissioner Campbell moved for approval of dimension changes on
Plat of "Hammond Property", Pl. Bk. 24 Pm. ge 248, as shown below and
recommended by the Planning Board;

Commissioner Strong moved for acceptance of the Planning Board's
r$commendation and the granting of Mr~ O. C~ Plaxico's request for
permit to ~ construct an inclosed Patio or Porch on the West side of
the Arville Tea Room, located~on Lots 14, 15 and 16 in Block 1 of
Ocean Pa~k S/D, per plan submitted. Motion seconded by Commissioner
R. J. Holland and unanimously carried.
Commissioner Campbell moved to grant Mr. We C. Burton~permit~ to
construct and Addition to the apartment building on Lots 4, 5 and 6
in Block 2 in Ocean P~rk, in accordance with plans submitted, as
recommended by the PlAnning Board and SUBJECT TO conditions of said
recommendation in its entirety, being - "The Planning Board recom-
mends granting Mr. W. C~ Burtonts permit So.Construct an Addition
to the apartment .bui,lding on Lots 4, 5 and 6, Block 2, Ocean Par.k,
in accordance with plans submitted, resulting in an ultimate set
back of five (5) feet fr~m the property line and further subject to
such construction not to be considered part of condemnation costs
should Bronson Street ever be wide'ed:' Motion seconded by Commis-
sioner Strong and unanimously agreed.
Commissioner Stron~ m~ved to deny the request of Mr. William M.
Miller, developer of Rio Del Re~ Shores, for leasing of City owned
land described as - "That part of Lot Nine (9) Block Two (2) in Sec-
tion 21-46-43, lying East of U.S.No. 1, pe~r plat thereof recorded in
the public records of Palm Beach County. M, tion was semonded by
Commissioner Campbell and. unanimously carried.
Concerning the recommendation of the Planning Board relative to
granting of Cornices and Eaves to extend not m~re than three (3)
feet over ~front, side and rear yard set-~ack requirements, and fol-
lowing Commissioner Campbell being assured by Mr. Sinks that such
recommendation is intended to govern and-~recognize Set-Back require-
ments heretofore understood and interpreted from the Code, Oommis-
sion~r Strong moved that said recommendation be referred to the City
Attorney who shall prepare an amending ordinance based thereon for
consideration by the Council at the next r~gutar meeting. Motion
was seconded by Commissioner M~ K. Holland and unanimously agreed.
OCTOBER 1st, 1957
Following general discussion concerning Deposit of the Proceeds
from the Sale of Water Revenue Certificates, Series 1957, of the
City of Delray Beach, Florida, and in accordance with policy pre-
viously established pertaining to deposits of municipal funds, Com-
missioner Campbell moved that said Moneys be placed in the proper
funds, in as near equal amounts as posaible, in the First National
Bank of Delray Beach and the Del~ay Beach National Bank, said Depos-
its to be made on the terms eubmitted this day by the above named
Banks. Motion was seconded by Commissioner Strong and unanimously
carried.
The City Attorney was instructed to phone the interested parties
in New York City advising them of the Council ts decision relative to
Deposit of said proceeds of salee
City Attorney Newett read a letter from Mr. C. T. McCreedy where-
in the City Attorney was advised of various procedures to follow in
New York City concorning final acts in the closing of the Sale of
Water Revenue Certificates - Series 1957, and affecting delivery of
same to Ira Haupt & Co.
Reviewing usual and past policy concerning the City Attorney.'s
remuneration for services rendered pertaining to the preparation,
validation and ultimate sale of Water Revenue Certificates - Series
1957, of the City of Delray Beach, Florida, Commissioner Strong
moved that the City Attorney be paid one (1) percent of actual con-
struction costs, estimated by Smith & Gillespie to be $975,000,
covering the Water Works Improvement Program provided for from the
proceeds of the Water Revenue Certificates Sale hereinbefore referred
to. Motion seconded by Commissioner M. K. Holland and unanimously

City Manager Lawson submitted Bids, requested by the Council at
the previous meeting, for one (1) 1957 Two-Door Sedan for use by
the Police Department ts newly created detective department:
