A Regular Meeting of the City Council of Delray Beach, Florida,
was held in the Council Chambers in the City Hall, at 7:30 P. M,,
with Mayor George V. Warren in the Chair, City Manager W. E. Lawson
Jr., City Attorney Harry T. Newett and the following Council Members
betng'present, Col. Dugal G. Campbell, Mr. R. J. Holland, Mrs. M. K.
Holland and Mrs. Catherine E. Strong.
An opening prayer was delivered by Rev. Robert G. Morey.
Commissioner Campbell moved for approval of the Minutes for the
regular meeting of the Council held on October 14th, as written.
Motion seconded by Commissioner R. J. Holland and unanimously agreed.
Mayor Warren then read the names of those qualified candidates
for Councilman, filed as of 5:00 P.M., Monday, October 28th, 1957,

and extended a welcome to all qualified candidates.
City Manager Lawson reminded the Council that Resolution No.
lO71, adopted on October 14th, scheduled this meeting for a Public
Hearing concerning the proposed installation of storm drains on N.
E. 2nd Street between Swinton Avenue and the Intra-coastal Waterway
and also on N.E. 3rd Avenue between 2nd and ~th Streets.
Mr. C. J. Manson, speaking on behalf of twenty-seven property
owners, in the neighborhood of N.E. 4th Street between Swinton Ave
and the F.E.C. RR., protested this proposed drainage improVement
on the basis that said property owners did not believe their prop-
erties would be.~benefitted to the extent they would doubtless be
assessed, and requested the Council to defer action on a Resolution
providing for such improvement to-proceed until further study of
a determined benefitted area could be made.
Mr. A. J. Michael inquired if such an improvement would tie in
with an over-all sewage disposal system which will be necessary~in
the near future, and further that ~he did not believe satisfactory
drainage to the Waterway could be effected at high tide.
Mr. Harry McKean, a registered engineer, protested the proposed
assessment and .determined benefitted area,and further felt that the
intended size of tho drains should be increased to tie-in wi th the
outfalls of tho State Road Board to be provided in conjunction with
the road improvement through Delray Beach, by the S.R.D. on E. Fifth
and Sixth Avenues. Mr. McKean £urther believed it would be wise to
defer this proposed improvement until the State's program was known.
Commissioner Campbell moved that, due to many factors involved
in this proposed drainage improvement, this project be tabled until
next meeting at which time the Council will consider a Report which
is requested be provided by a committee, composed of the City Manager,
the City Engineer, Col. Fabens of the Planning Board, and Mr. Harry
J. McKean, which committee ~shall arrange a oonference with the Share
Engineer to determine to what extent that office will co-operate with
the City as it is possible that the contemplated road improvement
may be used tG advantage in helping to solve our drainage problem.
Motion .seconded by Commissioner R. J. Holland and unanimously agreed.
~ Mr. John ManSweden and Mr. Lee Smith, of the Chamber of Commerce,
displayed a sample of the p~oposed Christmas Lighting Program deco-
ration and assured the Counci~l that their request of $1,000.00 aid
from the. City would preclude any further similar request for such
program for a three(3) year period.
Commissioner R. J. Holland moved that the City donate, to the
Chamber of Commerce, $1,000,00 for thc ChristmasLighting Program
subject to the above understanding with Mr. Smith and Mr. VanSweden.
Motion seconded .by Commissioner Ca~mpbell and unanimously carried.
Mr. VanSweden informed the Council that arrangements had been
made with Florida Power & Light whieh will assure the street Christ-
mas Lighting to be effected November 18th,

Mayor Warren informed the Council of having received acknow-
ledgments from Governor LeRoy Collins, Sec. of State R. A. Gray and
State Treasurer J. Edwin Larson, for telegrams sent by the Mayor in
protest to the naming of a University in Tampa -" University of
South Florida." The ultimate name of this University wa~, however,
University of South Florida as recommended by the State Board of
Control and accepted by the State Board of Education.
The City Manager then read Resolution No. 1072:

City Manager Lawson then read Resolution No. 1073:

Commissioner Strong moved that Resolution No. 1073 be passed
and adopted on this first and final reading. Motion seconded by
Commissioner M. K. Holland and unanimously agreed.
Mayor Warren inquired if the City was not in a position .to main-
rain clearance of vacant lots following the initial clearance by the
owner of the property and was advised by the City Manager that the
present City Council had determined that the City was unable to fi-
nance such a program.
Commissioner Campbell requested the City Manager and City Attorney
to provide some method of stepping up the lot clearing program and
to also solicit the co-operation of Milk Dealers and Distributors
in eliminating the accumulation of empty bottles and cases at various
corners in the city.
City Manager Lawson read the report from the Planning Board date~
October 19th, concerning Mr. O. C. Plaxico's deviation request for
the Arvilla Hotel.
Commissioner Strong moved to accept the recommendati0n~'of the
Planning Board and to grant the request of Mr. Plaxico con~erning
an addition to the S~rvilla Hotel of an enclosed porch on the west
end of the hotel. Motion seconded by Commissioner Campbell and
unanimously agreed.

The City Nanager then read the Planning Board's report of October
21st, relative to Ordinance No. G-275 - "To regulate Cornices and
Eaves, Projections and Encroachments, Walls and Fences" - which had
been referred back to the Planning Board at the regular meeting held
on October 14th for clarification, and followed by reading amended
Ordinance No. G-275'.
AN ORDINANCE RELATING TO ZONING, SUPPLENENTING
SECTION 29-?e6 0F THE CODE OF ORDINANCES OF THE
CITY OF DELRAY BEACH, FLORIDA, TO REGULATE AND
RESTRICT CORNICES AND EAVES, PROJECTIONS AND
ENCROACH~ENTS, WALLS AND FENCES IN THE CITY OF
DELRAY BEACH, FLORIDA.
Commissioner Campbell moved to place Ordinance No. G-275 on first
reading. Notion seconded by Commissioner Strong and unanimously
carried,
City Nanager Lawson submitted the Planning Board's Report of Oc-
tober 21st concerning the request of William N. Niller to lease
Waterway frontage adjacent to and south of Rio Del Rey Shores.
Nr. Joe Kern informed the Council that the proposed lease was
similar to that of the City Docks lease.
Commissioner Strong stated that as a member of the Finance Com-
mittee she considers the terms offered too low and the proposed life
of the requested lease too long.
Commissioner Campbell moved that said request of Nr. William
~iller, for lease of Waterway frontage referred to in preceding par-
agraph, be denied. Notion seconded by Commissioner R. Jo Holland
and unanimously agreed~
The City Nanager presented the Planning Board's Report of October
21st concerning the subdivision proposed by Ellen D. Wightman and
Louise D. Nee. de, between N.~, 12th and 14th Avenues and abutting on
the south side of second street.
~[r. Curtis Dodson, speaking for the developers, assured the Coun-
cil that the Subdividers would provide, by dedication, a strip of
land on the west end of the subdivision, as requested by the Planning
Board, to provide for the extension of N.W. l~th Avenue, as indicate~
in red on proposed plat of said S/D previously submitted, and fur-
ther to sign an agreement, subject to approval by the City Nanager,
that paving 22 feet wide, rather than 20 feet as shoWn, and public
easements for utilities would be provided.
Commissioner Campbell moved to accept the Planning Board's recom-
mendation, subject to all conditions outlined therein, and tc approve
the amended sketch of the proposed S/D, subject to final plat in-
corporating the amendments as shown on said sketch hereby approved,
and further subject to the City ~anager~s approval of such agreement
as referred to above. ~otion seconded by Commissioner R. J. Holland

City Nanager Lawson the~ read the Planning Board's Report dated
October 25th concerning a replat og a portion of Section 4 - Tropic
Isles to provide for a proposed plRn for improvement of drainage in
Tropic ~alms S/D and the neighboring S/D of Hidden Valley, which will
also include a canal through Tropic Isle - Section 4. This proposed
drainage improvement causes a replat of Lots N-4, N-~, N-6, N-y, 490
thru 496 inclusive,4500 thru 503 inclusive, 534, 557 thru ~67 inclu
sire, in said Sec. of Tropic Isle S/D, as shown on sketch sub-
mitted.
~r, Henry J. Nellon and Nr. William Grimditch of North Tropic
Isles, Inc., assured the Council of the benefits tc be obtained in
this proposed drainage improvement, and of paramount importance
prior to any further consideration relative to additional annexation
of lands in Tropic Palms.
commissioner Campbell moved for tentative acceptance of
Nellon's submitted replat of Sec, 4 - Tropic Isle, pending negotia-
tions between the County Commission, North Tropic Isles, Inc., South
Coast Development Corp., (Tropic Palms) and any other parties as to
final acceptance of the canal location by the various parties in-
volved, as recommended by the Planning Board. Notion seconded by
Commissioner Strong and unanimously agreed.
The City l~lanager then read the Planning Board's Report of October
R6th concerning plans of Nr. L. D. Tenerelli for proposed construc-
tion on Lots 2, 3, 4, 5, ll, 12 and 13, Block l, Ocean Park, Delray
Beach, Florida, copy of which Report is attached to and forms a part
of these minutes.

Att'y. Neil E. MacMillan, representing Mr. 'renerelli, advised of
having met with the Planning Board on October 21st at which time a
majority of the Board were in favor of approving the proposed plans
submitted by Mr. Tenerelli, and that he had not been notified of the
Planning Board again meeting on October 25th to reconsider this
matter, at which latter meeting the Board reversed its previous ap-
proval.
Mr. John Thayer expressed the desire of the Beach Tax Payers
League that the City Council ~hold the Eoning Code and its contents,
particularly Sections 1% and l~ thereof, and not deviate from the
established Brockway Line, but, if deviation is to be considered,
that a Public Hearing be provided.
Attorney MaeMilla~ reminded the Council of the action by property
owners on Atlantic A .enue in dedicating land for the widening of said
Atlantic AvenUe, 'asea u~ an understanding that their front proper~y
line, prior to dedication, remain the same for future set-back re-
quirements, and further, referred to action of the Council at the
regular meeting of June 24th, 1957, which caused Mr. Tenerelli to
expend considerable money in preparation of Plans and provisions for
improvement of said lands.
City Attorney Harry T. Newett stated that, concerning Covenants
between parties, no legislation shall impair on the terms of any
legal contract, and further informed the Council that under existing
circumstances, no legal obligation requires the City to pay for the
17 feet accepted from Mrs. Grace Weir in 1947, per Resolution No. 640.
Following a general discussion 8f actions taken by prior Councils,
relative to this matter, and terms, if any, under which the City of
Delray Beach accepted the E 17 ft thereof, Commissioner Campbell
moved that this item be tabled until the next regular meeting, two
weeks hence, to allow further study and possible added legal advice.
Motion seconded by Commissioner R. J. Holland and upon Call of Roll
Commissioners Campbell, R. J. Holland, M. K. Holland and Mayor Warren
voted in favor thereof, Commiss~oner Strong being opposed.
Commissioner Campbell moved for appointment of Mr. J. Stuart Lank-
ton to the Planning Board and Eoning Commission for a period of five
(5) years as reco~mmended by the remaining members of the Board. Mo-
tion seconded by Commissioner Strong and unanimously agreed.
Commissioner Campbell moved to deny the request of Mr. Joe Johnson
for a Beer & Wine License at 27 N.W. 5th Avenue, due to proximity of
churches. Motion seconded by Commissioner Strong and unanimously
c art i ed.
Commissioner Campbell inquired of the City Attorney as to what
power the City might possess to require better controls of activities
in and around Georgia Town Tavern and the Attorney read excerpt of
the Charter, pertaining to violations necessary to cause revocation
of a License.
Commissioner Strong moved that Georgia Town Tavern be advised to
clean-up the Tavern and evidence complete control of its activities
within thirty (30) days or expect to be called before the Council.
Motion seconded by Commissioner Campbell and unanimously agreed.
Commissioner Campbell moved that Bills, in the amount of $21,892.1%,
as presented by the City Manager, be paid subject to approval of the
Finance Committee. Motion seconded by Commissioner M. K. Holland and
unanimously carried.
Commissioner 'Campbell moved that the request of Jehovals Witnesses,
for permit to use a fire-proof tent on December let only, and the re-
quest of the Sherman William Post Number 188 for a permit to use a
fire-proof tent November llth thru November 16th in conjunction with
their annual carnival provided by Miller Amusement Carnival, be
granted. Motion seconded by Commissioner R. J. Holland and unani-
mously agreed.
Commissioner Campbell moved that the City Manager be requested to
take forceful action, at once, against the property owners who are
renting premises not equipped with running water nor water closets or
toilets, and are forcing tenants to use privies, as continued viola-
tions might well cause an epidemic. Motion seconded by Commissioner
Strong and unanimously carried.
Mayor Warren read a Notice received from the Florida League of
Municipalities advising of the Annual Convention being scheduled for
November 17th to 19th inclusive, at Daytona Beach, with headquarters
being located at The Daytona Plaza Hotel, and recommended that the

League be notified, with regret, if it is determined that no repre-
sentatives of Delray Beach will be able to attend.
City Manager Lawson informed the Council of having received a
request from the Royal Palm Ice Company for an extension of time
to provide for excess water disposal due to their fiscal year op-
eration and Commissioner Campbell moved to grant said request for
ninety (90) days from January 1st, 1958. Motion seconded by Com-
missioner R. J. Holland and unanimously agreed.
Mayor Warren read the following letter from Seacrest High School
P.T.A.
October 16, 1957.
CITY COMMISSION,
Delray Beach, Florida.
Gentlemen:
The Executive Board of the Seacrest High School Parent
Teacher's Association at their meeting on October 15th, 1957,
greed that they are not in favor of a Curfew Ordinance for Del-
ray Beach.
They have not had an opportunity to bring this matter
before the total membership of the association.

enter into a month to month contract with Mr. Ernie Deutsch for
rental of the property at S.E.2nd Avenue and 1st Street, on Lot

Commissioner R. J. Holland moved to authorize execution of an
Agreement with the F.E.C. RR., for installations of Water.Mains be-
neath the R.R. property at N.E. 3rd Street and S,E. 6th Street. Mo-

Mayor Warren presented an invitation, just received, from Mr.
F. H. Christie, Chairman, Airports Board, extended to officials of
the City of Delray Beach, to attend the Official Opening of Nassau's
International Air Terminal Building by His Excellency Sir Raynor
Arthur, K.C.M.G., C.V.O. at 4:30 P.M. on the 16th of November,
and being unable to attend, due to prior commitment, suggested that
Vice Mayor R. J. Holland and Commissioner M. K. Holland arrange to
attend this Opening.
